Specify the role of the area engineer in construction of the above mentioned building.\n\nReply of the PIO:\nNo reply\n\nFirst Appeal:\nReply to the question was not provided by the PIO.\n\nOrder of the FAA:\n\"I. Sh. R.H. Bansal (Appellant) is present\n2. Sh. Jagdish Kumaar EE-13-II\/RZ is present\nThe case was taken up today. The original application of the appellant, appeal memo has been gone\nthrough. The grievance of the appeliant is that he has not received the reply so far. The PlO is therefore,\ndirected to furnish the reply to the applicant within 2 weeks.\"\n\nGround of the Second Appeal:\nNo information was provided by the PIO.\n Decision:\nFrom the contention of the appellant it appears that no information has been provided to\nhim. The FAA has recorded the presence of Sh. Jagdish Kumar, and yet Mr. Jagdish\nKumar deemed PIO appears to have disregarded the order of the First appellate authority.\n\nThe Appeal is allowed.\nThe PIO is directed to provide the complete information to the appellant before 30 January\n2011.\n\nThe issue before the Commission is of not supplying the complete, required information by the PIO\nwithin 30 days as required by the law.\nFrom the facts before the Commission it appears that the PIO is guilty of not furnishing information\nwithin the time specified under sub-section (1) of Section 7 by not replying within 30 days, as per the\nrequirement of the RTI Act. He has further refused to obey the orders of his superior officer, which raises\na reasonable doubt that the denial of information may also be malafide. The First Appellate Authority has\nclearly ordered the information to be given.\n\nIt appears that the PIO's actions attract the penal provisions of Section 20 (1). A showcause notice is\nbeing issued to him, and he is directed give his reasons to the Commission to show cause why penalty\nshould not be levied on him.\n\nHe will present himself before the Commission at the above address on 31 January 2011 at 02.30pm\nalongwith his written submissions showing cause why penalty should not be imposed on him as mandated\nunder Section 20 (1).
