With the consent of the parties, this<\/p>\n<p>                   application is now being disposed of.\n<\/p>\n<p>                                In view of submissions advanced on behalf of the<\/p>\n<p>                   petitioner, facts in detail need not be set out which led to filing<\/p>\n<p>                   of the present case. On 07.04.2004, the police on getting<\/p>\n<p>                   confidential information reached the house of the petitioner. He<\/p>\n<p>                   was seen escaping therefrom. A chase was offered and he was<\/p>\n<p>                   captivated. On search being conducted of the room occupied by<\/p>\n<p>                   the petitioner, one country-made pistol was found kept beneath<\/p>\n<p>                   the pillow. Further search found two country-made pistols kept<\/p>\n<p>                   concealed beneath the wooden almirah. He was accordingly<\/p>\n<p>                   charge-sheeted and put on trial.        11 P.Ws. were examined.<\/p>\n<p>                   Several exts. as well as materials exts. were also produced. On<\/p>\n<p>                   a consideration of materials on record, learned trial court by<\/p>\n<p>                   judgment and order dated 28.03.2006 passed in Tr. No.1347\/06<\/p>\n<p>                   observed as under:\n<\/p>\n<p>                                    &#8220;Accused was present at the time of search<br \/>\n<span class=\"hidden_text\">                      2<\/span><\/p>\n<p>              and seizure and in presence of P.W.4 and<br \/>\n              P.W.5 seizure list was prepared and copy of<br \/>\n              same was furnished to accused and accused<br \/>\n              has never denied his signature on seizure list<br \/>\n              and he only took defence that some other<br \/>\n              person may have planted the Arms at the P.O.<br \/>\n              but he has been kept mum about his bed at<br \/>\n              chowki and recovery of M.Ext.1. After carefully<br \/>\n              scrutinizing the materials\/evidence available on<br \/>\n              record I find the persecution has been able to<br \/>\n              bring home the charges levelled against the<br \/>\n              accused beyond shadow of reasonable doubts&#8221;<\/p>\n<p>            Aggrieved by the aforesaid judgment and order the<\/p>\n<p>petitioner preferred criminal appeal being Cr. Appeal No.15\/06.<\/p>\n<p>Learned appellate court in the light of the grounds disclosed in<\/p>\n<p>the memo of appeal, considered the same and re-scanned the<\/p>\n<p>evidence on record and thereby concurred with the finding(s)<\/p>\n<p>recorded by learned trial court. Accordingly, his conviction<\/p>\n<p>under section 25(1-B) a and 26(1) of the Arms Act and sentence<\/p>\n<p>to undergo R.I. for three years with fine having default clause<\/p>\n<p>were maintained.\n<\/p>\n<p>            Counsel for the petitioner, referring to judgment of<\/p>\n<p>learned trial court, submits that at the time of conviction he was<\/p>\n<p>found close to 55 years. It is also contended that learned trial<\/p>\n<p>court did not find any criminal antecedent and\/or past conviction<\/p>\n<p>against the petitioner. It is contended that the petitioner is now<\/p>\n<p>aged about 60 years. It is next contended that he had to fight the<\/p>\n<p>criminal litigation for over two years and thereby suffer<\/p>\n<p>excruciating circumstances which is\/are a shade of punishment.<\/p>\n<p>It is thus contended that the petitioner deserves a lessor<\/p>\n<p>punishment for proven charge(s).\n<\/p>\n<p><span class=\"hidden_text\">                            3<\/span><\/p>\n<p>                  Counsel for the State, however, supported the two<\/p>\n<p>     impugned judgments. It is contended that learned trial court has<\/p>\n<p>     found that P.Ws.4 and 5 have admitted their signatures on the<\/p>\n<p>     seizure memo (Ext.1), a copy whereof was duly furnished under<\/p>\n<p>     the L.T.I.\/signature to the petitioner-accused. It is the contention<\/p>\n<p>     of learned APP that finding(s) of guilt recorded by the two<\/p>\n<p>     courts below cannot be said to be perverse and\/or perfunctory.<\/p>\n<p>                  I have considered the submissions made on behalf of<\/p>\n<p>     the parties. Definitely, the petitioner was 55 years of age at the<\/p>\n<p>     time of conviction. He must be 60 years of age by now. Learned<\/p>\n<p>     trial court records that there is no past conviction. In that view of<\/p>\n<p>     the matter, a lessor punishment, in the facts and circumstances of<\/p>\n<p>     the case, would subserve the cause of justice<\/p>\n<p>                  Accordingly, while maintaining the conviction<\/p>\n<p>     recorded by learned trial court and duly affirmed by learned<\/p>\n<p>     lower appellate court, this Court reduces the sentence of R.I.<\/p>\n<p>     for three years under section 25(1-B) and 26(1) of the arms Act<\/p>\n<p>     to R.I. for two and half years under each count. Other<\/p>\n<p>     part(s)\/condition(s) of the sentence shall remain intact.<\/p>\n<p>                  With this modification in sentence, the application is<\/p>\n<p>     dismissed.\n<\/p>\n<\/p>\n<p>                               ( Kishore K.
