The short question that arises for ourconsideration<br \/>\nin  this  appeal is whether the impugned order of  the\tHigh<br \/>\nCourt  of Orissa dated 27-9-1993 passed in OJC No.  5435  of<br \/>\n1993  directing the appellants not to take any\tdecision  on<br \/>\nthe   advertisement   dated   27-7-1993\t  issued   by\t the<br \/>\nSuperintendent CDMO, Bolangir to settle the shop with anyone<br \/>\nto  hold  a  medical store  inside  the\t hospital  premises,<br \/>\nPatnagarh could be sustained in the absence of any  material<br \/>\nto  show  that\tthe  said  decision  of\t the  Government  is<br \/>\narbitrary  or  opposed to any rule or  regulations  in\tthat<br \/>\nbehalf.\t 3.  The brief facts leading to\t this  appeal  under<br \/>\nArticle\t  136  of  the\tConstitution  are  that\t the   State<br \/>\nGovernment of Orissa with a view to streamline the  existing<br \/>\nprocedure  for\topening of 24 hours medical  stores  in\t the<br \/>\nCollege,  Hospitals, etc. and in super session\tof  previous<br \/>\ninstructions  took a decision that 24 hours  medical  stores<br \/>\nshall  be opened in the campus of the hospital\twhich  shall<br \/>\nremain\topen  for all the 24 hours with a view to  make\t the<br \/>\nmedicines  available to the patients at\t competitive  price.<br \/>\nConsequently,  a memo dated 13-5-1993 was issued to all\t the<br \/>\nDMET\/DHS\/DC  and all Superintendents of Medical Colleges  of<br \/>\nthe State of Orissa as well as to all CDMOs and CMOs in\t the<br \/>\nCapital Hospital, Bhubaneswar to assess the need for  having<br \/>\n24  hours  medical stores in the campus\t of  the  respective<br \/>\nhospitals  and\tif the need is found to be  imperative\tthey<br \/>\nshall  make an order to that effect and issue  advertisement<br \/>\ninviting  applications from eligible persons.  According  to<br \/>\nthe  instruction, the said applications have to be  sent  to<br \/>\nthe authorities mentioned in the aforesaid memo who in\tturn<br \/>\nhave to forward the same to the Government along with  their<br \/>\nviews\/comments for a final decision at the Government level.\n<\/p>\n<p>It    was   in\t pursuance   of\t  this\t memo\t that\t the<br \/>\nSuperintendent\/CDMO,   Bolangir\t issued\t  an   advertisement<br \/>\ninviting applications from the intending shop owners to open<br \/>\na  medical store inside the premises of\t the  Sub-Divisional<br \/>\nHospital,  Patnagarh which shall be kept open day and  night<br \/>\nfor  the  purposes  of\thelping\t the  patients\tIn   getting<br \/>\nmedicines  without any difficulty.  Respondents 1 to  7\t who<br \/>\nare having their medical stores across the road in front  of<br \/>\nthe main gate No. 2 of the Hospital filed the writ  petition<br \/>\nin   the   High\t Court\tof  Orissa  challenging\t  the\tsaid<br \/>\nadvertisement  issued  by  the\tSuperintendent\/CDMO  on\t the<br \/>\nground that if a medical store is opened inside the premises<br \/>\nof  the\t Sub-Divisional Hospital which is a  small  hospital<br \/>\nhaving\ta provision for only 30 beds, there will  hardly  be<br \/>\nany  business  to sustain them.\t The respondents  also\tcame<br \/>\nforward<br \/>\n<span class=\"hidden_text\">654<\/span><br \/>\nwith  an  offer\t that  Petitioners 1 and 4  to\t7  (who\t are<br \/>\nRespondents 1, 4 to 7 herein) whose medical stores are\tnear<br \/>\nthe  gate  of the Hospital shall keep their  medical  stores<br \/>\nopen  day  and night and that they are willing\tto  give  an<br \/>\nundertaking  to\t that  effect  to  the\tSuperintendent\/CDMO,<br \/>\nBolangir.  The said petition was contested by the appellants<br \/>\nherein by stating that the said advertisement was issued  in<br \/>\nview  of  the  Government policy to open  the  medical\tshop<br \/>\nwithin\tthe  campus of the Hospital in public  interest\t and<br \/>\nspecially  to make the medicines available to  the  patients<br \/>\neven at odd hours.\n<\/p>\n<p>4.It  appears that during the course of arguments in  the<br \/>\npetition  before  the High  Court  the\tSuperintendent\/CDMO,<br \/>\nBolangir was personally present in the Court who in response<br \/>\nto  certain questions put by the learned Judges stated\tthat<br \/>\nthe whole purpose of the advertisement is to make  available<br \/>\nmedicines to the patients day and night.  