Justice M.SASIDHARAN NAMBIAR\n\n Dated :23\/03\/2010\n\n O R D E R\n          M.SASIDHARAN NAMBIAR,J.\n\n           ------------------------------------------\n            CRL.M.C.NO.123 OF 2010\n           ------------------------------------------\n             Dated 23rd March 2010\n\n\n                         O R D E R\n<\/pre>\n<pre>            Petitioner                is       the    de   facto\n\ncomplainant    and         first            respondent      the\n\n<\/pre>\n<p>accused in C.C.1055\/2009 on the file of<\/p>\n<p>Judicial    First              Class              Magistrate-V,<\/p>\n<p>Kozhikode.  First         respondent                was  granted<\/p>\n<p>bail.  While     on       bail,          petitioner        filed<\/p>\n<p>C.M.P.3211\/2009       for        cancellation           of   the<\/p>\n<p>bail  contending         that         on       12\/6\/2009     and<\/p>\n<p>15\/6\/2009 first respondent threatened her<\/p>\n<p>over phone. It is alleged that                            he is<\/p>\n<p>trying to influence the investigation by<\/p>\n<p>intimidating        the             witnesses.             First<\/p>\n<p>respondent filed an objection before the<\/p>\n<p>learned Magistrate           denying the allegation.<\/p>\n<p>By  Annexure-D       order           learned          Magistrate<\/p>\n<p>Crmc 123\/10<br \/>\n<span class=\"hidden_text\">                          2<\/span><\/p>\n<p>dismissed     the petition. This petition is filed<\/p>\n<p>under Section 482 of Code of Criminal Procedure<\/p>\n<p>contending     that  learned Magistrate  dismissed<\/p>\n<p>the      petition  for   the  sole   reason   that<\/p>\n<p>investigation was completed and final report<\/p>\n<p>was submitted without considering the question<\/p>\n<p>whether bail is liable to be cancelled due to<\/p>\n<p>threat     made  by   first  respondent  effecting<\/p>\n<p>investigation and trial.\n<\/p>\n<p>           2.   Learned  counsel appearing for the<\/p>\n<p>petitioner and first respondent were heard.<\/p>\n<p>           3. When petitioner asserts that she was<\/p>\n<p>threatened by first respondent on 12\/6\/2009 and<\/p>\n<p>15\/6\/2009, first respondent denied the case.<\/p>\n<p>Final report has already been submitted and<\/p>\n<p>offences     taken  cognizance.  Question  now  is<\/p>\n<p>whether by     continuing on bail first respondent<\/p>\n<p>would interfere with a fair trial. On the facts<\/p>\n<p>Crmc 123\/10<br \/>\n<span class=\"hidden_text\">                          3<\/span><\/p>\n<p>and circumstances of the case, I find no reason<\/p>\n<p>to    interfere   with   Annexure-D  order.   First<\/p>\n<p>respondent is directed not the threaten or make<\/p>\n<p>attempt to influence any of the      witnesses.
