Mr.M.Rajarajan\n                       Government Advocate\n\n:ORDER\n<\/pre>\n<p>\tThe petitioner challenges the charge memo issued against him on the ground<br \/>\nthat without following the principles laid down by the Hon&#8217;ble Supreme Court in<br \/>\nthe judgment reported in AIR 1997 SC 3011 in the case of <a href=\"\/doc\/1031794\/\">Vishaka and others vs.<br \/>\nState of Rajasthan &amp; others and<\/a> without forming Complaints Committee as laid<br \/>\ndown by the Honourable Supreme Court, the intiation of departmental proceedings<br \/>\nagainst the petitioner for having given sexual harassment to his subordinate is<br \/>\nnot maintainable and therefore, the impugned charge memo is liable to be<br \/>\nquashed.\n<\/p>\n<p>\t2.It is submitted by the learned counsel appearing for the petitioner,<br \/>\nMrs.Srimathy that as per the law laid down by the Honourable Supreme Court in<br \/>\nthe judgment referred to above, the Government has to constitute a Complaints<br \/>\nCommittee, which has to enquire into the allegations of sexual harassment made<br \/>\nagainst any of the employees and after getting a report from the Complaints<br \/>\nCommittee further action has to be taken and in this case, admittedly, no<br \/>\nComplaints Committee has been constituted and no enquiry was condcuted by the<br \/>\nComplaints Committee regarding the allegations of sexual harassment by the<br \/>\npetitioner and without conducting any proper enquiry, the 2nd respondent issued<br \/>\nthe charge memo and therefore, that is liable to be quashed.\n<\/p>\n<p>\t3.The respondents filed a detailed counter and the learned Government<br \/>\nAdvocated contended that as per the judgment of the Honourable Supreme Court<br \/>\nreferred to above, the Government of Tamilnadu has formulated the procedure for<br \/>\nconducting enquiry by the Complaints Committee, by its letter, dated 29.12.2000<br \/>\nissued by the Chief Secretary to Government and as per the said letter, in<br \/>\nannexure-I, procedure for conducting enquiry by the Complaints Committee was<br \/>\nstated and as per annexure-II, guideline for the employers has also been stated<br \/>\nand it has been specifically stated that where the conduct of an employee<br \/>\namounts to miscondcut in employment as defined in the relevent rules, the<br \/>\nemployer may also initiate appropriate disciplinary action, for good and<br \/>\nsufficient reasons, though no complaint is made to the Complaints Committee.\n<\/p>\n<p>\t4.It is, therefore, conteneded by the learned Government Advocate,<br \/>\nMr.M.Rajarajan that having regard to the guidelines given in annexure-II the<br \/>\nemployer in addition to referring the matter to the Complaints Committee is also<br \/>\nentitled to initiate appropriate disciplinary action in accordance with the<br \/>\nrelevent rules, when the condcut of an employee amounts to misconduct and in<br \/>\nthis case, the condcut of the petitioner amounts to misconduct as per the<br \/>\nTamilnadu Civil Service (Conduct) Rules and therefore, the charge memo was<br \/>\nissued agaisnt the petitioner and it was in order and it cannot be quaqshed.\n<\/p>\n<p>\t5.Heard both sides.\n<\/p>\n<p>\t6.In Vashaka and others vs. State of Rajasthan and others, reproted in<br \/>\nAIR 1997 SC 3011, the Honourable Supreme Court has laid down the following<br \/>\nguidelines has incorported in the said judgment in para 16.\n<\/p>\n<p>\t7.After the judgment of Supreme Court most of the employers have<br \/>\nunderstood that the committee&#8217;s report are only recommendary and as done so as<br \/>\nto find out a prima facie case warranting further intimation of disciplinary<br \/>\naction separately under the relevant service rules.  Because of this<br \/>\nunderstanding of law, women, who were sexually harassed, were made to appear<br \/>\ntwice in two separate enquiries and this led to further harassment and<br \/>\nhumiliation. Subsequently, the Supreme Court considered the complaints made by<br \/>\nvarious representations of the woman&#8217;s organisations and passed further order<br \/>\nclarifying <a href=\"\/doc\/1031794\/\">Vishaka and Others vs. State of Rajasthan and Others<\/a> (supra) case<br \/>\nwhere the Supreme Court directed Governments to strictly go by the report of the<br \/>\nSexual Harassment Committee and made the enquiry report as the starting point of<br \/>\nfurther&#8217;, proceedings. The employers were directed to proceed from the stage of<br \/>\nthe enquiry report and take appropriate action.  In this regard, the Supreme<br \/>\nCourt also directed for amendment of relevant Service Rules.