Justice V.GIRI\n\n Dated :28\/08\/2009\n\n O R D E R\n                       V.GIRI, J\n                    .......................\n                  W.P.(C).24952\/2009\n                    .......................\n       Dated this the 28th day of August, 2009\n\n                     JUDGMENT\n<\/pre>\n<p>     Petitioner is aggrieved by Ext.P8 order passed<\/p>\n<p>by the additional Tahsildar under the                  Land<\/p>\n<p>Conservancy Act. Petitioner preferred an appeal as<\/p>\n<p>Ext.P10 before the Revenue Divisional Officer who<\/p>\n<p>has returned the appeal directing that if there is no<\/p>\n<p>local Society in the place functioning,            then the<\/p>\n<p>original order should stand.            Obviously there is a<\/p>\n<p>complete failure on the part of the appellate authority<\/p>\n<p>to   exercise    its  jurisdiction         and   since   the<\/p>\n<p>aforementioned endorsements in Ext.P10 cannot,<\/p>\n<p>under any circumstances, be treated as an appellate<\/p>\n<p>order or reflective of a proper exercise of jurisdiction<\/p>\n<p>by the appellate authority, there will be a direction to<\/p>\n<p>the 2nd respondent to receive on file Ext.P10 and pass<\/p>\n<p>an order thereon, after hearing the petitioner, within<\/p>\n<p>two months from the date of receipt of a copy of this<\/p>\n<p>judgment.
