Rekha Gohiya vs Principal Secretary The State Of &#8230; on 27 August, 2011<\/div>\n<pre>                   W.P.No.7028\/2011\n\nSmt.Rekha Gohiya                         State of M.P. &amp; others\n\n\n\n\n27.8.2011<\/pre>\n<p>       Petitioner Smt.Rekha Gohiya along with Shri Greesham<br \/>\nJain, counsel for petitioner.\n<\/p>\n<p>       Shri Rahul Jain, Dy.A.G., for State.\n<\/p>\n<p>       Shri M.T.Baig, C.S.P. Gohalpur alongwith Shri Y.S.Jaisur,<br \/>\nS.I., Constables Ashish, Narendra and lady Head Constable<br \/>\nSudha are present.\n<\/p>\n<p>       The Police have produced Prince Mehra, son of petitioner<br \/>\nand girl Shweta Upadhya before this Court.             The parents of<br \/>\nShweta Upadhya are also present in the Court.\n<\/p>\n<p>       At the request of Smt.Rashmi Upadhya, mother of the<br \/>\ngirl, we permitted her to have a talk with Shweta Upadhya. But<br \/>\nit appears that their relations are not cordial. The girl is not<br \/>\nready to talk with her mother.         However, for a period of 5<br \/>\nminutes they have talked to each other. After 5 minutes the<br \/>\ngirl   Shweta   Upadhya     returned    by    saying    that   she   is<br \/>\napprehending danger to her and her husband&#8217;s life.\n<\/p>\n<p>       In these circumstances, we have directed Shri M.T.Baig,<br \/>\nCSP Gohalpur to provide adequate security to both of them for<br \/>\na period of 3 days.       Even thereafter, if any information is<br \/>\nreceived by the CSP Gohalpur in respect of any danger to the<br \/>\nlife and limb of Prince Mehra or\/and Shweta Upadhya, they be<br \/>\nprovided immediate help by the Police.\n<\/p>\n<p>       On being asked to Prince Mehra whether he was in<br \/>\nwrongful confinement or detention, it is stated that though he<br \/>\nwas out of Jabalpur, but he was not in confinement.\n<\/p>\n<p>       As Prince Mehra and Shweta Upadhya both have married<br \/>\nand prays that they may be set free to lead their life, we<br \/>\n                    W.P.No.7028\/2011<\/p>\n<p>Smt.Rekha Gohiya                      State of M.P. &amp; others<\/p>\n<p>dispose of the proceedings with above directions.\n<\/p>\n<p>      At this stage, Smt.Rashmi Upadhya submitted that Prince<br \/>\nMehra is not major and he has not completed age of 21 years.\n<\/p>\n<p>      On being asked, Prince Mehra stated that he has<br \/>\ncompleted age of 20 years only.\n<\/p>\n<p>      As the petition was filed for production of corpus of<br \/>\nPrince Mehra, who is not in wrongful confinement or in<br \/>\ndetention of any person, we set him free.\n<\/p>\n<p>      No further action is required in this petition.