\n<\/p>\n<p>\t8.Further, the Honourable Court also clarified the law laid down in<br \/>\nVishaka&#8217;s case in the judgment reported in (2009)16 SCC 624 in the matter of<br \/>\nMedha Kotwal Lele &amp; others vs. Union of India and others and the order reads as<br \/>\nfollows:-\n<\/p>\n<p>\t&#8220;Several Petitions had been filed before this Court by Women Organisations<br \/>\nand on the basis of the note prepared by the Registrar General that in respect<br \/>\nof sexual harassment cases the Complaints Committees were not formed in<br \/>\naccordance with the guidelines issued by this Court in <a href=\"\/doc\/1031794\/\">Vishaka v. State of<br \/>\nRajasthan<\/a> (1997)6 SCC 241 and that these petitions fell under Clause (6) of the<br \/>\nPIL Guidelines given by this Court i.e., &#8220;Atrocities on Women&#8221; and in any event<br \/>\nthe Guide-lines setout in Vishaka and Others v.State of Rajasthan and Others<br \/>\n(supra) were not being followed. Thereupon, this Court treated the, petitions as<br \/>\nWrit Petitions filed in public interest.\n<\/p>\n<p>\tNotice had been issued to several parties including the Government<br \/>\nconcerned and on getting appropriate responses from them and now after hearing<br \/>\nLearned Attorney General for UOI and learned Counsel we direct as follows:-\n<\/p>\n<p>\t&#8216;Complaints Committee as envisaged by the Supreme Court in its Judgment in<br \/>\n<a href=\"\/doc\/1031794\/\">Vishaka and Others v. State of Rajasthan and Others<\/a> case(1997)6 SCC 241 at 253,<br \/>\nwill be deemed to be an inquiry authority for the purposes case 1997(6)SCC 241<br \/>\nat 253 will bee deemed to be an inquiry authority for the purposes of Central<br \/>\nCivil Service (Conduct)Rules 1964 (hereinafter called CCS Rules) and the report<br \/>\nof the complaints Committee shall be deemed to be an inquiry report under the<br \/>\nCCS rules. Thereafter the disciplinary authority will act on the report in<br \/>\naccordance with the rules&#8221;.\n<\/p>\n<p>Similar amendments shall also be carried out in the Industrial Employment<br \/>\n(Standing Order) Rules.&#8221;\n<\/p>\n<p>\t9.These judgments were interpreting by the Honourable Division Bench of<br \/>\nthis Court in the judgment reproted in (2008)5 MLJ 261 in the case of <a href=\"\/doc\/447884\/\">Chairman,<br \/>\nNavodaya Vidyalaya Samiti, Ministry of HRD, Shastri Bhavan, New Delhi and others<br \/>\nvs. Dr.T.Murugesan and others<\/a>, held as follows:-\n<\/p>\n<p>\t&#8216;Therefore now the employers can have only one stage action. After the<br \/>\nSexual Harassment Committee&#8217;s report, they must proceed to impose punishment on<br \/>\nan employee found guilty of sexual harassment.  This order came to be passed by<br \/>\nthe Supreme Court, as the Court had received complaints that the earlier<br \/>\nprocedure led the woman being further harassed by attending before two separate<br \/>\nenquiries one by the Special Committee and the other before the Enquiry Officer<br \/>\nappointed in terms of Service Rules.  In the light of the above, the question of<br \/>\nexamining the victim girl in the presence of the first respondent does not<br \/>\narise.&#8221;\n<\/p>\n<p>Therefore, as per the law laid down by the Honourable Supreme Court, the report<br \/>\nof the Complaints Committee shall be the basis for taking disciplinary<br \/>\nproceedings and the authorities are entiteld to take further action on the basis<br \/>\nof the report of the Complaints Committee.  Though the Government of Tamil Nadu<br \/>\nhas issued a letter and formulated the guidelines for the formation of<br \/>\nComplaints Committee and also permitted the employer to take disciplinary<br \/>\nproceedings, if the condcut of the Government Servant amounts to misconduct as<br \/>\nper the relevant Rules as per law laid down by the Honourable Supreme Court as<br \/>\nstated above in the absence of any complaint given to the Complaints Committee<br \/>\nand in the absence of any report by the Complaints Committee, the employer<br \/>\ncannot take any action for sexual harassment.\n<\/p>\n<p>\t10.Hence, the charge memo issued against the petitioenr is deferred for<br \/>\nthe time being and the respondents are directed to constitute a Complaints<br \/>\nCommitte if  such Committee has not been constituted so far and the Complaints<br \/>\nCommittee shall go into the allegations made against the petitioner and after<br \/>\nthe receipt of the report of the Complaints Committee, the respondents are<br \/>\nentitled to take further action.\n<\/p>\n<p>\t11.With the above observations, this petition is disposed of.<br \/>\nconsequently, connected M.P. is closed.
