Justice J.B.KOSHY\n\n Dated :26\/09\/2007\n\n O R D E R\n                        J.B.KOSHY, J.\n                  -------------------------\n                   Crl.R.P.No.491 OF 2000\n                  -------------------------\n                  Dated 26th September, 2007\n\n                            ORDER\n<\/pre>\n<p>         Revision petitioner\/accused was found guilty for<\/p>\n<p>the offence punishable under Section 279 &amp; 304 of the Indian<\/p>\n<p>Penal Code by the Assistant Sessions Judge, Thrissur. He was<\/p>\n<p>sentenced to undergo simple imprisonment for one year under<\/p>\n<p>Section  304(A)  of   the   Indian  Penal   Code  and  simple<\/p>\n<p>imprisonment for three months under Section 279 of the Indian<\/p>\n<p>Penal Code.  In appeal conviction was upheld, but, sentence<\/p>\n<p>was modified.  Operative part of the judgment of the Sessions<\/p>\n<p>Judge is as follows:\n<\/p>\n<\/p>\n<blockquote><p>          &#8220;IN THE RESULT:\n<\/p><\/blockquote>\n<blockquote><p>        a) This appeal is allowed in part.\n<\/p><\/blockquote>\n<blockquote><p>        b) The verdict of guilty and conviction of<br \/>\n            the appellant u\/s.304-A and 279 IPC are<br \/>\n            upheld.\n<\/p><\/blockquote>\n<blockquote><p>        c)    But  the   sentence  imposed  on  the<br \/>\n            appellant u\/s.304-A IPC. is modified<br \/>\n            and reduced.    The sentence imposed on<br \/>\n            him   u\/s.279   IPC  and   the   further<br \/>\n            direction that the sentence shall run<br \/>\n            concurrently    are    upheld.      The<br \/>\n            supersession of the sentence imposed on<br \/>\n            the appellant by the learned Magistrate<br \/>\n            u\/s.304-A  I.P.C.,   the  appellant  is<br \/>\n            setneced to undergo simple imprisonment<br \/>\n            for a period of six months and to pay a<br \/>\n            fine  of  Rs.5000\/-.     In  default of<\/p>\n<p><span class=\"hidden_text\">Crl.R.P.491\/2000                 2<\/span><\/p>\n<p>                payment  of  fine  he  shall  undergo<br \/>\n                simple  imprisonment  for  a  further<br \/>\n                period of three months.\n<\/p><\/blockquote>\n<blockquote><p>          d)    The appellant is further disqualified<br \/>\n                from driving any vehicle for a period<br \/>\n                of  one   year  from   the  date   of<br \/>\n                endorsement of such disqualification<br \/>\n                of his driving licence.&#8221;\n<\/p><\/blockquote>\n<p>Prosecution     case   is  that  the  accused  drove  KBR  2849<\/p>\n<p>(Kadampuzha Amma) bus through Thrissur-Shornur road in a<\/p>\n<p>rash and negligent manner so as to endanger the personal<\/p>\n<p>safety of others on 20-10-1995 and caused the bus to hit<\/p>\n<p>against a cyclist Appu alias Chandrasekharan who was riding<\/p>\n<p>the bicycle through the western portion of road at 6.15<\/p>\n<p>p.m. and that the bus run over the victim causing his<\/p>\n<p>death.       The place of occurrence is Thirur Desom.       The<\/p>\n<p>accused drove the bus in a rash and negligent manner and<\/p>\n<p>also in over speed with the knowledge that his act may<\/p>\n<p>cause death of others.      In 313 statement accused denied the<\/p>\n<p>allegations.      His defence case was that he was not the<\/p>\n<p>driver of the bus.\n<\/p>\n<\/p>\n<p>             2. PW1 deposed before the court that himself and<\/p>\n<p>the deceased Appu were co-workers and friends, that they<\/p>\n<p>are carpenters, that on the date of occurrence they were<\/p>\n<p>returning home after their work, that the deceased Appu was<\/p>\n<p><span class=\"hidden_text\">Crl.R.P.491\/2000               3<\/span><\/p>\n<p>riding the bicycle towards north keeping left side of the<\/p>\n<p>road through Shoranur-Thrissur public road, that he was<\/p>\n<p>also riding in another bicycle behind Appu, that the<\/p>\n<p>incident occurred in between 6 p.m. and 7 p.m. at a place<\/p>\n<p>called Thirur, that a bus came from the opposite direction<\/p>\n<p>hit against the cyclist Appu and the bus run over the<\/p>\n<p>victim causing his death, that the bus was driven in over<\/p>\n<p>speed.       