The petitioner (Tritiya Verg Shaskiya Karmachari Grih<\/p>\n<p>     Nirman Sahkari Samiti Maryadit) is a society of Class-III<\/p>\n<p>     Government employees, registered under the provisions of<\/p>\n<p>     the  Chhattisgarh Cooperative Societies Act 1960.  The<\/p>\n<p>     petitioner challenges the legality and validity of the<\/p>\n<p>     order dated 23rd June, 2008, passed by the Chhattisgarh<\/p>\n<p>     Information Commission (for short &#8216;the Commission&#8217;) in<\/p>\n<p>     Appeal Case No. 175\/2008 to the extent of observation of<\/p>\n<p>     the  Commission that the provisions of  the  Right  to<\/p>\n<p>     Information Act, 2005 (for short &#8216;the Act, 2005&#8217;)  are<\/p>\n<p>     applicable to the petitioner society.\n<\/p>\n<p>  2.   The facts, in nutshell, are that the respondent No. 3<\/p>\n<p>     sought for certain information from the petitioner-Society.\n<\/p>\n<p>     The respondent  No. 3 being aggrieved by non-supply of the<\/p>\n<p>     documents by the Society preferred an appeal before the<\/p>\n<p>     Commission. The Commission, although dismissed the appeal, <\/p>\n<p>     however observed that the provisions of the Act, 2005 are<\/p>\n<p>     applicable to the petitioner-society. Thus, this petition<\/p>\n<p>     challenges the observation of the Commission to the extent<\/p>\n<p>     of &#8221; vr% bl vk\/kkj ij ;g vf\/kfu;e mDr lfefr ij ykxw gksuk<\/p>\n<p>     ekU; fd;k tkrk gS A &#8220;.\n<\/p>\n<p>3.   Shri R. S. Patel, learned counsel appearing for the<br \/>\npetitioner submits that the Commission though has dismissed<br \/>\nthe appeal but the observation, as stated above, is not<br \/>\nproper and justified. Thus this petition, stating that the<br \/>\nabove stated observation with regard to the applicability<br \/>\nof the provisions of the Act, 2005 to the petitioner-<br \/>\nsociety was made without looking into the documents asto<br \/>\nwhether the petitioner-society was obtaining any government<br \/>\naid or is a government society. Thus, the same observation<br \/>\ndeserves to the deleted\/expunged.\n<\/p>\n<p>  4.    I  have  heard  learned counsel appearing  for  the<\/p>\n<p>     petitioner and perused the documents appended thereto.\n<\/p>\n<p>  5.    It  is  well  settled that if  a  case  has  become<\/p>\n<p>     infructuous on the facts of the case and question remains<\/p>\n<p>     to be decided for academic purpose, it is not necessary to<\/p>\n<p>     examine the case. In the matter of Basheshar Nath  Vs.<\/p>\n<p>     Commissioner  of Income-tax, Delhi and  Rajasthan  and<\/p>\n<p>     another1, the Supreme Court observed as under :\n<\/p>\n<p>       &#8220;12. &#8230;We take the view that this Court should  not<br \/>\n       make any pronouncement on any question which is  not<br \/>\n       strictly   necessary  for  the   disposal   of   the<br \/>\n       particular  case  before it. We, therefore,  confine<br \/>\n       our  attention to Art. 14 and proceed to discuss the<br \/>\n       question on that footing.&#8221;\n<\/p>\n<p>  6.    In  the matter of Dhartipakar Madan Lal Agarwal Vs.<\/p>\n<p>     Rajiv Gandhi2  their Lordships observed as under :-\n<\/p>\n<p>       &#8221;   4.  &#8230;.In  this  view  grounds  raised  in  the<br \/>\n       petition  for  setting aside  the  election  of  the<br \/>\n       respondent   have  been  rendered  academic.   Court<br \/>\n       should  not undertake to decide an issue  unless  it<br \/>\n       is  a  living issue between the parties. If an issue<br \/>\n       is  purely academic in that its decision one way  or<br \/>\n       the  other  would have no impact on the position  of<br \/>\n       the  parties,  it would be waste of public  time  to<br \/>\n       engage  itself  in deciding it. Lord Viscount  Simon<br \/>\n       in  his  speech in the House of Lords  in  Sun  Life<br \/>\n       Assurance Co. of Canada v. Jarvis3 observed :  I  do<br \/>\n       not  think that it would be a proper exercise of the<br \/>\n       authority  which  this  House  possesses   to   hear<br \/>\n       appeals  if  it  occupies  time  in  this  case   in<br \/>\n       deciding  an academic question, the answer to  which<br \/>\n       cannot  affect the respondent in any way. It  is  an<br \/>\n       essential  quality of an appeal fit to  be  disposed<br \/>\n       of  by his House that there should exist between the<br \/>\n       parties to a matter in actual controversy which  the<br \/>\n       House undertakes to decide as a living issue.&#8221;\n<\/p>\n<p>  7.   In the matter of Secretary, Ministry of Information &amp;<\/p>\n<p>  Broadcasting,  Govt.  of  India and  others  Vs.  