Civil Application (Stamp) No. 2279 of<br \/>\n2010 in Second Appeal No. 80 of 1990 on the grounds stated in this<br \/>\napplication. However, the learned Advocate Mr. Mishra for the<br \/>\nopponents has raised an objection that Regular Civil Suit No. 13 of<br \/>\n2009 is also filed before the District Court, Ahmedabad (Rural).<br \/>\nTherefore, learned Advocate Mr. Dastoor has submitted an undertaking<br \/>\nof the applicants stating therein that the suit will be withdrawn<br \/>\nwithin a week. In view of the undertaking, present Civil Application<br \/>\nfor condonation of delay under Section 5 of the Limitation Act is<br \/>\nrequired to be considered.\n<\/p>\n<p>2.\tHaving<br \/>\nheard the learned Advocates for the parties and also considering the<br \/>\nguidelines with regard to the condonation of delay under Section 5 of<br \/>\nthe Limitation Act and also the judgments of the Hon&#8217;ble Apex Court<br \/>\ni.e. (i)<br \/>\n<a href=\"\/doc\/509361\/\">Oriental<br \/>\nAroma Chemical Industries Ltd., v. Gujarat Industrial Development<br \/>\nCorporation &amp; Anr.,<\/a> (2010)5 SCC 459,\n<\/p>\n<p>(ii) <a href=\"\/doc\/644440\/\">State<br \/>\nof Bihar &amp; others v. Kamleshwar Prasad Singh &amp;<\/a> another, AIR<br \/>\n2000 SC 2306<br \/>\n(paras 11 to 14 of the reported judgment) and (iii) <a href=\"\/doc\/1240908\/\">N.<br \/>\nBalakrishnan v. M. Krishnamurthy, Judgment Today,<\/a> 1998 (6) SC 242,<br \/>\npresent<br \/>\napplication deserves to be allowed condoning the delay of 1847 days.<br \/>\nAccordingly the present<br \/>\napplication is allowed.\n<\/p>\n<p>Rule made absolute<br \/>\naccordingly.
