     The appellant  is aggrieved  by the   order dated April
\n27, 1989  of the  High\tCourt  of  Judicature  at  Allahabad
\n(Lucknow Bench)\t dismissing his\t writ petition\twherein\t his
\nchallenge to  the post\tof Officer  on Special Duty (Special
\nComponent Plan) which he was holding, failed.\n<\/p>\n
     The  appellant   joined  Secretariat   service  of\t the
\nrespondent as  Lower Division  Assistant  in  the  temporary
\ncapacity in  the year  1975. Whereafter\t he was\t promoted as
\nUpper Division\tAssistant. While  the appellant\t was holding
\nthe  post   of\tUpper\tDivision  Assistant  in\t officiating
\ncapacity, he  was selected and appointed on ex-cadre post of
\nOfficer on  Special Duty  (Special Component  Plan) by order
\ndated October  16, 1980.  By Office  Memorandum dated May 8,
\n1984,  this   post  of\tOfficer\t on  Special  Duty  (Special
\nComponent  Plan)   was\tsought\t to  be\t  abolished  and  by
\nnotification dated  May 14,  1984 Shri\tShiva Shankar Singh,
\nrespondent No.4,  was appointed\t as Officer  on Special Duty
\n(Special Component  Plan) in  newly created  post. Both\t the
\naforesaid  office   memorandum\tand  the  notification\twere
\nchallenged by the appellant in the writ petition in the High
\nCourt.\n<\/p>\n
     In support of his case in the High Court, the appellant
\nhad contended  that a Government servant holding a temporary
\npost  for  more\t than  three  years  acquired  right  to  be
\nconsidered  for\t  confirmation\tagainst\t that  post  and  if
\nnecessary by  converting the temporary post into a permanent
\none. He\t said that  since he  had completed  more than three
\nyears as  Officer on  Special Duty (Special Component Plan),
\nhe was\tentitled to hold that post which was being abolished
\nby Officer  Memorandum dated  May 8,  1984. His further case
\nwas that  this post was borne on the cadre of Directorate of
\nHarijan and Social Welfare and could not be abolished by the
\nSecretariat  Administration  (Establishment)  of  the  State
\nGovernment. The\t case set  up by  the appellant did not find
\nfavour with  the  High\tCourt  and  it\tdismissed  his\twrit
\npetition.\n<\/p>\n
     The only  contention raised before us in this appeal is
\nthat the  post of Officer on Special Duty (Special Component
\nPlan) was  in the  cadre of  the Directorate  of Harijan and
\nSocial Welfare\tDepartment of  the State  Government and the
\nState\tGovernment   in\t  the\tSecretariat   Administration
\n(Establishment) could  not have\t abolished the\tsame. We may
\nnote that  on account  of the  interim orders  issued by the
\nHigh Court  and latter\tby this Court, the post of Office on
\nSpecial Duty  (Special Component  Plan) has  been  continued
\nwith the  appellant, it\t appears, still holding the same. To
\nunderstand how this post which the appellant was holding was
\ncreated and  how it  was abolished, we may refer to sequence
\nof certain events.\n<\/p>\n
     On October\t 16, 1980  a communication [No.5158\/26-3-80-
\n11(17)80] was  addressed by  the Secretary to the Government
\nof  U.P.   to  the  Director,  Harijan\tand  Social  Welfare
\nDepartment according sanction to create on temporary post at
\nSecretariat level  in the pay scale of Rs.500\/1000\/-. It was
\nstated in  the letter that for the purpose of implementation
\nof  special  component\tplan  for  Scheduled  Castes  in  an
\naccelerated and\t effective manner,  the Governor was pleased
\nto accord  sanction to\tcreate that above post from the date
\nof filling  up the post which date shall not be earlier than
\nthe date  of this  order upto  February\t 28,  1981.  It\t was
\nmentioned that\tthe said  post shall  be a gazetted post and
\nthe designation\t whereof shall\tbe Officer  on Special\tDuty
\n(Special Component Plan). The holder of the said post was to
\nbe paid\t in addition  to pay,  dearness allowance  and other
\nallowances as applicable and approved by the Government from
