Justice K.R.UDAYABHANU\n\n Dated :18\/12\/2006\n\n O R D E R\n                      K.A.ABDUL GAFOOR &amp;\n\n                     K.R.UDAYABHANU, JJ.\n\n              -------------------------\n\n                        W.A.No.1463 of  2003 B\n\n              -------------------------\n\n              Dated this the 18th day of December, 2006.\n\n\n\n                                  JUDGMENT\n<\/pre>\n<p>Abdul Gafoor, J.\n<\/p>\n<\/p>\n<p>             The issue raised in this writ appeal, at the instance of the<\/p>\n<p>Union   of   India   and   the   Food   Corporation,   is   whether   the   writ<\/p>\n<p>petitioner,   the   respondent   in   this   appeal,   is   entitled   to   arrears   of<\/p>\n<p>pay   consequent   on   his   retrospective   promotion   with   effect   from<\/p>\n<p>November,   1957.     That   entitlement   of   the   respondent   cannot   be<\/p>\n<p>disputed any more in the light of Ext.P1 judgment of the Karnataka<\/p>\n<p>High Court, which stands confirmed by Ext.P2 judgment of the Apex<\/p>\n<p>Court.  The former judgment reads as under:<\/p>\n<blockquote><p>        &#8220;We  therefore,  direct   that   the  petitioner&#8217;s  case   for<\/p>\n<p>        promotion   to   the   post   of   godown\/dock<\/p>\n<p>        superintendent   be   considered   as   on   11.11.1957<\/p>\n<p>        when   the   third   respondent   was   promoted   and<\/p>\n<p>        according  to the rules  than it  force (sick &#8216;then in<\/p>\n<p>        force&#8217;), and that if he is found fit for promotioness<\/p>\n<p>        (sick   &#8216;promotion   as&#8217;)   on   that   etc.   the   promotion<\/p>\n<p>        already given to him to that position be dated back<\/p>\n<p>        to 11.11.1957  and he be granted  all  consequential<\/p>\n<p>W.A.NO.1463\/03<\/p>\n<p>                                                       :: 2 ::<\/p>\n<blockquote><p>           benefits.   If he is not found fit for promotion as<\/p>\n<p>           on   11th  November,   1957   he   will   not   get   any<\/p>\n<p>           relief.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>                  2.  An appeal was carried to the Supreme Court by the<\/p>\n<p>Government   of   India   and   the   Food   Corporation.     Ext.P2   is   the<\/p>\n<p>judgment   dismissing   the   said   appeal.     Necessarily,   Ext.P1<\/p>\n<p>direction   stands   confirmed.     It   has   been   specifically   directed   in<\/p>\n<p>Ext.P1 that, &#8220;in case the writ petitioner\/third respondent is<\/p>\n<p>entitled to promotion with effect from 11.11.1957  he be<\/p>\n<p>granted all consequential benefits&#8221;.   Consequential  benefits<\/p>\n<p>arising out of the retrospective promotion are:\n<\/p><\/blockquote>\n<blockquote><p>                  (a)             The salary and allowances, and<\/p>\n<\/blockquote>\n<blockquote><p>                  (b)             The seniority.<\/p><\/blockquote>\n<\/blockquote>\n<blockquote><p>                  3.   The dispute is with regard to the former alone.  It<\/p>\n<p>is true that there is a general   principle of   &#8220;no work &#8211; no pay&#8221;.\n<\/p><\/blockquote>\n<p>This   would   have   been   a   principle   to   be   canvassed   before   the<\/p>\n<p>Karnataka   High   Court,   which   passed  Ext.P1   judgment.
