KHARE\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t      J U D G M E N T<br \/>\nNANAVATI. J.\n<\/p>\n<p>     Even though  in the  Cause Title  of  the\tAppeal\tfive<br \/>\npersons are shown as respondents, it has to be treated as an<br \/>\nappeal against\tthree respondents  only, as  the  respondent<br \/>\nNos. 2\tand 3  had died\t during the  pendency of  the appeal<br \/>\nbefore the High Court.\n<\/p>\n<p>     The three\trespondents were  tried along  with  Jagdish<br \/>\nSingh and  Jay Narayan\tfor the\t offences  punishable  under<br \/>\nSections 148 and 302 IPC for causing death of Ram Bharose on<br \/>\n16.2.1982  at  11.00  a.m.  The\t trial\tcourt  believed\t the<br \/>\nevidence of P.W. 4 Rewa who was with Ram Bharose at the time<br \/>\nof the\tincident and  also of  P.W. 3 Ram Avtar who had seen<br \/>\nthe incident while standing near the house of Kishan Lal and<br \/>\nconvicted all  the five\t accused under\tSection 148  and 302<br \/>\nIPC. All  the five  convicted accused filed an appeal before<br \/>\nthe High  Court. Accused Jay Narayan and Jagdish died during<br \/>\nthe pendency  of the  appeal and,  therefore,  their  appeal<br \/>\nabated. The  High Court on reappreciation of the evidence of<br \/>\nP.W. 3\tRam Avtar  and P.W.  4 Rewa  Ram held that they were<br \/>\npresent at  the time of the occurrence and could be accepted<br \/>\nas truthful  witnesses. The  High Court,  therefore,  relied<br \/>\nupon their  evidence and held that the accused had assaulted<br \/>\nRam Bharose  High Court,  however,  did\t not  confirm  their<br \/>\nconviction under  Section 302  IPC for the reason that there<br \/>\nwas no charge against them that the death of Ram Bharose was<br \/>\ncause, in  furtherance of  the common object of the unlawful<br \/>\nassembly of  which they\t were the  members. The\t High Court,<br \/>\ntherefore, held\t that they  could be held quality only under<br \/>\nSection 326  IPC   common object  was to assault Ram Bharose<br \/>\nand commit rioting with deadly weapons.\n<\/p>\n<p>     We have also gone through the evidence of P.W. 3 and 4.<br \/>\nFrom their  evidence it\t is not\t possible to say which fatal<br \/>\ninjury was  caused by  which accuse.  The two witnesses have<br \/>\nspecifically referred to only about 8 to 10 injuries whereas<br \/>\non the\tperson of  Ram Bharose\tas many\t as 51 injuries were<br \/>\nfound. As  it was  not possible\t to hold  who had caused the<br \/>\nfatal  injury  to  the\tdeceased,  the\tHigh  Court  rightly<br \/>\nconvicted them under Section 326 IPC.\n<\/p>\n<p>     As we  do not  find any substance in this appeal, it is<br \/>\ndismissed.
