Justice THOTTATHIL B.RADHAKRISHNAN\n\n Dated :24\/05\/2010\n\n O R D E R\n<\/pre>\n<p>          THOTTATHIL B.RADHAKRISHNAN, J.<\/p>\n<p>  = = = = = = = = = = = = = = = = = = = = = = = =<\/p>\n<p>            W.P.(C).No.22069 of 2009-C<\/p>\n<p>  = = = = = = = = = = = = = = = = = = = = = = = =<\/p>\n<p>        Dated this the 24th day of May, 2010.<\/p>\n<p>                     Judgment<\/p>\n<p>1.The complaint of the petitioners is that they are<\/p>\n<p> deprived of their entitlements under Section 4 of<\/p>\n<p> the     Persons    with     Disabilities    (Equal<\/p>\n<p> Opportunities, Protections of Rights and Full<\/p>\n<p> Participation)  Act,  1995.   The  said   provision<\/p>\n<p> prescribes   non-discrimination    in    Government<\/p>\n<p> employment. That is essentially a right conferred<\/p>\n<p> on persons with disabilities. Therefore, in terms<\/p>\n<p> of Sections 61 and 62, the Commissioner appointed<\/p>\n<p> by the State Government is empowered to look into<\/p>\n<p> complaints with respect to matters relating to<\/p>\n<p> deprivation    of   rights     of   persons   with<\/p>\n<p> disabilities; non-implementation of laws, rules,<\/p>\n<p> bye-laws,    regulations,     executive     orders,<\/p>\n<p> guidelines or instructions made or issued by the<\/p>\n<p> appropriate Governments and the local authorities<\/p>\n<p> for the welfare and protection of rights of<\/p>\n<p><span class=\"hidden_text\">WPC22069\/09           -: 2 :-<\/span><\/p>\n<p> persons with disabilities and take up the matter<\/p>\n<p> with the appropriate authorities.        Therefore,<\/p>\n<p> notwithstanding the fact that the KSRTC, the<\/p>\n<p> employer of the petitioners is a statutory body,<\/p>\n<p> the Commissioner under the Act in hand will have<\/p>\n<p> jurisdiction  to   decide    on  such   complaints.<\/p>\n<p> Therefore,  I  am  clear    in  my mind   that the<\/p>\n<p> petitioners have an alternate efficacious remedy<\/p>\n<p> against the grievances advanced.<\/p>\n<p>2.Be that as it may, the learned counsel for the<\/p>\n<p> petitioners   states    that   in   certain   other<\/p>\n<p> litigations, the KSRTC had conceded to certain<\/p>\n<p> directions   issued  by     this  Court   and  had<\/p>\n<p> reconsidered   their      stand  and   the    PSC&#8217;s<\/p>\n<p> concurrence may also be an issue.          In this<\/p>\n<p> context, the learned counsel for the KSRTC states<\/p>\n<p> that     if the   petitioners    make   appropriate<\/p>\n<p> application seeking the benefit of the Act, that<\/p>\n<p> would be considered in accordance with law.<\/p>\n<p> Taking     the   aforesaid      submissions   into<\/p>\n<p><span class=\"hidden_text\">WPC22069\/09           -: 3 :-<\/span><\/p>\n<p> consideration and without going into merits, the<\/p>\n<p> impugned   order  is     quashed to   enable   the<\/p>\n<p> petitioners to seek appropriate reliefs from the<\/p>\n<p> establishment in terms of what is recorded above.<\/p>\n<p> The writ petition ordered accordingly.<\/p>\n<p>                        THOTTATHIL B.RADHAKRISHNAN,<br \/>\n                                  JUDGE.\n<\/p>\n<p>Sha\/0106<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court M.A.Joy.
