He was originally appointed as peon in<\/p>\n<p>the   bank   under   the   dying-in-harness   scheme   consequent   on   the<\/p>\n<p>death of his father.   He is having 24 years and 8 months service.<\/p>\n<p>He passed the secondary certificate course conducted  by the Ana<\/p>\n<p>Technological   University.     Ext.P1   is   the   certificate   issued   by   the<\/p>\n<p>Anna   Technological   University.     Ext.P2   is   the   communication<\/p>\n<p>issued by the Government of India under the   Ministry of Human<\/p>\n<p>Resources Development which reads as follows:<\/p>\n<blockquote><p>               &#8221;  I am directed to your letter no  ATU\/04\/1524<\/p>\n<p>        dated   7th  Jan   04,   regarding   Reorganisation   of<\/p>\n<p>        Degree\/Diploma\/Certificates   issued   by   Anna<\/p>\n<p>        Technological University, Raipur ( Chhattisgarh).   It<\/p>\n<p><span class=\"hidden_text\">WPC No.14536\/07                         2<\/span><\/p>\n<p>        is   to   say   that   Degree\/Diploma\/Certificates   &amp;   Pre-<\/p>\n<p>        University   (   10th  &amp;   10+2)   Courses   awarded   by   a<\/p>\n<p>        University for which it is recognised or authorised as<\/p>\n<p>        reacquired by any law does not require any separate<\/p>\n<p>        recognition.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>               Your   University   being   established   under   State<\/p>\n<p>        Act( Chhattisgarh notified by Gazette notification no<\/p>\n<p>        E-73-212\/03\/HE\/38   dated   10\/10\/2003                     under<\/p>\n<p>        Chhattisgarh   Niji   Ksheatra   Vishawavidalaya<\/p>\n<p>        ( Sthapana and Viniyaman) Adhiniyam 2002  ( No-2<\/p>\n<p>        of   2002).     Degree\/Diploma\/Certificate   including<\/p>\n<p>        pre-university ( 10th &amp; 10+2) courses issued by Anna<\/p>\n<p>        Technological   University   Raipur   (   Chhattisgarh)<\/p>\n<p>        stands   automatically   recognised   for   the   purpose   of<\/p>\n<p>        employment   under   Central\/State   Government,   for<\/p>\n<p>        Higher  Studies in India and Abroad.<\/p><\/blockquote>\n<p>      2.     Case   of   the   petitioner   is   that   the   first   respondent<\/p>\n<p>established   by   the   Government   of   Kerala   is   a   statutory   entity<\/p>\n<p>imparting   training   in   various   courses.     It   invited   application   for<\/p>\n<p>admission  to  Junior Diploma in Co-operation,  known  as JDC for<\/p>\n<p>the course commencing in June 2007.  Basic qualification for being<\/p>\n<p><span class=\"hidden_text\">WPC No.14536\/07                            3<\/span><\/p>\n<p>admitted   in   the   course   is   SSLC   or   equivalent.     According   to   the<\/p>\n<p>petitioner,   the   qualification   which   the   petitioner   possesses   is<\/p>\n<p>equivalent to SSLC.\n<\/p>\n<\/p>\n<p>      3.        In the statement filed on behalf of the first respondent.<\/p>\n<p>it is stated as follows:\n<\/p>\n<\/p>\n<blockquote><p>                  &#8221;   The   petitioner   is   working   as   cashier   in<\/p>\n<p>            Nedumangad             Co-operative Urban Bank Ltd. No.<\/p>\n<p>            3193.     The   first   respondent   invited   applications   for<\/p>\n<p>            admission to JDC course commencing in June, 2007.<\/p>\n<p>            The minimum qualification required for admission to<\/p>\n<p>            the   JDC   course   is   SSLC.     The   qualification   of   the<\/p>\n<p>            petitioner   is   secondary   certificate   course   from   Anna<\/p>\n<p>            Technology University, Raipur.  The 2nd respondent is<\/p>\n<p>            identical matter have referred the same to the Director<\/p>\n<p>            of   Public   Instruction,   Kerala   for   obtaining<\/p>\n<p>            clarification   whether  the   secondary   certificate   course<\/p>\n<p>            from Anna Technology is equivalent to SSLC issued<\/p>\n<p>            by Government of Kerala.  It is submitted on behalf of<\/p>\n<p>            this   respondent   that   Raipur   Anna   Technological<\/p>\n<p>            University is not included in the records in the office<\/p>\n<p>            relating   to   the   equivalency   certificate.     Hence   it   is<\/p>\n<p><span class=\"hidden_text\">WPC No.14536\/07                            4<\/span><\/p>\n<p>            prayed that the petitioner is not entitled to any reliefs<\/p>\n<p>            sought in the writ petition.&#8221;<\/p><\/blockquote>\n<p>      4.       I   heard   the   learned   counsel   for   the   petitioner   and   the<\/p>\n<p>learned counsel for the first respondent also.<\/p>\n<p>      5.       Learned   counsel   for   the   petitioner   submits   that   it   is   a<\/p>\n<p>hard   case   where   petitioner   has   been   working   since   1982   and<\/p>\n<p>persons   even   with   one   year   service   are   being   admitted   to   the<\/p>\n<p>course.  He submits that having regard to the terms in Ext.P2 there<\/p>\n<p>cannot   be   any   doubt   that   the   qualification   possessed   by   the<\/p>\n<p>petitioner must be treated as equivalent to SSLC.   Learned counsel<\/p>\n<p>for   the   first   respondent   reiterates   the   contention   taken   in   the<\/p>\n<p>statement.\n<\/p>\n<\/p>\n<p>       What is stated in Ext.P2 is only that the certificate issued by<\/p>\n<p>the   Anna   Technological   University   stands   automatically<\/p>\n<p>recognised for the purpose of employment under the Central\/State<\/p>\n<p>Government and  higher studies in India and Abroad.   Admittedly<\/p>\n<p>petitioner does not have SSLC and he can claim admission only if<\/p>\n<p><span class=\"hidden_text\">WPC No.14536\/07                            5<\/span><\/p>\n<p>he possesses a qualification which is treated as equivalent.   Going<\/p>\n<p>by Ext.P2 all that it says is that the certificate ( Ext.P1) possessed<\/p>\n<p>by   the   petitioner   is   to   be   recognised     for   the   purpose   of<\/p>\n<p>employment   and   higher   studies.     It   cannot   be   relied   upon   to<\/p>\n<p>establish   that   the   certificate   possessed   by   the   petitioner   is<\/p>\n<p>equivalent to SSLC qualification.  They are two different concepts<\/p>\n<p>in   my  view.     If   that   be   so,   much   as   I   may   sympathise   with   the<\/p>\n<p>condition   of   the   petitioner,   I   feel   myself   disabled   by   the<\/p>\n<p>requirement   for   admission   to   the   course.   Even   though   learned<\/p>\n<p>counsel   for   the   petitioner   would   submit   that   Ext.P2   was   not<\/p>\n<p>considered by respondents, I feel that no purpose will be served by<\/p>\n<p>directing that the matter to be looked into by the respondents.