\ntime to\t time. This letter also described the qualifications
\nfor holding  this post\tand the\t functions which  were to be
\nperformed. Then the letter gave the following directions:\n<\/p>\n
     “The above\t said expenditure  shall
\n     be\t  made\t in   the   income   and
\n     expenditure account for the current
\n     financial year  1980-81 and charged
\n     against   the    head   “288-Social
\n     Security  and   Welfare  –\t  Ka   –
\n     Schedule Caste,  Schedule Tribe and
\n     other backward  classes welfare – 2\n<\/p><\/blockquote>\n
     – uplift  of schedule  caste  under
\n     organisation  puronidhanit\t schemes
\n     by\t     centre-special\t central
\n     relief\/subsidiary relief\/ component
\n     relief\/state   relief   under   the
\n     special component plant for the all
\n     around  development   of  scheduled
\n     castes.\n<\/p><\/blockquote>\n
     This  order   is  issued  with  the
\n     Sanction of  the finance department
\n     received by its non-official letter
\n     No.%-2968-10-80 dated 15th October,
\n     1980.”<\/p><\/blockquote>\n
     At the  same time,\t by Office  Memorandum dated October
\n16, 1980,  the\tappellant  was\tappointed  to  the  post  of
\nOfficer on Special Duty (Special Component Plan) in the pay-
\nscale  of   Rs.500-1000\/-  created   under   the   aforesaid
\nGovernment Order  No.5158\/26-3-80-11(17)80 dated October 16,
\n1980. By  officer order\t dated January\t22, 1982  a new pay-
\nscale for  the post  of officer\t on  Special  Duty  (Special
\nComponent Plan)\t was sanctioned and now this post was in the
\npay-scale of  Rs.770-1600\/-.  This  was\t by  letter  of\t the
\nSpecial Secretary  to the Government of Uttar Pradesh to the
\nDirector, Harijan  and Social  Welfare Department.  The post
\nwas being  extended from  time to time by various Government
\norders. Then  comes the\t Office Memorandum dated May 8, 1984
\nissued by  the Secretariat  Administration  (Establishment),
\nSection I  abolishing this  post  and,\tat  the\t same  time,
\ncreating a  new post of the Officer on Special Duty (Special
\nComponent Cell). This Officer Memorandum we may reproduce as
\nunder :\n<\/p>\n
     \"Secretariat\t\t      Administration\n     (Establishment) Section-I\n     No.2667A\/Twenty-E-1-544(2)\/80\t    Lucknow\n     dated 8th May, 1984.\n     In\t reference   to\t The  Government\n     Resolution\t\tNo.\t     Pay\n<\/pre>\n
     R.1590\/Ten\/42(M)\/1980  dated   29th
\n     September,\t 1981\tpassed\ton   the
\n     recommendations made  in the report
\n     of Uttar  Pradesh\tPay  Commission,
\n     the undersigned  is directed to say
\n     that the  Governor\t is  pleased  to
\n     accord sanction for creation of one
\n     temporary\tpost   of   Officer   on
\n     Special  Duty   (Special  Component
\n     Plan)   in\t   the\t Uttar\t Pradesh
\n     Secretariat  from\t the   date   of
\n     issuance of  this order or from the
\n     date when the said post is utilised
\n     till 28th\tFebruary 1985  whichever
\n     is later  in the  new pay\tscale of
\n     Rs.770-40-1050-E.B.-50.1300-60-
\n     1420-E.B.60-1600 in  the  cadre  of
\n     Uttar Pradesh  Secretariat\t Service
\n     with the  condition that  the  said
\n     post may  be abolished  at any time
\n     before the\t specified date\t without
\n     any prior\tnotice. As  a result  of
\n     creation\tof    this   post,   one
\n     temporary\tpost   of   Officer   on
\n     Special  Duty   (Special  Component
\n     Plan)  in\tthe  old  pay  scale  of
\n     Rs.500-25-700-E.B.-40-900-E.B.-50-<\/p>\n
     1000 created  by  the  Harijan  and
\n     Social   Welfare\t Section-3    by
\n     Government\t Order\tNo.5158\/26.3.80-
\n     11(17)\/80 dated  16th October, 1980
\n     which was\trevised to  the new  pay
\n     scale   of\t  Rs.7000-40-1050-EB-50-\n<\/p>\n
     1300-60-1320-EB-60-1600\t      by
\n     Government\t Order\tNo.4346\/26.3.82-
\n     11(84)\/81 dated  22nd January, 1982
