(4) 268 JT 1995 (8)\t193\n 1995 SCALE  (6)387\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     A\tnotification   under  Section\t4(1)  of   the\tLand<br \/>\nAcquisition Act,  1894 (for  short, &#8216;the Act&#8217;) was published<br \/>\nin January,   1973  acquiring Ac.3.589\tof land\t situated in<br \/>\nCuttack for  Telecommunication\tDepartment  for\t residential<br \/>\nquarters of  the staff, Telephone exchange, Post office etc.<br \/>\nIn exercise of the power under Section 17(4) read with 17(1)<br \/>\nenquiry under  Section 5A  was dispensed  with.\t Before\t the<br \/>\ndeclaration  under   Section  6\t  could\t  be   published   a<br \/>\nrepresentation was  made by  the wife of the respondent No.1<br \/>\ni.e. Dr.  Sarojini Pradhan  requesting to delete 24 decimals<br \/>\nof land\t for  construction  of\tNursing\t Home  etc.  In\t the<br \/>\nmeanwhile, Cuttack  Development Authority  declared the area<br \/>\nto be commercial zone. In consequence, the appellant made an<br \/>\napplication requesting\tto permit  construction upto  90 ft.<br \/>\nand rest  of the  land may  be permitted  to be released for<br \/>\nresidential purposes.  In the  meanwhile, the representation<br \/>\nmade by Dr. Sarojini was pending declaration under Section 6<br \/>\nwas published on June 30, 1975. A notice under Section 9 was<br \/>\nserved on  November 1, 1975, possession of the land was also<br \/>\nclaimed to  have been taken on April 12, 1976 and was handed<br \/>\nover to\t the Union  of India.  The Land\t Acquisition Officer<br \/>\nmade his  award on  November 2,\t 1976 and paid the amount to<br \/>\nall persons who had accepted the award or those who received<br \/>\nunder protest  and it  is said\tthat as\t regards the  amount<br \/>\nawarded to Dr. Sarojini Pradhan, it was kept in deposit.\n<\/p>\n<p>     On August\t18, 1979 the respondent No.1, since his wife<br \/>\ndied in\t the meanwhile,\t filed W.P.  No.1139\/79, challenging<br \/>\nthe validity  of the  notification under  Section  4(1)\t and<br \/>\nSection 6  declaration. The  High Court by order dated March<br \/>\n16, 1982  disposed of  the writ petition with a direction to<br \/>\nthe  Government\t  to  consider\tthe  representation  of\t the<br \/>\nrespondent for exclusion of the land from acquisition. After<br \/>\nan elaborate  consideration and\t scrutiny of  the  necessary<br \/>\nmaterial, Union of India rejected the representation on June<br \/>\n3, 1987.  Thereafter the  respondents filed  W.P. No.435  of<br \/>\n1988 challenging  the notifications.  In the  meanwhile\t the<br \/>\nheadquarters of the Telecommunication Department was shifted<br \/>\nfrom Cuttack  to Bhubaneswar  but it  was decided  that\t the<br \/>\nexisting staff\twould remain  at Cuttack.  The High Court by<br \/>\nthe impugned  order  dated  October  31,  1990\tquashed\t the<br \/>\nnotification under  Section 4(1)  on  the  ground  that\t the<br \/>\nexercise of the power under Section 17(4) was invalid. Since<br \/>\nthe declaration\t was made  after the  amendment to Section 6<br \/>\nhas come into existence, the notification under Section 4(1)<br \/>\nwas held to be invalid. Thus these appeals by special leave.\n<\/p>\n<p>     The crucial  question that\t arises for consideration is<br \/>\nwhether\t the   High  Court   was  right\t  and  justified  in<br \/>\ninterfering with the acquisition. It is seen that out of the<br \/>\nextent of  Ac.3.589, the  claim of  the respondents  is only<br \/>\nAc.o.240 dec.  In other\t words, only  around 1162 sq. yards.<br \/>\nAll others  had accepted  the award,  a few  of\t them  under<br \/>\nprotest. It is common knowledge that possession would always<br \/>\nbe taken under a memo and handing over also would be under a<br \/>\nmemo.  It   is\ta  recognized  usual  practice\tin  all\t the<br \/>\nacquisition proceedings.  By operation of Section 17(1) even<br \/>\nbefore award  could be made, the Land Acquisition Officer is<br \/>\nentitled to take possession of the land. He did so. The time<br \/>\nmentioned  in\tSection\t 9   stood  expired  by\t them.\tEven<br \/>\notherwise, award  was made on November 2, 1976. By operation<br \/>\nof Section  16 of  the Act  right, title and interest in the<br \/>\nland vested  in the  Government\t absolutely  free  from\t all<br \/>\nencumbrances. Thereby  the Government  became  the  absolute<br \/>\nowner with  effect from\t April 12,  1976. This\tCourt in the<br \/>\ncase of Satendra Prasad Jain &amp; Ors. Vs. State of U.P. &amp; Ors.<br \/>\n[(1991) 4  SCC 531  had held  that once\t possession has been<br \/>\ntaken validity\tof the\tnotification under  Section 4(1) and<br \/>\ndeclaration under  Section 6 cannot be gone into and Section<br \/>\n11 A does not apply.\n<\/p>\n<p>     It is  already seen  that the possession having already<br \/>\nbeen taken  on April  12, 1976\tand vested in the Government<br \/>\nfree from  all encumbrances  and many others having accepted<br \/>\nthe award  and some  had  received  the\t compensation  under<br \/>\nprotest,  the\tHigh  Court   was  wholly   unjustified\t  in<br \/>\ninterfering with  the acquisition.  We have  seen  the\tplan<br \/>\nproduced before\t us  which  would  indicate  that  the\tland<br \/>\nacquired comprises  the establishment  of Officers&#8217; building<br \/>\nand 2000 electronic exchange. Under theses circumstances, it<br \/>\nwould be  highly inconvenient  to  exclude  this  land\tfrom<br \/>\nacquisition. The purpose of enquiry under Section 5A is only<br \/>\nto show that any other convenient and suitable land would be<br \/>\navailable other\t than the  land sought\tto be  acquired,  or<br \/>\nthere is  no public  purpose. This  issue  would  become  an<br \/>\nacademic, once the construction started and was in progress.<br \/>\nThe ratio  in the  case\t of  oxford  English  School  v.  A.<br \/>\nHastings  Hope\t reported  in  [(1995)\t5  SCC\t206  has  no<br \/>\napplication to\tthe facts  of these  appeals. In  that case,<br \/>\nneither the award was made before the amendment act has come<br \/>\ninto force nor was possession taken. In these circumstances,<br \/>\nthis Court held that declaration under Section 6 was invalid<br \/>\nand direction  given by\t the High  Court to  conduct enquiry<br \/>\nunder Section 5A, after three years had expired, is illegal.<br \/>\nSection 4(1)  also stood  lapsed by  operation of proviso to<br \/>\nSection 6  of the  Act.\t Therefore,  the  ratio\t is  clearly<br \/>\ninapplicable to the facts of these appeals.\n<\/p>\n<p>     In these  circumstances,  the  High  Court\t was  wholly<br \/>\nunjustified in interfering with the acquisition and quashing<br \/>\nthe notification and declaration under Section 6 of the Act.\n<\/p>\n<p>     The appeals are allowed.
