This
\n\tApplication is filed by the applicant under Section 438 Cr. P.C. in
\n\tconnection with CR No. I   6 of 2004, registered with ACB Police
\n\tStation, Bhuj, District : Kutch for the offences under Section
\n\t120-B, 406, 409, 420, 455, 468, 471, 34, 114 and 201 of the Indian
\n\tPenal Code and Sections 7, 12, 13(1)(c)(d) and Section 13(2) of the
\n\tPrevention of Corruption Act.\n<\/p>\n
Heard
\n\tlearned Counsel for the parties and perused the papers produced
\n\tbefore me.\n<\/p>\n
Learned
\n\tSenior Counsel Mr. Yogesh Lakhani has contended that the applicant
\n\thas been wrongly implicated in the commission of the offence. He is
\n\tan innocent person. Even the ingredients of the offence are not
\n\tsatisfied. Learned Senior Counsel submitted that from the papers
\n\titself, show that the lignite, which was sold and purchased to
\n\tlicencee. For the date of the FIR and investigation time, the ACB is
\n\tunable to file charge-sheet. Even the officer has never bothered to
\n\tfind out the accused. There is no any prima facie case made out
\n\tagainst the applicant. He further submitted that the Sales Tax
\n\titself makes clear for penalty and prosecution for evasion of sale
\n\ttax. In view of the aforesaid submissions, he prayed to grant
\n\tanticipatory bail to the applicant.\n<\/p>\n
Learned
\n\tAPP Mr. Jani has vehemently opposed this application and he has read
\n\tallegation contained in the FIR at Pages 21, Para 11 and forcefully
\n\tsubmitted that this is a clear cut prima facie case against the
\n\tapplicant and therefore, discretion may not be exercised in favour
\n\tof the applicant.\n<\/p>\n
Having
\n\theard the learned Counsel for the parties and perused the record and
\n\tconsidered the arguments advanced by the learned Counsel for the
\n\tparties. Even the case diary was called for, which is produced
\n\tbefore me and I have verified the same. It appears from the case
\n\tdiary that the Investigating Officer has never bothered to find out
\n\tthe accused for a period of more than 6 years. The Investigating
\n\tOfficer has also never bothered to follow the procedure of the Code
\n\tof Criminal Procedure and it appears that the Investigating officer
\n\thas totally negligent and due to negligence on the part of the
\n\tInvestigating Officer, the bail cannot be refused. Therefore, I am
\n\tof the opinion that this is a fit case to grant anticipatory bail to
\n\tthe applicant.\n<\/p>\n
In
\n\tthe result, this Application is allowed by directing that in the
\n\tevent of arrest of the applicant herein pursuant to CR No. I   6
\n\tof 2004 registered with ACB Police Station, Bhuj, District : Kutch,
\n\tthe applicant shall be released on Bail on his furnishing a Bond of
\n\tRs.10,000\/- (Rupees ten thousand only) with one surety of like
\n\tamount on condition that –\n<\/p>\n
a)\the
\nshall co-operate with the investigation and make himself available
\nwhenever required;\n<\/p>\n
b)\the
\nshall remain present before the concerned Police Station, on 30th
\nAugust, 2010 at 11.00 am sharp.\n<\/p>\n
c)\the
\nshall not hamper the investigation in any manner nor shall directly
\nor indirectly make any inducement, threat or promise to any witness
\nso as to dissuade him for disclosing such facts to the Court or to
\nany Police Officer;\n<\/p>\n
d)\tAt
\nthe time of execution of Bond, they shall furnish his address to the
\nI.O. and the Court concerned and shall not change the residence till
\nthe final disposal of the case or till further orders;\n<\/p>\n
e)\tthat
\nhe will not leave India without the permission of the Court and, if
\nthey are holding a Passport, surrender the same before the trial
\nCourt immediately;\n<\/p>\n
f)\tIt
\nwould be open to the Investigating Officer to file an application for
\nremand, if he considers it just and proper and the concerned
\nMagistrate would decide it on merits;\n<\/p>\n
g)\tthis
\norder will be operative if the applicant is arrested at any time
\nwithin a period of 90 days;\n<\/p>\n
h)\twithin
\na period of ten days from the date of arrest, the applicant shall
\napply for regular bail which application shall be decided by the
\ncompetent Court in accordance with law without being influenced by
\nthe fact that anticipatory bail was granted.\n<\/p>\n
8.\tWith
\nthese directions, this Criminal Miscellaneous Application is disposed
\nof. Rule is made absolute. Direct service permitted.\n<\/p>\n