However, the\tHigh<br \/>\nCourt  allowed the petition of the respondents and  directed<br \/>\nthat  no  decision shall be taken on  the  advertisement  to<br \/>\nsettle\tthe shop with anyone to hold a medical store  inside<br \/>\nthe  premises of the Sub-Divisional Hospital,  Patnagarh  if<br \/>\nthe  petitioners  (Respondents\t1, 4 to 7  herein)  give  an<br \/>\nundertaking  to\t the CDMO, Bolangir within 10  days  stating<br \/>\nthat each one of them shall keep his shop open day and night<br \/>\nand shall make the medicines available to the patients.\t The<br \/>\nHigh  Court  further  directed\tthat in\t the  event  of\t any<br \/>\nviolation  of this condition and if the CDMO comes  to\tknow<br \/>\nthat  the  ailing patients of the  Sub-Divisional  Hospital,<br \/>\nPatnagarh  are not getting medicines because of the  closure<br \/>\nof  the\t shops it would be open to him to  re-advertise\t the<br \/>\nsettlement of medical store.  The appellants being aggrieved<br \/>\nby the said order have preferred this appeal.\n<\/p>\n<p>5.Learned counsel appearing for the appellants vehemently<br \/>\nurged  before  us  that\t the  said  advertisement   inviting<br \/>\napplications  for settling the shop to have a medical  store<br \/>\ninside the hospital premises was issued in pursuance of\t the<br \/>\nGovernment  policy  and\t with the sole object  to  make\t the<br \/>\nmedicines  available to the patients even at odd hours\tand,<br \/>\ntherefore,  the High Court should not have  interfered\twith<br \/>\nthe  administrative decision of the Government taken in\t the<br \/>\npublic\tinterest.   We\tfind  considerable  force  and\tmuch<br \/>\nsubstance in these submissions.\n<\/p>\n<p>6.In   the  aforesaid  background  the\tquestion   arises<br \/>\nwhether,  in  the absence of any rule or regulation  to\t the<br \/>\ncontrary,  can\tthe power of the State be  abridged  on\t the<br \/>\nbasis  of an individual interest of certain trader, even  to<br \/>\nthe  extent of restricting the State&#8217;s capacity\t to  advance<br \/>\nlarger\tpublic\tgood.  It can hardly be\t disputed  that\t the<br \/>\nconsideration  of  availability\t of  the  medicines  to\t the<br \/>\npatients  should be the uppermost consideration as  compared<br \/>\nto  the right of a person to derive income and make  profits<br \/>\nfor his sustenance by running a medical store for the reason<br \/>\nthat the medical stores are primarily meant for the patients<br \/>\nand not the patients for the medical stores or those who run<br \/>\nthe  same.   The  submission of the respondents\t that  if  a<br \/>\nmedical\t store is opened within the campus of the  Hospital,<br \/>\nthe same will jeopardise their interest adversely  affecting<br \/>\ntheir  business\t and that they will not be able\t to  sustain<br \/>\nthemselves  could  not\tbe a valid ground  to  disallow\t the<br \/>\nappellants to open a<br \/>\n<span class=\"hidden_text\">655<\/span><br \/>\nshop  within the Hospital campus.  Undoubtedly, the  opening<br \/>\nof a medical store within the Hospital campus will provide a<br \/>\ngreat  facility\t to the patients who may not be\t having\t any<br \/>\nattendant of their own in the Hospital for their  assistance<br \/>\nat  odd\t hours\tin the event of an emergency to\t go  out  to<br \/>\npurchase  the  medicines.  There may be patients  having  an<br \/>\nattendant  who may not find it convenient or safe to go\t out<br \/>\nof the campus to purchase the medicines in the night  hours.<br \/>\nIn these facts and circumstances the paramount consideration<br \/>\nshould be the convenience of the patients and protection  of<br \/>\ntheir  interest and not the hardship that may be  caused  to<br \/>\nthe  medical  storekeepers  who may be\thaving\ttheir  shops<br \/>\noutside\t the  Hospital campus.\tThus the  intention  of\t the<br \/>\nappellants  to\topen  a medical store  within  the  Hospital<br \/>\ncampus\tis  to\tsalvage the  difficulties  of  the  patients<br \/>\nadmitted  in the Hospital and this object of the  appellants<br \/>\nhas direct nexus with the public interest particularly\tthat<br \/>\nof  the patients and, therefore, the High Court\t should\t not<br \/>\nhave interfered with the decision of the State Government to<br \/>\nsettle\tthe  holding  of a medical  store  in  the  Hospital<br \/>\npremises.   However, if the respondents so choose, they\t may<br \/>\nkeep   their  medical  stores  also  open  day\tand   night.<br \/>\nConsequently the impugned order could not be sustained.\n<\/p>\n<p>7.In  the result the appeal succeeds and is hereby  allowed.<br \/>\nThe impugned order of the High Court dated 27-9-1993 is\t set<br \/>\naside  and  the writ petition filed by\tthe  respondents  is<br \/>\ndismissed.