\n     of the  Harijan and  Social Welfare
\n     Section-3 and  the period\tof which
\n     has been extended for the last time
\n     upto  28th\t February  1985\t by  the
\n     Government\t Order\tNo.633\/26.3.1985
\n     dated 30th\t March 1984  of the same
\n     department,  that\t post  shall  be
\n     deemed to\tbe  abolished  from  the
\n     date when\tthe newly  created  post
\n     with the  same name  and equivalent
\n     to former post is brought into use.\n<\/p>\n
     2.\t  The said  post shall be deemed
\n     to be  included temporarily  in the
\n     posts of  Section Officers\t in  the
\n     Cadre of  Uttar Pradesh Secretariat
\n     Service.\n<\/p>\n
     3.\t  The holder  of the  said  post
\n     shall also\t be paid  in addition to
\n     pay  in  the  above  mentioned  pay
\n     scale,  dearness\tallowances   and
\n     other  allowances\t as   applicable
\n     under orders  issued from\ttime  to
\n     time by the Government.\n<\/p>\n
     4.\t  The  expenditure  incurred  in
\n     this regard,  shall be  made in the
\n     income and\t expenditure account for
\n     the  financial   year  1984-85  and
\n     charged against  the  Head\t “228  –\n<\/p>\n
     Social Security  and  Welfare  (Ka)
\n     Scheduled Castes,\tScheduled Tribes
\n     and other\tbackward classes welfare
\n     (2) – Scheduled Castes Welfare (Ng-

\n     of Scheduled  Castes under\t special
\n     component\tplan   special\t Central
\n     Relief  (Cent   per  cent\t central
\n     relief)\/Aubaid\t      Subsidiary
\n     grant\/component\/Government\t  relief
\n     (grant No.81).<\/p>\n
     5.\t  These orders\tare issued  with
\n     the   assent    of\t  the\t Finance
\n     Department\t received  by  its  non-\n<\/p>\n
     official Letter  No.E-129\/71 4  (A)
\n     dated 4th May, 1984.\n<\/p>\n

     As noted  above, in  pursuance to\tthis memorandum, the
\nState Government by notification dated My 14, 1984 appointed
\nRespondent No.4,  Shiva Shankar\t Singh on this newly created
\npost. This notification in relevant part reads as under:\n<\/p>\n
     “Government of Uttar Pradesh,
\n     Secretariat Administration
\n     (Establishment) Section-1.
\n     No.2792\/20-E-1-691\/84 dated 14th May, 1984
\n     Notification\/Appointment
\n     The following  permanent Upper  Division Assistants  of
\n     utter Pradesh  Secretariat\t are  appointed\t as  Section
\n     Officers on ad hoc and temporary basis from the date of
\n     taking charge  thereof and\t are  posted  to  the  newly
\n     created post\\vacancy  shown in  column 3  against their
\n     names respectively.\n<\/p><\/blockquote>\n

     The above\tposts have  been  notified  by\toffice\tMemo
\n     No.2667-2667-A\/Twenty E  544  (2)\/810  dated  9th\tMay,
\n     1984.\n<\/p><\/blockquote>\n
\t\t\t      sd\/-\n<\/p><\/blockquote>\n
\t\t\t Kamal Pandey,
\n\t\t\t Secretary.”<\/p><\/blockquote>\n
     As we  have seen  above letter  dated October  16, 1980
\ncreates the  post of  Officer on Special Duty at Secretariat
\nlevel. To that effect latter was addressed by the Secretary,
\nGovernment of  Uttar Pradesh  to the  Director, Harijan\t and
\nSocial Welfare.\t Similarly, Office  Memorandum dated  May 8,
\n1984 reproduced\t above abolishes that post and creates a new
\ntemporary post\tof Officer  on Special Duty. There is hardly
\nany scope  fir controversy  as raised  by the appellant that
\nthe post  of Officer  on Special  Duty which was a temporary
\npost and  to which  he was  appointed on  ad hoc  basis\t was
\ncreated in  the Directorate  and no in the Secretariat which
\nmeans in  the  ministry.  His  contention,  therefore,\tthat
\nSecretariat administration  had no  power or jurisdiction to
\nabolish the  post he was holding does not appear to have any
\nbasis. Admittedly,  the post  of  Officer  on  Special\tDuty
\n(Special Component  Plan)  which  was  temporary  was  being
\nextended from  time to\ttime by\t various Government  orders.
