Sai, Advocates  \n\n \n\n \u00a0\n\n \n\n Dated : \n22.03.2007 \n\n \n\n \u00a0\n\n ORDER \n<\/pre>\n<p> \u00a0<\/p>\n<p> \u00a0<\/p>\n<p> Heard the Learned<br \/>\nCounsel for the parties. This Revision<br \/>\nPetition is filed against the judgement and order dated  7th August, 2003 passed by the A.P.<br \/>\nState Consumer Disputes Redressal Commission in Appeal No.135 of 1999 by which<br \/>\nthe order passed by the District Forum is confirmed. The District Forum by its order dated  25th February, 1999 directed the<br \/>\nPetitioner to pay a compensation of Rs.7,500\/- for<br \/>\nsale of defective chilli seeds to the Complainant. The State Commission also considered the fact<br \/>\nthat there was sufficient evidence on record to establish that Complainant had<br \/>\npurchased the seeds from the Petitioner.<br \/>\nThe District Forum as well as the State Commission arrived at the<br \/>\nconclusion that the yield of the chilli crop was not<br \/>\nas per the advertisement or brochure.\n<\/p>\n<p>Against that judgement, this Revision Petition is filed by the dealer.\n<\/p>\n<p> Considering the findings of fact recorded by<br \/>\nthe District Forum and the State Commission, it is apparent that seeds supplied<br \/>\nby the Petitioner were defective and that the Complainant has suffered the loss<br \/>\nbecause the yield was minimum and not as per the brochure.\n<\/p>\n<p> However, Learned Counsel appearing on<br \/>\nbehalf of the Petitioner submits that Petitioner is a dealer and he is not<br \/>\npersonally liable for defective seeds and therefore order ought not to<br \/>\nhave been passed against him without joining manufacturing firm as party,<br \/>\nnamely, Hindustan Seeds Corporation.\n<\/p>\n<p> In our view, no doubt, the<br \/>\nmanufacturer would have been a proper party but at the same time the Petitioner<br \/>\nis a person who has supplied and sold the seeds to the Complainant, therefore,<br \/>\ncomplaint was maintainable against the Petitioner. If Petitioner has any grievance, it is open<br \/>\nto the Petitioner to recover the amount<br \/>\nordered from the manufacturer by filing appropriate proceedings, but it<br \/>\ncannot be said that the Petitioner, a dealer, who has sold the seeds, is not liable.\n<\/p>\n<p> Lastly, Learned Counsel for the<br \/>\nPetitioner submits that there was no question of directing the Petitioner to<br \/>\npay the interest @12% p.a. from the date of complaint till the date of payment.\n<\/p>\n<p> It<br \/>\nis also to be stated that as per the interim order, in all, Petitioner has<br \/>\ndeposited Rs.11,800\/-. The amount deposited by the Petitioner with the District<br \/>\nForum shall be considered as full and final payment to the Complainant. It would be open to the Complainant tp withdraw the same if not withdrawn.\n<\/p>\n<p> \u00a0<\/p>\n<p> Considering<br \/>\nthis aspect, in<br \/>\nour view, impugned<br \/>\norder passed by the<br \/>\nState Commission does not call<br \/>\nfor any modification.\n<\/p>\n<p> In the result, Revision Petition<br \/>\nstands disposed of accordingly.
