BASANT, J.\n\n                     - - - - - - - - - - - - - - - - - - - - - -\n\n                       B.A.No.  1145  of   2008\n\n                     - - - - - - - - - - - - - - - - - - - - - -\n\n              Dated this the 25th day of  February, 2008\n\n\n                                  O R D E R\n<\/pre>\n<p>       Application   for   regular   bail.     The   petitioner   is   the   4th<\/p>\n<p>accused.   Altogether there are 15 accused persons.   The accused<\/p>\n<p>face allegations for offences punishable, inter alia, under Section<\/p>\n<p>308 I.P.C.  The injured belong to C.P.M. and the accused persons<\/p>\n<p>allegedly   owed   allegiance   to   NDF.     The   alleged   incident   took<\/p>\n<p>place   on   10.1.2008.     The   petitioner   was   arrested   on   19.1.2008.<\/p>\n<p>On   account   of   political   animosity,   an   attack   was   made   on   the<\/p>\n<p>victims   belonging   to   the   CPM   using   iron   rods.     No   serious\/<\/p>\n<p>grievous   injury   has   been   suffered.     Had   the   weapon   landed   on<\/p>\n<p>more vulnerable part of the body, death would have taken place.<\/p>\n<p>This is the allegations raised.  The petitioner continues in custody<\/p>\n<p>from 19.1.2008.    One of the co-accused  (A6) has  been arrested<\/p>\n<p>and  he has  already  been  enlarged  on bail.    It  is prayed that  the<\/p>\n<p>petitioner, who remains in custody from 19.1.2008, may now be<\/p>\n<p>enlarged on bail subject to appropriate terms and conditions.<\/p>\n<p>B.A.No.  1145  of   2008<\/p>\n<p><span class=\"hidden_text\">                                              2<\/span><\/p>\n<p>       2.    Notice  was  given.    The learned  Prosecutor  does  not  oppose<\/p>\n<p>the   application.     He   only   prays   that   appropriate   conditions   may   be<\/p>\n<p>imposed, considering the nature of the dispute, to ensure that there is<\/p>\n<p>no possibility of recurrence of the incident.<\/p>\n<p>       3.  Having considered all the relevant inputs,  I am satisfied that<\/p>\n<p>the petitioner can be granted regular bail.<\/p>\n<p>         4.  In the result:\n<\/p>\n<\/p>\n<p>       1)  This application is   allowed.\n<\/p>\n<\/p>\n<p>       2)  The petitioner shall be released on bail on the following terms<\/p>\n<p>and conditions.\n<\/p>\n<\/p>\n<p>       (a)  The petitioner shall execute a bond  for Rs.50,000\/-  (Rupees<\/p>\n<p>fifty thousand only)  with two solvent sureties each for the like sum to<\/p>\n<p>be satisfaction of the learned Magistrate.<\/p>\n<p>       (b)        He  shall  surrender  the  passport,     if  any.       If  there is  no<\/p>\n<p>passport,   an   affidavit   to   that   effect   shall   be   filed   before   the   learned<\/p>\n<p>Magistrate.\n<\/p>\n<\/p>\n<p>       (c)   He shall make himself available for interrogation before the<\/p>\n<p>Investigating   Officer     on   all   Mondays   and   Fridays     between   10   a.m.<\/p>\n<p>B.A.No.  1145  of   2008<\/p>\n<p><span class=\"hidden_text\">                                     3<\/span><\/p>\n<p>and 12 noon   for a period of three months and thereafter as and when<\/p>\n<p>directed by the Investigating Officer in writing to do so.<\/p>\n<p>      (b)     During the said period  of three months  the petitioner shall<\/p>\n<p>not enter the jurisdiction of   Valapatanam Police Station   without the<\/p>\n<p>prior permission of the learned Magistrate, except   for the purpose of<\/p>\n<p>complying with condition (c)  above.\n<\/p>\n<\/p>\n<p>                                               (R.
