C--ij\\iil__Ju&#039;drge\n(Sr.Dn.], Hubli and etc.   A&quot; 5 . \n\nThis appeal coming on for orders this  iJ&quot;.i,.. \n\ndelivered the following: --   \n\nJUDGMENT   A \n\nThough this matter is listeclipior orders, by i&#039;con:s_ent.. or their&#039;\n\nparties the appeal is heard on merits_.___\ufb02&#039;~v._ &#039;\n\n2. The appellantwas  No.21 \/ 1989 on\nthe file of the Civilgeludigeh irfitihii. Challenging the\nlegality and correctne.s\u00a7_ award passed in LAC\nNo.21 of 19\u00ab&#039;.%&#039;9  present appeal is \ufb01led. The\nrespondent  Jiof 1 acre 38 guntas of land\nsituated in&#039;RS. Noi.2-&#039;:7i&#039;_Qi\/&#039;li+2.5r&#039;3\u00absituated at Gokul Village in Hubli\n    acquired for the bene\ufb01t of the\n\nappellant-   a road to Cotton Oil Seed Complex of the\n\nivTRT-..gppellant--.r4__ Accordingly, a notification under Section 4 of the Land\n\n* -\u00abEA-vcqui.sition Acfwas issued and ultimately an award was passed on\n\n\ufb01xing the market value at the rate of Rs.ll,500\/-- per\n\n\n\n3. Being not satis\ufb01ed with the award of the Land Acquisition\n\nOfficer, the 2nd respondent requested the Land Acquisition\n\nto send a reference under Section 18 of the Land Acquisit.ioriiAct.ito \n\ndetermine the actual market value of the the if\n\nreference was sent to Civil Judge (Senior&quot;:DiVisioin)  \n\nmarket value. Referring the ma&#039;Lter&#039;~..to the refe_rer1ce.__&quot;c:ourt was&#039;\n\nquestioned by the appellant herein__i:ih3t__\ufb01l_ing  petition in\nW.P.No.40919 of 2002 before..xth.i.As&#039;i-.(:o:urtuoniitheground that the\nappellant herein wasnot   the reference\ncourt and  allowed by the\nreference court  to the appellant. The\nwrit petition&#039; filed [came to be allowed and the\nmatter was reini_tted  court to reconsider the matter\nafter giving&#039; an    appellant. The reference court\n theipkmatteriiirelying upon the documents produced\n\nby the LE7-&#039;iirespQn&#039;de&#039;nt.ihas determined the market value at the rate\n\n Rs.6,5Q&#039;0\/iiigunta. This judgment and award is called in\n\n&quot; -\u00ab .fq&#039;de_sti.on in this appeal.\n\n\n\n4. We have heard learned counsel appearing for the parties.\n\nThe counsel for the appellant contends that the reference conlrlt\u00bb has\n\ncommitted a serious error in fixing the market value at~thel.r__at\u00b0e,of,\n\nRs.6,500\/- per gunta relying upon Ex.P7. Accordin_glv_&#039;to.qhi.Am  _ \n\nwas acquired by the Land Acquisition Officer and \n\nconverted from agricultural to non--agri&#039;eul&#039;turalgp1,1rpose\u00b0:eVen&quot;g\n\nbefore the initiation of the preliminary:neti\ufb01cat&#039;ionl.&quot;&#039;t .&quot;7Therelfore, he\ncontends that Ex.P7 shouldiinot  by&#039; the\nreference court. Therefore, he   reconsider the\nmatter and set aside:\u00ab.lth--e  passed by the\n\nreference court.\n\n5. Per  for the claimants submits that\nthe judgmentlofplthle  has been confirmed by this\nCourt in   byia Division Bench of this Court on\n  theivrlllloordships have held that the market\n\nvaluEe--..o.f.the&#039; acquired under EX.P7 and the potentiality of the\n\n&#039;v.__A\u00b0&#039;lVand acquired: *inl\u00a7&#039;.l&#039;the present case are one and the same and\n\n&quot; &quot; -\u00abltherefopre, the,_a&#039;ward passed by the reference court earlier has been\n\n an appeal filed by the Special Land Acquisition\n\n(V\n\n\n\nOfficer. Therefore, he submits that the present appeal has to be \n\nrejected.