Thereafter, he tried to secure some amount from his relatives<br \/>\n\tand from other sources, but he failed and ultimately he approached<br \/>\n\tthe Legal Aid Committee of this Court to assist him by engaging an<br \/>\n\tadvocate from Legal Aid Committee and the Legal Aid Committee has<br \/>\n\tengaged an advocate, who has drafted the appeal and filed the same<br \/>\n\tand for that considerable time has been consumed. Therefore, delay<br \/>\n\tof 243 days has caused in filing the appeal. It is, therefore,<br \/>\n\tprayed that the delay may be condoned. It is also pleaded that there<br \/>\n\twas sufficient cause which prevented the applicant in filing appeal<br \/>\n\tin time.\n<\/p>\n<p>Having<br \/>\n\tconsidered the submissions advanced by Ms.Sudha C.Shukla, learned<br \/>\n\tadvocate for the applicant and Mr.L.B.Dabhi, learned APP for the<br \/>\n\trespondent &#8211; State of Gujarat and perusal of the averments<br \/>\n\tmade in the application, which have remained uncontroverted and the<br \/>\n\tcelebrated principles governing the discretionary exercise of power<br \/>\n\tconferred under Section 5 of the Act, so as the reported decisions<br \/>\n\tof the Hon&#8217;ble Supreme Court construing Section 5 of the Act<br \/>\n\tliberally, we are of the considered opinion that the delay caused<br \/>\n\thas been aptly, elaborately and sufficiently explained by the<br \/>\n\tapplicant. The record does not indicate that there was any inaction<br \/>\n\tor negligence on the part of the applicant in prosecuting the<br \/>\n\tappeal. The applicant has never abandoned the lis. The explanation<br \/>\n\toffered by the applicant for condonation of delay is not only<br \/>\n\tplausible, but acceptable.\n<\/p>\n<p>In<br \/>\n\tview of the aforesaid, according to us, this application deserves to<br \/>\n\tbe allowed by condoning the delay as prayed for.\n<\/p>\n<p>For<br \/>\n\tthe foregoing reasons, the application succeeds and accordingly it<br \/>\n\tis allowed. Delay of 243 days in filing the above proceedings is<br \/>\n\tcondoned.
