{"id":36006,"date":"2011-09-01T00:00:00","date_gmt":"2011-08-31T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/kamalpreet-singh-vs-union-of-india-and-another-on-1-september-2011"},"modified":"2017-01-28T20:02:32","modified_gmt":"2017-01-28T14:32:32","slug":"kamalpreet-singh-vs-union-of-india-and-another-on-1-september-2011","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/kamalpreet-singh-vs-union-of-india-and-another-on-1-september-2011","title":{"rendered":"Kamalpreet Singh vs Union Of India And Another on 1 September, 2011"},"content":{"rendered":"<div class=\"docsource_main\">Punjab-Haryana High Court<\/div>\n<div class=\"doc_title\">Kamalpreet Singh vs Union Of India And Another on 1 September, 2011<\/div>\n<pre>Civil Revision No.5293 of 2011(O&amp;M)                                     -1-\n\nIN THE HIGH COURT                OF PUNJAB           AND     HARYANA          AT\n                                CHANDIGARH.\n\n                                       Civil Revision No.5293 of 2011(O&amp;M)\n                                       Date of Decision: September 1, 2011\n\nKamalpreet Singh\n                                                     .....Petitioners\n                                  v.\n\nUnion of India and another\n                                                     .....Respondents\n\nCORAM: HON'BLE MR.JUSTICE RAM CHAND GUPTA\n\nPresent:       Mr.Saurav Khurana, Advocate\n               for the petitioners.\n                             ......\n<\/pre>\n<p>RAM CHAND GUPTA, J.(Oral)<\/p>\n<p>C.M.No.21221-CII of 2011<\/p>\n<p>               Application is allowed subject to all just exceptions.<\/p>\n<p>Civil Revision No.5293 of 2011<\/p>\n<p>               Petitioners have invoked supervisory jurisdiction of this Court<\/p>\n<p>under Article 227 of the Constitution of India for setting aside order dated<\/p>\n<p>24.9.2010, Annexure P3, passed by learned Civil Judge, (Junior Division),<\/p>\n<p>Amritsar, vide which evidence of petitioners-plaintiffs has been closed.<\/p>\n<p>               I have heard learned counsel for the petitioners and have gone<\/p>\n<p>through the whole record carefully including the impugned order passed by<\/p>\n<p>learned trial Court.\n<\/p>\n<p>               It has been contended by learned counsel for the petitioners that<\/p>\n<p>one of the petitioners-plaintiffs, i.e., petitioner No.2-Ravi Pal Singh is to be<\/p>\n<p>cross-examined and that no other evidence is to be adduced by petitioners-<\/p>\n<p>plaintiffs except tendering of some documents, which are per se admissible<\/p>\n<p>in evidence.\n<\/p>\n<p>               Hence, in view of these facts, one opportunity can be granted to<br \/>\n<span class=\"hidden_text\"> Civil Revision No.5293 of 2011(O&amp;M)                                    -2-<\/span><\/p>\n<p>the petitioners-plaintiffs for this purpose and the other party can be<\/p>\n<p>compensated by way of cost.\n<\/p>\n<p>            Hence, the present revision petition is accepted.       Impugned<\/p>\n<p>order is set aside. Learned trial Court is directed to grant one opportunity to<\/p>\n<p>produce petitioner no.2-Ravi Pal Singh for the purpose of cross-examination<\/p>\n<p>so that his statement be read in evidence and tender the documents, which<\/p>\n<p>are per se admissible in evidence subject to payment of ` 5,000\/- as cost,<\/p>\n<p>which shall be a condition precedent.\n<\/p>\n<p>            Disposed of accordingly.\n<\/p>\n<p>            However, at this stage, no notice is being issued to the opposite<\/p>\n<p>party, because if the respondents are summoned to contest this litigation, it<\/p>\n<p>may involve huge expenditure and unnecessary harassment and delay of the<\/p>\n<p>proceedings. For this view, reliance can be placed upon a Division Bench<\/p>\n<p>judgment of this Court rendered in Batala Machine Tools Workshop Co-<\/p>\n<p>op v. Presiding Officer, Labour Court, Gurdaspur, CWP No.9563 of<\/p>\n<p>2002, decided on 27.6.2002, wherein it was observed as under:-<\/p>\n<blockquote><p>              &#8221;      We are conscious of the fact that the instant order is<\/p>\n<p>              detrimental to the interest of the respondent-workman. We<\/p>\n<p>              are also conscious of the fact that no notice has been given to<\/p>\n<p>              the respondent-workman before the instant order has been<\/p>\n<p>              passed. The reasons for not issuing notice to the respondent<\/p>\n<p>              workman is to ensure that he does not have to incur<\/p>\n<p>              unnecessary expenses in engaging counsel to appear on his<\/p>\n<p>              behalf in this Court.