\nThere is  no Government order further extending this post or
\nany sanction  order from  the Finance Department as required
\nunder the  Uttar  Pradesh  Rules  Of  Business,\t 1975.\tEven
\notherwise the  post in the absence of any order of extension
\nor any\tfinancial sanction  lapses of  its own.\t The  Office
\nMemorandum dated  May 8, 1984 is specific and leaves no room
\nfor doubt that the temporary post of Officer on Special Duty
\n(Special Component Cell) which the appellant was holding was
\nabolished.  Under   the\t Uttar\tPradesh\t Rules\tof  Business
\ncreation of  post carrying pay scale the maximum of which is
\neither Rs.2,000\/-  or less  than Rs.  2,000\/-  requires\t the
\nsanction of  Minister Incharge\twhich he  can do  only after
\nDepartment of  Finance has concurred. If there is difference
\nof opinion  between the\t Minister In-charge  of a particular
\ndepartment where  the post  is sought  to be created and the
\nFinance\t Department   the  matter   is\treferred  under\t the
\naforesaid Rules\t to the\t Chief Minister.  The  letter  dated
\nOctober\t 16,   1980  creating\tthe  post  and\tthat  Office
\nMemorandum dated May 8, 1984 abolishing the post referred to
\nabove record  the sanction issued by the Finance Department.
\nWe may\trefer to  para 4(2)  of the  Uttar Pradesh  Rules of
\nBusiness, 1975 which is as under:\n<\/p>\n
     “4(2)  Unless  the\t case  is  fully
\n     covered  by   powers  to\tsanction
\n     expenditure or  to\t appropriate  or
\n     re-appropriate funds,  conferred by
\n     any general  or special orders made
\n     by\t the   Finance\tDepartment,   no
\n     department\t  shall,   without   the
\n     previous concurrence of the Finance
\n     Department, issue\tany orders which
\n     may –\n<\/p><\/blockquote>\n
     (a)  involve   any\t abandonment  of
\n     revenue or\t involve any expenditure
\n     for which\tno  provision  has  been
\n     made in the Appropriation Act;<\/p><\/blockquote>\n
     (b) involve  any grant  of land  or
\n     assignment\t   of\t  revenue     or
\n     concession, grant, lease or licence
\n     of mineral\t or forest  right  or  a
\n     right  to\t water\tpower\tor   any
\n     easement or privilege in respect of
\n     such concession;\n<\/p><\/blockquote>\n
     (c) relate\t to the\t number or grade
\n     of posts,\tor to  the strength or a
\n     service, or to the payor allowances
\n     or government  servants or\t to  any
\n     other conditions  of their\t service
\n     having financial implications; or\n<\/p><\/blockquote>\n
     (d)  otherwise   have  a  financial
\n     bearing\t  whether      involving
\n     expenditure or not:<\/p><\/blockquote>\n
     Provided  that  no\t orders\t of  the
\n     nature  specified\t in  clause  (c)
\n     shall be  issued in  respect of the
\n     Finance  Department   without   the
\n     previous\tconcurrence    of    the
\n     DEPARTMENT OF Personnel.”<\/p><\/blockquote>\n
     The Rule is specific and carries with it the mandate of
\nthe Constitution under Article 166 thereof.\n<\/p>\n
     We\t have\tnot  been  shown  any  order  of  the  State
\nGovernment extending  the duration of the post of Officer on
\nSpecial Duty (Special Component Cell) which the appellant is
\nholding or  sanction of\t the Finance  Department agreeing to
\nthe continuation of that post. We do not find any bar that a
\npost though  created in the Secretariat establishment in the
\nMinistry cannot\t be used  in  any  attached  or\t subordinate
\noffice but  that does  not give right to that office to hold
\non that post.\n<\/p>\n
     High Court\t has taken  correct view  of the  matter. We
\nfind no\t reason to  differ from\t the same.  The appeal lacks
\nmerit, it is dismissed with costs.<\/p>\n","protected":false},"excerpt":{"rendered":"