But, he was declared hostile as he failed to<\/p>\n<p>identify the driver of the bus as accused.      According to<\/p>\n<p>him,     driver  ran  away.   PW10,  an  occurrence  witness,<\/p>\n<p>identified the number of the offending bus as KBR 2489<\/p>\n<p>`Kadampuzha Amma&#8217;.    But, he was also declared hostile as he<\/p>\n<p>also failed to identify the accused.   PW3 was the conductor<\/p>\n<p>of the bus at the time of the incident.    He deposed before<\/p>\n<p>the court that the accused was the driver of the bus at the<\/p>\n<p>time of the incident, that the accident happened at about<\/p>\n<p>6.30 p.m., that the bus was coming towards Thrissur, that<\/p>\n<p>he had not seen the actual hitting of the bus on the<\/p>\n<p>victim, that he does not know the reason for the accident,<\/p>\n<p>that he produced Ext.P3 trip sheet book before the police,<\/p>\n<p>that Ext.P3(a() is the trip sheet of the relevant date,<\/p>\n<p>wherein the name of the accused is entered as the driver of<\/p>\n<p>the bus and that he put his signature in the trip sheet as<\/p>\n<p>the conductor.      Even though PW3 was declared hostile, he<\/p>\n<p><span class=\"hidden_text\">Crl.R.P.491\/2000                 4<\/span><\/p>\n<p>proved and identified the accused as the driver of the bus<\/p>\n<p>which was involved in the accident.\n<\/p>\n<\/p>\n<p>             3. PW6   Doctor conducted post-mortem examination<\/p>\n<p>on the body of deceased Appu and issued Ext.P7 post-mortem<\/p>\n<p>certificate.      PW6 opined that the death was due to the head<\/p>\n<p>injury.       PW7, the then Motor Vehicle Inspector, Thrissur<\/p>\n<p>inspected the bus involved in the incident and issued<\/p>\n<p>Ext.P8 report.       He deposed that the vehicle was having no<\/p>\n<p>mechanical defect and that the brake was efficient.         PW9<\/p>\n<p>Village Assistant, then attached to Killannur Village,<\/p>\n<p>inspected the scene of occurrence and prepared the scene<\/p>\n<p>plan, Ext.P10.      PW11, then Sub Inspector attached to Viyyur<\/p>\n<p>Police Station, registered the crime on the basis of Ext.P1<\/p>\n<p>F.I. Statement furnished by PW1.          The F.I.R. has been<\/p>\n<p>marked as Ext.P12 through him.          PW12 Circle Inspector<\/p>\n<p>conducted the investigation in this case.          He prepared<\/p>\n<p>Ext.P6 inquest report regarding the dead body of the<\/p>\n<p>deceased      on   21.10.1995  at   Thrissur  Medical   College<\/p>\n<p>Hospital.       PW5 identified the dead body of the victim and<\/p>\n<p>he is a witness to Ext.P6 inquest report.          PW12 Circle<\/p>\n<p>Inspector inspected the scene of occurrence and prepared<\/p>\n<p>Ext.P9 scene mahazar on 21.10.1995, the next day of the<\/p>\n<p>incident.       PW8 is an attestor to Ext.P9 scene mahazar.<\/p>\n<p><span class=\"hidden_text\">Crl.R.P.491\/2000               5<\/span><\/p>\n<p>M.O.2 series are the glass pieces taken from the scene of<\/p>\n<p>occurrence under Ext.P9 scene mahazar. M.O.I is the blood<\/p>\n<p>stained cloth worn by the victim.            In view of the<\/p>\n<p>deposition of PW3 and Ext.P3 trip sheet maintained in the<\/p>\n<p>offending bus, it cannot be contended that accused was not<\/p>\n<p>the driver of the bus involved in the incident.      PW1 and<\/p>\n<p>PW10 very clearly deposed before the court that the victim<\/p>\n<p>was riding the cycle through the western side of the<\/p>\n<p>Shoranur-Thrissur road and that the victim had not come<\/p>\n<p>from the side road as suggested by the defence.     The scene<\/p>\n<p>mahazar (Ext.P9) shows that the tarred road is having a<\/p>\n<p>width of 7.85 metres at the place of occurrence and that<\/p>\n<p>the    place    of occurrence  is  somewhat on   the  western<\/p>\n<p>extremity of the tarred road.    As per the scene mahazar the<\/p>\n<p>place of occurrence is 62 cms. east from the western<\/p>\n<p>extremity of the tarred road.      