Justice ANTONY DOMINIC\n\n Dated :22\/09\/2010\n\n O R D E R\n                       ANTONY DOMINIC, J.\n              --------------------------------------------------\n                 W.P.(C) NO.29187 OF 2010(W)\n              --------------------------------------------------\n         Dated this the 22nd day of September, 2010\n\n                           J U D G M E N T\n<\/pre>\n<p>     A student facing disciplinary action initiated by the Principal<\/p>\n<p>of the School is the petitioner in this writ petition. Challenge in<\/p>\n<p>this writ petition is against the whole disciplinary proceedings.<\/p>\n<p>     2. Pleadings in the writ petition show that based on the<\/p>\n<p>report received from the police, petitioner was placed under<\/p>\n<p>suspension and Ext.P2 memo of charges was issued to him. On<\/p>\n<p>receipt of Ext.P2 memo of charges petitioner submitted his<\/p>\n<p>explanation and an Enquiry Committee was appointed. Enquiry<\/p>\n<p>was conducted, report was submitted to the disciplinary authority<\/p>\n<p>and    based on which show cause notice was issued and<\/p>\n<p>explanation was also filed. The          disciplinary authority has not<\/p>\n<p>taken any final decision in the matter. It is at this stage that the<\/p>\n<p>writ petition is filed.\n<\/p>\n<p>     3. In my view, the writ petition is premature for the reason<\/p>\n<p>that the disciplinary authority has not taken any final decision<\/p>\n<p>adverse to the petitioner and only after concluding the case and<\/p>\n<p>only if the decision of the disciplinary authority is against the<\/p>\n<p>WPC.No. 29187\/2010<br \/>\n<span class=\"hidden_text\">                                 :2 :<\/span><\/p>\n<p>petitioner, he can invoke the remedy available under Article 226<\/p>\n<p>of the Constitution of India.\n<\/p>\n<p>      Therefore, the writ petition is dismissed as premature.<\/p>\n<p>                                          (ANTONY DOMINIC)<br \/>\n                                                 JUDGE<br \/>\nvi\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Syam Mohan vs The Principal on 22 September, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 29187 of 2010(W) 1.
