Justice R.BASANT\n\n Dated :16\/10\/2007\n\n O R D E R\n                                R.BASANT, J\n                        ------------------------------------\n                         B.A.No.6225 of 2007\n                        -------------------------------------\n              Dated this the 16th day of October, 2007\n\n                                    ORDER\n<\/pre>\n<p>      Application for anticipatory bail. Petitioners are accused 7 to 29.<\/p>\n<p>They are not named in the F.I.R. Only accused 1 to 6 are named in<\/p>\n<p>the F.I.R.  They face allegations for offences punishable, inter alia,<\/p>\n<p>under Section 452 I.P.C.       The crux of the allegations in the crime<\/p>\n<p>registered is that a group of persons allegedly trespassed into the<\/p>\n<p>residential building of the defacto complainant and attempted to<\/p>\n<p>assault and belabuor him.        The miscreants were allegedly involving<\/p>\n<p>themselves in sand mining activities. They were inimical towards the<\/p>\n<p>defacto complainant because they felt that the defacto complainant<\/p>\n<p>was passing on information to the authorities about the sand mining<\/p>\n<p>activities. The petitioners were not initially arrayed as accused by the<\/p>\n<p>police. Later, the petitioners &#8211; accused 7 to 29 have been arrayed as<\/p>\n<p>accused.\n<\/p>\n<p>      2.    The learned counsel for the petitioners submits that the<\/p>\n<p>petitioners are innocent. Only to satisfy the defacto complainant the<\/p>\n<p>whole mass of persons in the locality have been arrayed as accused.<\/p>\n<p>The petitioners have absolutely no direct involvement in the incident<\/p>\n<p>that took place.   They have been brought on the array of accused<\/p>\n<p>unnecessarily. To avoid vexation to them, directions under Section<\/p>\n<p>438 Cr.P.C may be issued. Appropriate conditions may be imposed, it<\/p>\n<p><span class=\"hidden_text\">B.A.No.6225 of 2007                   2<\/span><\/p>\n<p>is further submitted.\n<\/p>\n<p>       3.    The learned Public Prosecutor        opposes the application.<\/p>\n<p>The learned Public Prosecutor        points out that earlier, the named<\/p>\n<p>accused had come before this Court for grant of anticipatory bail. But<\/p>\n<p>such prayer was turned down by this Court.\n<\/p>\n<p>       4.    I have considered all the relevant inputs. Notwithstanding<\/p>\n<p>the opposition by the learned Public Prosecutor, I am persuaded to<\/p>\n<p>issue directions under Section 438 Cr.P.C in favour of the petitioners.<\/p>\n<p>I take note of the crucial difference that the petitioners have not been<\/p>\n<p>named as accused initially and as many as 23 persons have been<\/p>\n<p>specifically arrayed as accused. Appropriate conditions can of course<\/p>\n<p>be imposed.\n<\/p>\n<p>       5.    In the result, the Bail Application is, allowed. The following<\/p>\n<p>directions are issued under Section 438 Cr.P.C.<\/p>\n<p>       i)    The petitioners shall appear before the learned Magistrate<\/p>\n<p>at 11 a.m on 23.10.07. They shall be enlarged on regular bail on their<\/p>\n<p>executing a bond for Rs.25,000\/- (Rupees Twenty Five thousand only)<\/p>\n<p>each with two solvent sureties each for the like sum to the satisfaction<\/p>\n<p>of the learned Magistrate;\n<\/p>\n<p>       ii)   The petitioners shall make themselves available for<\/p>\n<p>interrogation before the Investigating Officer between 10 a.m and 3<\/p>\n<p>p.m on 24.10.2007 and 25.10.2007 and thereafter between 10 a.m<\/p>\n<p><span class=\"hidden_text\">B.A.No.6225 of 2007                3<\/span><\/p>\n<p>and 12 noon on all Mondays and Fridays for a period of 2 months;<\/p>\n<p>      iii) If the petitioners do not appear before the learned<\/p>\n<p>Magistrate as directed in clause (i), directions issued above shall<\/p>\n<p>thereafter stand revoked and the police shall be at liberty to arrest the<\/p>\n<p>petitioners and deal with them    in accordance with law as if those<\/p>\n<p>directions were not issued at all;\n<\/p>\n<p>      iv)  If the petitioners were arrested prior to their surrender<\/p>\n<p>on 23.10.07 as directed in clause (1) above, they shall be released<\/p>\n<p>from custody on their executing a bond for Rs.25,000\/- (Rupees<\/p>\n<p>Twenty Five thousand only) each without any sureties undertaking to<\/p>\n<p>appear before the learned Magistrate on 23.10.07.<\/p>\n<p>                                                 (R.BASANT, JUDGE)<br \/>\nrtr\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court M.Abdul Latheef vs The State Of Kerala on 16 October, 2007 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl No. 6225 of 2007() 1.