Cricket<\/p>\n<p>     Association  of Bengal and others3, the Supreme  Court<\/p>\n<p>     observed as under :-\n<\/p>\n<p>        &#8220;121.  The orders passed by the High Court have  to<br \/>\n        be  viewed  against the backdrop of the events  and<br \/>\n        the   position   of   law  discussed   above.   The<br \/>\n        circumstances  in which the High Court  passed  the<br \/>\n        orders  and  the  factual and legal  considerations<br \/>\n        which  weighed  with it in passing them  speak  for<br \/>\n        themselves.  However,  since  the  cricket  matches<br \/>\n        have  already  been telecast, the question  of  the<br \/>\n        legality  or  otherwise of the  orders  has  become<br \/>\n        academic  and it is not necessary to pronounce  our<br \/>\n        formal  verdict on the same. Hence we refrain  from<br \/>\n        doing so.&#8221;\n<\/p>\n<p>  8.    In  the  mater of State of Manipur and  others  Vs.<\/p>\n<p>     Chandam Manihar Singh4  the Supreme Court observed  as  <\/p>\n<p>     under:-\n<\/p>\n<p>       &#8220;10.  Having given our anxious consideration to  the<br \/>\n       rival  contentions, we find that as the High Court&#8217;s<br \/>\n       direction  in  favour  of  the  respondent&#8217;s  tenure<br \/>\n       which  is to expire on 15-10-1999 has almost  worked<br \/>\n       itself out and less than a month remains for him  to<br \/>\n       act  as  Chairman of the Board, the first  grievance<br \/>\n       raised  by learned Senior Counsel for the appellants<br \/>\n       in  connection with the removal of the respondent by<br \/>\n       order   dated  19-10-1998  has  become  of  academic<br \/>\n       interest.  We,  therefore, did  not  permit  learned<br \/>\n       Senior  Counsel for the appellants to  canvass  this<br \/>\n       point  any further before us. That takes us  to  the<br \/>\n       consideration of the second point.&#8221;\n<\/p>\n<p>  9.   The Hon&#8217;ble Constitution Bench of the Supreme Court in<\/p>\n<p>     the matter of Arnit Das Vs. State of Bihar5 observed as<\/p>\n<p>     under:-\n<\/p>\n<p>       &#8220;6.   It  is  settled practice that this Court  does<br \/>\n       not  decide  matters  which  are  only  of  academic<br \/>\n       interest  on  the facts of a particular  case.  (See<br \/>\n       with  advantage:  <a href=\"\/doc\/1195357\/\">Sanjeev Coke Mfg.  Co.  v.  Bharat<br \/>\n       Coking  Coal  Ltd.3, R. S. Nayak<\/a> v. <a href=\"\/doc\/1384660\/\">A.  R.  Antulay4<br \/>\n       and   Dhartipakar   Madan  Lal  Agarwal   v.   Rajiv<br \/>\n       Gandhi5.)<\/a>&#8220;.\n<\/p>\n<p>  10.  In the matter of Prakash Singh Badal and another Vs.<\/p>\n<p>     State of Punjab and others6 the Supreme Court observed as<\/p>\n<p>     under:-\n<\/p>\n<p>        &#8221;  39.      So  far as the question about the  non-<br \/>\n        application of mind in the sanction or  absence  of<br \/>\n        sanction  is  concerned, this has been answered  in<br \/>\n        the  first  question i.e. where the public  servant<br \/>\n        has  ceased  to be a public servant  since  he  has<br \/>\n        ceased   to  hold  the  office  where  the  alleged<br \/>\n        offence is supposed to have taken place, the  other<br \/>\n        questions really become academic.&#8221;\n<\/p>\n<p>  11.   The  Commission has not recorded the finding  after<\/p>\n<p>     having examined all the aspects of the matter. This is a<\/p>\n<p>     mere observation and particularly in view of the facts that<\/p>\n<p>     no relief was granted against the petitioner, the decision<\/p>\n<p>     on this issue becomes a matter of academic interest. The<\/p>\n<p>     Commission has declined to grant relief as sought for by<\/p>\n<p>     the  respondent No.3. Thus, the petitioner is  not  an<\/p>\n<p>     aggrieved party to challenge the order dated 23rd June,<\/p>\n<p>     2008, passed by the Commission.\n<\/p>\n<p>  12.  It is well settled principle of law that the question<\/p>\n<p>     of law on academic interest cannot be adjudicated upon, the<\/p>\n<p>     same should be left open for adjudication, whenever the<\/p>\n<p>     appropriate facts arises. The observation made by  the<\/p>\n<p>     Commission is left open to be decided in the appropriate<\/p>\n<p>     facts  of  the case. The observation, which  is  under<\/p>\n<p>     challenge, is mere obiter and not a finding recorded by the<\/p>\n<p>     Commission, as the materials were not available before the<\/p>\n<p>     Commission  to record any finding with regard  to  the<\/p>\n<p>     applicability of the provisions.\n<\/p>\n<p>  13.  Applying the above stated well settled principles of<\/p>\n<p>     law, this petition has no merit.
