DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 31\/03\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>Learned<br \/>\n\tcounsel appearing for the applicant submits that investigation is<br \/>\n\tover and charge sheet is filed.\n<\/p>\n<p>\tIt is further submitted that the applicant is attributed with<br \/>\n\tinflicting fist and kick blows while cause of death is injury on<br \/>\n\tthigh caused by sword and knife used by one Shabbirmiya and another<br \/>\n\tco-accused and not by the applicant.  It is further submitted<br \/>\n\tthat the applicant has roots in the society and will<br \/>\n\tnot flee from justice. It is further submitted that by imposing<br \/>\n\tsuitable conditions, the applicant may be enlarged on bail.\n<\/p>\n<p>Heard<br \/>\n\tlearned APP  for the respondent &#8211; State.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel for the parties and perusing the record of the<br \/>\n\tcase and taking into consideration the facts of the case, nature of<br \/>\n\tallegations, role attributed to the accused and punishment<br \/>\n\tprescribed for the alleged offences coupled with the fact that<br \/>\n\tcharge sheet is filed, without discussing the evidence in<br \/>\n\tdetail, at this stage, I am inclined to enlarge the applicant on<br \/>\n\tbail  in connection with C.R.No.I-116\/2010 of Shahpur Police Station<br \/>\n\t for the offences punishable under sections 302, 323, 324, 114 of<br \/>\n\tthe Indian Penal Code and under section 135(1) of Bombay Police Act,<br \/>\n\ton furnishing   bond of Rs.10,000\/- (Rupees ten thousand only) with<br \/>\n\tone surety of the like amount to the satisfaction of the lower Court<br \/>\n\tand on conditions that the applicant shall :\n<\/p>\n<p>[a]\tnot take<br \/>\nundue advantage of liberty or abuse liberty;\n<\/p>\n<p>[b]\tnot act in<br \/>\na manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c]\tmaintain<br \/>\nlaw and order;\n<\/p>\n<p>[d]\tmark<br \/>\npresence before the concerned  Police Station on every 1st<br \/>\nand 15th day of English Calender month between  11.00 a.m.<br \/>\nand 2 p.m .\n<\/p>\n<p>[e]\tnot leave<br \/>\nthe State of Gujarat without prior permission of the Sessions \tJudge<br \/>\nconcerned;\n<\/p>\n<p>[f]\tfurnish the<br \/>\naddress of residence at the time of execution of the \tbond and shall<br \/>\nnot change the residence without prior permission of  this Court;\n<\/p>\n<p>[g]\tsurrender<br \/>\npassport, if any, to the Lower Court immediately.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed,  the Sessions<br \/>\n\tJudge concerned will be free  to take appropriate action in the<br \/>\n\tmatter.\n<\/p>\n<p>Bail<br \/>\n\tbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute.