Thus from the evidence of<\/p>\n<p>PW1, PW2 and PW10 and Ext.P9 scene mahazar it is very clear<\/p>\n<p>that the road is having sufficient width at the scene of<\/p>\n<p>occurrence and that the victim was riding through the<\/p>\n<p>western extremity of the road keeping the left side of the<\/p>\n<p>road.     In these circumstances, it is very evident that the<\/p>\n<p>accident occurred due to the rashness and negligence of the<\/p>\n<p>accused driver. The appellate court found as follows:<\/p>\n<p><span class=\"hidden_text\">Crl.R.P.491\/2000                6<\/span><\/p>\n<blockquote><p>             &#8220;In every accident case it is of crucial<br \/>\n             importance that the court must try to<br \/>\n             ascertain the lie of the scene of the<br \/>\n             occurrence.  We get a clear idea about<br \/>\n             the  scene   of  occurrence   from   the<br \/>\n             evidence  tendered  by  the  prosecution<br \/>\n             witnesses as also the data perceived by<br \/>\n             the investigating officer at the scene<br \/>\n             of the occurrence described in Ext.P9<br \/>\n             scene mahazar.  The road at the place of<br \/>\n             occurrence  is  broad  and  the   tarred<br \/>\n             portion of the road has a width of 7.85<br \/>\n             metres.  The road margins are there on<br \/>\n             either side of the road and the western<br \/>\n             road margin a width of 7.60 metres.  The<br \/>\n             eastern road margin has a width of 3.20<br \/>\n             metres.  Ext.P10 sketch of the scene of<br \/>\n             occurrence is also available to help the<br \/>\n             court to draw a clear impression.    The<br \/>\n             spot of occurrence is located at a spot<br \/>\n             62 cms to the east of the western kerb.<br \/>\n             At the scene of occurrence, the Poomala<br \/>\n             road comes from the east and joins the<br \/>\n             main road.    Broken glass pieces were<br \/>\n             available at the scene to identify the<br \/>\n             spot of occurrence.   PWs 1,2,3 and 10<br \/>\n             have been declared hostile, but their<br \/>\n             evidence,  though  hostile  gives  us  a<br \/>\n             clear picture of the manner in which the<br \/>\n             accident  had  taken  place.    The  bus<br \/>\n             driven by the appellant\/accused had cut<br \/>\n             across entirely to its wrong side of the<br \/>\n             road and the impact had taken place at a<br \/>\n             spot close to the western kerb of the<br \/>\n             tarred road.&#8221;\n<\/p><\/blockquote>\n<p>After considering the evidence appellate court also found<\/p>\n<p>that accident occurred while accused was driving the vehicle<\/p>\n<p>rashly and negligently and it occurred at the wrong side of<\/p>\n<p>the accused.     I see no ground to interfere in the concurrent<\/p>\n<p>findings of the courts below in revisional jurisdiction.<\/p>\n<p><span class=\"hidden_text\">Crl.R.P.491\/2000                 7<\/span><\/p>\n<p>Findings are not perverse but based on proper analysis of<\/p>\n<p>evidence.       With regard to sentence, appellant curt has<\/p>\n<p>already taken a lenient view.         According to the public<\/p>\n<p>prosecutor also for rash and negligent driving, no lenient<\/p>\n<p>view can be taken.        However, I reduce the punishment of<\/p>\n<p>simple imprisonment of six months to three months for the<\/p>\n<p>offence punishable under Section 304-A.        Fine amount or<\/p>\n<p>default sentence is not interfered with.        I confirm the<\/p>\n<p>conviction and sentence under Section 279 IPC.       Therefore,<\/p>\n<p>conviction under Sections 279 IPC and 304-A I.P.C. are<\/p>\n<p>confirmed.      Sentence imposed under Section 279 IPC is also<\/p>\n<p>confirmed.      Imprisonment awarded under Section 304-A alone<\/p>\n<p>is reduced from six months to three months.       Fine imposed<\/p>\n<p>under Section 304A I.P.C. is not interfered with.     All other<\/p>\n<p>sentences       are  confirmed.     Substantive   sentence   of<\/p>\n<p>imprisonment      need  be  suffered concurrently.
