BASANT, J.\n                  - - - - - - - - - - - - - - - - - - - - - -\n                    Crl.M.C.No. 361 of 2009\n                  - - - - - - - - - - - - - - - - - - - - - -\n             Dated this the 30th day of January, 2009\n\n                               O R D E R\n<\/pre>\n<p>      The petitioners face indictment in a prosecution under<\/p>\n<p>Section 498A I.P.C. Cognizance was taken on the basis of a<\/p>\n<p>final report submitted by the police after due investigation in a<\/p>\n<p>crime. That crime in turn was registered on the basis of a private<\/p>\n<p>complaint filed by the second respondent before the learned<\/p>\n<p>Magistrate and forwarded by the learned Magistrate to the police<\/p>\n<p>under Section 156(3) Cr.P.C. Investigation is complete.          Trial<\/p>\n<p>has not commenced.           The petitioners are the husband and<\/p>\n<p>relatives of the defacto complainant, who is arrayed as the second<\/p>\n<p>respondent in this petition.\n<\/p>\n<p>      2.   The petitioners and the second respondent have now<\/p>\n<p>come before this Court to apprise this Court of the fact that the<\/p>\n<p>parties have settled all their outstanding disputes and the second<\/p>\n<p>respondent has compounded the offences allegedly committed by<\/p>\n<p>the petitioners.   The first petitioner and the second respondent<\/p>\n<p>Crl.M.C.No. 361 of 2009<br \/>\n<span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>have now decided harmoniously to terminate the marital tie in<\/p>\n<p>accordance with law.\n<\/p>\n<p>      3. Notice was given to the learned Prosecutor, who does not<\/p>\n<p>oppose the application. The second respondent has entered appearance<\/p>\n<p>through counsel and has filed an affidavit duly attested by the counsel<\/p>\n<p>to confirm such settlement\/composition.<\/p>\n<p>      5. Learned counsel for the petitioners and the second respondent<\/p>\n<p>pray, the learned Prosecutor does not oppose the said prayer and I am<\/p>\n<p>satisfied that the extra ordinary inherent jurisdiction as enabled by the<\/p>\n<p>dictum in    B.S. Joshi v. State of Haryana (AIR 2003 SC 1386)<\/p>\n<p>can safely be invoked to bring to premature termination the<\/p>\n<p>unnecessary, irrelevant and superfluous prosecution surviving against<\/p>\n<p>the petitioners.\n<\/p>\n<p>      6. In the result:\n<\/p>\n<p>      a) This Crl.M.C. is hence allowed.\n<\/p>\n<p>      b) C.C.671 of 2008 pending before the J.F.M.C.-II, Hosdurg, in<\/p>\n<p>which the petitioners are the accused and the second respondent, the<\/p>\n<p>defacto complainant, is hereby quashed.<\/p>\n<p>Crl.M.C.No. 361 of 2009<br \/>\n<span class=\"hidden_text\">                                   3<\/span><\/p>\n<p>      c) Needless to say, proceedings under Section 446 Cr.P.C., if<\/p>\n<p>any, pending against the petitioners and their sureties shall be disposed<\/p>\n<p>of in accordance with law.\n<\/p>\n<\/p>\n<p>                                             (R.