\n\n6. He further contends that the land in qu_es.tion ev&#039;e.nHmuich&#039;&#039;&#039;&#039;&#039; &#039;\n\nprior to the initiation of preliminary notification underS&#039;ecti&#039;on&quot;4(&#039;1)d&#039;  \n\nof the Act was within the I-lubli--Dharwar&#039;Corporation  \n\ntherefore, the market value of the land acqui_r:edv:_undper \nthe present one can be considered as_  fu.r&#039;thei~..pcontends\nthat the land under Ex.P7 was&#039;acquired&quot;:se&#039;ven  to the\nnoti\ufb01cation in the  thefrefference court\n\nshould have considered th.e{&quot;--c3b_:$t  from the date of\n\nnotification under  the&quot;-noti\ufb01cation issued in the present\n\nCESC.\n\n counsel for the appellant submits that the\n\nlearned c&#039;ounsel--\u00ab claimant cannot rely upon the order passed\n\n MFA 2902 since this Court had given an opportunity\n\nit  appellant to file an application to recall the order passed in\n\n --..lp\\fi&#039;o\u00bb.2z765\/2002. Therefore, he submits that the order of\n\n6\/\n\n\n\ncon\ufb01rmation passed in MFA No.2&#039;\/&#039;65\/2002 has no bearing in\n\norder to consider this appeal on merits.\n\n8. On perusal of the records, we have...--s.eenV&#039;i-that  \n\nopportunity was given to the appellant :,_l_&#039;i&#039;E3:1V&#039;Cli:I:l &#039;:\n\napplication to recall the order passed in  \n\norder--sheet in MFA No.2&quot;\/65\/2002  that_a\ufb02n lppllcgilon in\nfact had been \ufb01led by the &#039;recall  said order,\nbut a co--ordinate Bench of   has rejected\nthe said application.&#039;  appellant fairly\n\nsubmits that against&#039;i__thel&quot;--orjdsi-.o,llpasSedv.: on 24.11.2008 in MFA\n\nNo.2765\/20d2, not &#039;preferred any appeal to the\nSupreme Cour&#039;t..J in  the judgment passed by a co-\nordinate Baler; &#039;MFA &#039;1\u00a7r&#039;o.2.&#039;76s.i\/2002 has become \ufb01nal. Though it\n  thep_learneldHcounse1 for the appellant that the land\n\nacquired_i-unde&#039;r..v was converted from agricultural to non-\n\nlv{,,,.,4&#039;g~igricultural purpose, in MFA No.2765\/ 2002 a co--ordinate Bench\n\n&quot;&#039;ilfiasl&#039;admittedly; given a \ufb01nding stating that land acquired under\n\n Was.5 also an agricultural land and not converted from\n\nVlagriucultural to non~agricultural purpose, nor substantiated the\n\n5\/\n\n\n\ngrounds urged by the learned counsel for the appellant that the\n\nland under EXP&#039;? was converted from agricultural to.--non\u00bb\n\nagricultural purpose. No material is placed before this\n\nbefore the reference court. In the circumstances tl1&#039;e&#039;&#039;contentioni &quot;\n\nurged by the learned counsel for the appe-1--ia&#039;nt-- .can&#039;notibe&#039;iaccepted&#039;;..\n\n9. In View of the order passed in  \/&#039;2:C&#039;O2&#039;, \n\nis an appeal preferred by the  Land\n\nchallenging the very same judgment Vaward, iwe\u00ab are of the View\n\nthat there is no necessity to corisider   the appellant on\n\nmerits again. When the land\n\n&#039; iW....has been_&#039;isitua&#039;te&#039;i\u00a3&#039;I.within the limits of the Corporation, even if it is\n\n.jipigifiotconvertedfrom agricultural to non--agricultural, the potentiality\n\n&#039;j._&#039;_&quot;of_  acquired in the present case cannot be treated as\n\naw\n\n\n\ninferior to the land acquired under EXP7. Both the lands can be\n\nused for non--agricultural purpose as submitted by theml.e:a.rned\n\ncounsel for the claimant.
