Mr ND Gohil learned APP waives   service   of<br \/>\n     rule.\n<\/p>\n<p>     It is not in dispute that the petitioner is<br \/>\n     suffering from Kidney problem and at present he is under<br \/>\n     the treatment of Dr VK Subramaniam of Mumbai.         The<br \/>\n     petitioner has been released on temporary bail right from<br \/>\n     the year 1994 on various occassions. The last order was<br \/>\n     passed by this Court (Coram: AR Dave, J.) on 15.1.1997<br \/>\n     in Misc. Criminal Application No.      3 of 1997 after<br \/>\n     considering   the report of the Institute of Kidney<br \/>\n     Diseases &amp; Research Centre, Civil Hospital, Ahmedabad<br \/>\n     wherein it has been stated that the institute has no<br \/>\n     facility to give the      treatment   required   by   the<br \/>\n     petitioner.   In view of this, this Court has granted<br \/>\n     temporary bail to the petitioner up to         15.4.1997.<br \/>\n     Considering the medical report of the petitioner, I am<br \/>\n     of the view that the petitioner is entitled to be<br \/>\n     released on regular bail. In view of this, the present<br \/>\n     application is allowed. The petitioner is ordered to be<br \/>\n     released on bail on his executing a bond of Rs 10,000\/<br \/>\n (Rs. Ten Thousand only) with one surety in the like<br \/>\namount to the satisfaction of the lower court and subject<br \/>\nto the conditions that he shall;\n<\/p>\n<p>(a) not take undue advantage of his liberty or misuse<br \/>\n        his liberty;\n<\/p>\n<p>(b) not act in a manner injurious to the interest        of<br \/>\n        the prosecution;\n<\/p>\n<p>(c) maintain law and order;\n<\/p>\n<p>(d) will not enter Rajkot taluka;\n<\/p>\n<p>(e) mark his presence before nearest Police Station<br \/>\n        where he is going to reside on every 1st day of<br \/>\n        the month anytime between 9.00 A.M.      and 5.00<br \/>\n        P.M.   In case the petitioner is required to go<br \/>\n        out for treatment, in that event, he will obtain<br \/>\n        necessary permission from the learned Sessions<br \/>\n        Judge, Rajkot and only for that purpose, he is<br \/>\n        entitled to enter the Rajkot Taluka and will give<br \/>\n        all the details like address where he is going to<br \/>\n        reside including the address of the hospital<br \/>\n        where he is to be admitted and\/or to take the<br \/>\n        treatement. The petitioner will show the medical<br \/>\n        certificate of the treatment he is to take from<br \/>\n        the concerned Doctor to the learned Sessions<br \/>\n        Judge, Rajkot at the end of every month.\n<\/p>\n<p>(f) furnish the address of his residence at the time<br \/>\n        of execution of the bond and shall not change his<br \/>\n        residence without prior permission of the learned<br \/>\n        Sessions Judge, Rajkot;\n<\/p>\n<p>3.If breach of any of the above conditions is<br \/>\ncommitted, the Sessions Judge at Rajkot will be free to<br \/>\nissue warrant or take appropriate action in the matter.\n<\/p>\n<p>4.Bail before the lower Court    having    jurisdiction<br \/>\nto try the case.\n<\/p>\n<p>Rule is    made     absolute.
