Director &amp;\n                              Shri Dale Ram, SO)\n\nDate of Hearing       :       20.10.2009\n\nDate of Decision :            20.10.2009\n\nFACTS<\/pre>\n<p> :\n<\/p>\n<p>        The matter, is short, is that the appellant is working as a Chief<br \/>\nMedical Officer in Family Welfare Center attached to the Command<br \/>\nHospital, Kolkata, since 1995. For all these years, her ACR is being<br \/>\ninitiated by Sr. Executive Medical Officer (Officer Commanding of<br \/>\nthe Hospital) and reviewed by Major General (Medical) of the<br \/>\nEastern Command. However, this arrangement appears to have been<br \/>\naltered in the recent past. It is in this connection that vide her RTI<br \/>\napplication dated 18.12.2008, she had sought information on 05<br \/>\nparas.\n<\/p>\n<p>2.    The CPIO had responded to it vide letter dated 19.1.2009. The<br \/>\nAppellate Authority had dismissed the appeal vide letter dated<br \/>\n18.3.2009.\n<\/p>\n<p>3.   The present appeal is directed against the orders of the<br \/>\nCPIO\/AA.\n<\/p>\n<p>4.     Heard on 20.10.2009. Appellant present along with her<br \/>\nassistant. Dr. J. Mukherjee. The public authority is represented by the<br \/>\nofficers named above. The parties were heard. Para-wise discussion<br \/>\nis given here below :-\n<\/p>\n<p>(i). Para (a)\n<\/p>\n<p>5.     It is the say of the appellant that a complete copy of the<br \/>\nrelevant circular has not been provided to her. Shri Sinha furnishes a<br \/>\ncopy of the complete circular to the Commission which is handed<br \/>\nover to the appellant.\n<\/p>\n<p> (ii). Paras (b) (c) &amp; (d)\n<\/p>\n<p>6.     The main contention of the appellant is that as per DGAFMS<br \/>\nMedical Memorandum No. 129 dated July, 1991, Sr. Executive<br \/>\nMedical Officer has been designated as Reporting Officer for the<br \/>\nCMO. However, this arrangement has been altered vide letter No.<br \/>\n19651\/ACR\/DGAFMS\/DG-3 dated 27.8.2008 wherein &#8220;HOD of<br \/>\nDepartment (Division) to which attached&#8221; has been designated as<br \/>\nReporting Officer of the CMO. It is her forceful plea that the<br \/>\nMemorandum of 1991 has not been superseded in the aforesaid letter<br \/>\nresulting    in    an    incongruous      situation   whereby     two<br \/>\ninstructions\/guidelines survive side by side and thereby create<br \/>\nconfusion and uncertainty. Her further submission is that there is no<br \/>\nsanctioned post of HOD at present. Further, the identity of the<br \/>\n&#8216;Department&#8217; has not been established in the letter dated 27.8.2008.<br \/>\nShe, would, thus, forcefully plead that the confusion should be<br \/>\ncleared and status quo ante restored for harmonious functioning of the<br \/>\nMedical Officers.\n<\/p>\n<p>7.    On the other hand, Shri Sinha would submit that the<br \/>\nMemorandum of 1991 does not create a channel for writing\/reviewing<br \/>\nof the ACRs and, therefore, is not relevant in the matter in hand.<br \/>\nWhen queried as to under what guidelines\/instructions, the ACRs of<br \/>\nCMO were being written prior to the instructions of 2008, he does not<br \/>\ngive any categorical response. It, however, is his strong plea that the<br \/>\ncompetent authority has all the powers to create any channel for<br \/>\nwriting\/reviewing of ACRs and this power has been exercised<br \/>\nthrough letter dated 27.8.2008.\n<\/p>\n<p>(iii). Para (C)\n<\/p>\n<p>8.     The appellant would further submit that her query in this para<br \/>\nhas remained unresponded to so far. To this, Shri Sinha would<br \/>\nrespond that information regarding this para is to be provided by<br \/>\nCommand Hospital, Eastern Command, Kolkata and they have<br \/>\nalready been asked to do so. It is, however, noted that about 10<br \/>\nmonths have since passed but no response has been given to the<br \/>\nappellant. It is noted that Shri Sinha had marked a copy of his letter<br \/>\nto the Command Hospital perse and not to the CPIO concerned. He<br \/>\nnow undertakes to write DO letter to the CPIO of the Command<br \/>\nHospital, requesting him to provide requisite information to the<br \/>\nappellant in 04 weeks time.\n<\/p>\n<p>                              DECISION\n<\/p>\n<p>9.   As mentioned herein above, as regards pars (b), (c) &amp; (d) of the<br \/>\nRTI application, the letter of 27.8.2008 does not appear to supercede<br \/>\n the Memorandum of 1991 and this creates a confusing and anomalous<br \/>\nsituation. The contention of Shri Sinha that the Commission has no<br \/>\nauthority to question the competence of the administrative authority<br \/>\nto create channels for initiating\/reviewing ACRs is well taken. But as<br \/>\nan administrative authority, he is expected to clear the air by way of<br \/>\nissuing clear and categorical instructions in the matter in hand. In this<br \/>\nview of the matter, Shri Sinha is hereby directed to have necessary<br \/>\nclarifications issued so that there is no scope for confusion as to who<br \/>\nwill be the Reporting\/Reviewing officer in respect of CMOs posed in<br \/>\nFamily Welfare Centre in question. He is also directed to have<br \/>\ninformation expedited in respect of para &#8216;c&#8217; of the RTI application.\n<\/p>\n<p>10.
