was taken and” the–_ accused was Dut to trial for offence<\/p>\n
 3r3V8~—3-f”the Act. The respondent initiated<\/p>\n
.W.proVse’cuti\u00abo_nl iag\u00e9iinst the petitioner for offence under Section<\/p>\n
138″”0ef  on the ground that in relation to the<\/p>\n
in~-.__’v.transactivo’r\u00a7 of supply of liquor to the firm run by the<\/p>\n
  Cpentitii’o~ner, a sum of Rs.3,83,0G0\/- became due. Towards<\/p>\n
‘V’-____””.’disgcharge of the liablity, the accused issued the impugned<\/p>\n
lfhcheque, which was dishonoured on presentation. Based on<\/p>\n
the bank endorsement, statutory notice was issued which<\/p>\n
was also not complied. The accused denied liability  on<\/p>\n
the ground that he had nothing to do with <\/p>\n
Wines. He was only a servant and did not  , <\/p>\n
denied that the liquor was purchasedg-from’~tgh{e..’corra~.p’lainant<\/p>\n
and denied the amount due.*H.owevV’er_ the trriai<\/p>\n
the complainant had establisheldythe charge’andfgconvicted<\/p>\n
him against which was —i..r_rf.:rin’7_1inawi .l’a*;1peal.ywhich also failed.<\/p>\n
4. As c.o~r~;.I..:Cl’p:-_be  n..oVV’V”dispute that the
\ncheque   the accused and the
\ncomp|:ai’n’a’n\u00bbti:has;’:t\u00a7e’nde:rged’ eyid~ence through its authorised
\nagent :’tha’t_it’  liquoer Prashantha Wines in<\/p>\n
which the”~\u00ab.accuse_dl1was~7′ the Manager. Whether he was<\/p>\n
 Pr-o:_p*rietAoi’.,yor th”e~S.e.rvant is not the question. The accused<\/p>\n
  his signature on the cheque and it is not<\/p>\n
denied that it was issued to the complainant. Mere<\/p>\n
 contentionv that he was not the Proprietor of the firm does<\/p>\n
A  not”~\u00ab_.affect the incriminating evidence tendered by the<\/p>\n
  ‘complainant.\n<\/p>\n
