Nos. 235 &amp; 406 of 2006\n             =~=~=~=~=~=~=~=~=~=~=~=~=~=~=~=~=\n           Dated this the 31st day of March, 2010\n\n                         JUDGMENT\n<\/pre>\n<p>Basheer, J.\n<\/p>\n<\/p>\n<p>      These two appeals are directed against a common<\/p>\n<p>award passed by the Motor Accidents Claims Tribunal,<\/p>\n<p>Kottayam in O.P.(MV) Nos. 1940 and 1941 of 1998.<\/p>\n<p>      2. The Tribunal found that the claimants were entitled<\/p>\n<p>to get compensation of Rs.12,500\/- and Rs.11,500\/-<\/p>\n<p>respectively. The appellant Insurance Company, which had<\/p>\n<p>allegedly issued a valid insurance policy in respect of the<\/p>\n<p>offending   vehicle   (bus),   was  directed  to   pay  the<\/p>\n<p>compensation to the claimants.\n<\/p>\n<p>      3. The said award is challenged by the appellant<\/p>\n<p>Insurance Company, contending that insurance policy had<\/p>\n<p>not been issued by the appellant in respect of the offending<\/p>\n<p>vehicle, as alleged by the claimants.<\/p>\n<p>      4. We have heard learned counsel for the appellant<\/p>\n<p><span class=\"hidden_text\">MACA 235 &amp; 406\/06              2<\/span><\/p>\n<p>and learned counsel for the second respondent. Though<\/p>\n<p>notice has been served on the owner of the offending<\/p>\n<p>vehicle, he has not appeared either in person or through<\/p>\n<p>counsel.\n<\/p>\n<p>      5. In M.A.C.A.No.235 of 2006      the claimant has<\/p>\n<p>accepted notice, but he has not entered appearance either<\/p>\n<p>in person or through counsel. In M.A.C.A.No.406 of 2006<\/p>\n<p>notice to respondents 1 to 5 was taken out by paper<\/p>\n<p>application. Except the driver of the bus, others have not<\/p>\n<p>appeared.\n<\/p>\n<p>      6. The specific case of the appellant before the<\/p>\n<p>Tribunal was that the offending vehicle was not covered<\/p>\n<p>under a valid insurance policy. Though such a specific<\/p>\n<p>contention was raised, the owner of the vehicle did not<\/p>\n<p>choose to adduce any evidence to controvert the above<\/p>\n<p>contention. But still the Tribunal took the view that the<\/p>\n<p>Insurance Company was liable to indemnify the owner. We<\/p>\n<p>are of the view that the above conclusion arrived at by the<\/p>\n<p>Tribunal is without any justification.<\/p>\n<p><span class=\"hidden_text\">MACA 235 &amp; 406\/06           3<\/span><\/p>\n<p>     7. In that view of the matter the impugned award is<\/p>\n<p>modified. The direction to the appellant to pay the<\/p>\n<p>compensation is set aside.
