KRISHNAN, J.\n               = = = = = = = = = = = = = =\n                  M.F.A.(TCLSCSRA) NOs.\n                      104 &amp; 105 OF 2010\n             = = = = = = = = = = = = = = =\n         Dated this the 17th day of June, 2010.\n\n                       J U D G M E N T\n<\/pre>\n<p>     MFA No.104\/10 is filed by additional respondents 8 to<\/p>\n<p>21 and 23 to 37 and the other appeal is filed by respondents<\/p>\n<p>1 to 5 and 7 against the common order passed by the<\/p>\n<p>Additional    District  Judge-I,    Thiruvananthapuram       in<\/p>\n<p>I.A.Nos.2220\/09, 640\/10, 1453\/10, 1833\/09, 1832\/09 and<\/p>\n<p>O.P.477\/05.     After perusing the order and hearing the<\/p>\n<p>learned counsel appearing for all the sides I feel an order has<\/p>\n<p>to be passed directing the aggrieved appellants to move the<\/p>\n<p>Court which passed the order to review that order or any<\/p>\n<p>other relief contemplated under Order 23 of the Code of Civil<\/p>\n<p>Procedure to redress their grievances. I say so because the<\/p>\n<p>whole order is passed on the basis of some concessions said<\/p>\n<p>M.F.A.(TCLSCSRA) NOs.\n<\/p>\n<p>104 &amp; 105 OF 2010<br \/>\n<span class=\"hidden_text\">                              -:2:-<\/span><\/p>\n<p>to be made and compromise petition. It is also stated that<\/p>\n<p>some of the parties who are before me are not parties to the<\/p>\n<p>compromise petition as well. When an order is passed on the<\/p>\n<p>basis of a concession or compromise and if this compromise<\/p>\n<p>is not in proper form as contemplated under Order 23 of<\/p>\n<p>Code of Civil Procedure the appropriate remedy for the<\/p>\n<p>parties is to approach the Court which has passed the order<\/p>\n<p>for review of that order bringing into the limelight their<\/p>\n<p>grievances and the legal provisions. This Court sitting as an<\/p>\n<p>appellate judge cannot find out the correctness of any<\/p>\n<p>concessions said to be made unless it has been recorded in<\/p>\n<p>writing. Therefore I pass an order with a direction to the<\/p>\n<p>appellants in both the appeals to approach the court below<\/p>\n<p>for review of the order which is under challenge as<\/p>\n<p>contemplated by law and till the review application is<\/p>\n<p>disposed of, implementation of the order passed by the<\/p>\n<p>learned Judge shall be kept in abeyance. Since the matter<\/p>\n<p>M.F.A.(TCLSCSRA) NOs.\n<\/p>\n<p>104 &amp; 105 OF 2010<br \/>\n<span class=\"hidden_text\">                                 -:3:-<\/span><\/p>\n<p>relates to administration there is urgency and the court<\/p>\n<p>below shall try to dispose of the matter within one month<\/p>\n<p>from the date of receipt of the applications and the<\/p>\n<p>applications are to be filed within 10 days from today.<\/p>\n<p>      The appeals are disposed of accordingly.<\/p>\n<p>                             M.N.
