Mrs.Krina P.Calla, learned Assistant<br \/>\nGovernment Pleader, waives service of Rule on behalf of respondent<br \/>\nNo.2.  Learned advocate Mrs.Ketty A.Mehta waives service of Rule on<br \/>\nbehalf of respondent No.8.  Looking to the controversy involved in<br \/>\nthe matter, the learned advocate for the petitioner submitted that<br \/>\nthe rest of the respondents are not the contesting respondents.\n<\/p>\n<p>2.\tHeard<br \/>\nthe learned advocates for respective parties.\n<\/p>\n<p>3.\tThe<br \/>\npresent petition is filed challenging a communication dated<br \/>\n19.07.2007 addressed to the President\/Secretary of Jagannath Nagar<br \/>\nCooperative Housing Society (proposed) by the Executive Engineer,<br \/>\nDrainage Department, Surat Municipal Corporation.\n<\/p>\n<p>\tThe<br \/>\ncontents of the letter are that, &#8216;as there is a Court matter pending<br \/>\nrelated to revenue survey No.121 of village Bamroli, on which the<br \/>\naforesaid Jagannath Nagar Cooperative Housing Society is situated,<br \/>\nwherein the Surat Municipal Corporation is also joined as party,<br \/>\n there is an opinion of a panel advocate that without obtaining<br \/>\nconsent of the land owner, no primary facilities\/civic amenities can<br \/>\nbe granted by the Surat Municipal Corporation&#8217;.<br \/>\n The letter finally states that, &#8216;the work of laying down the<br \/>\ndrainage line in Jagannath Nagar Cooperative Housing Society cannot<br \/>\nbe undertaken&#8217;.\n<\/p>\n<p>4.\tMr.Trivedi, learned<br \/>\nadvocate for the petitioners submitted that the petitioners are<br \/>\nresiding at the aforesaid place for last about more than 15 years.<br \/>\nMrs.Ketty Mehta, learned advocate for respondent No.8 controverts the<br \/>\nstatement.\n<\/p>\n<p>\tBe that as it may,<br \/>\nthe fact remains that there are number of persons who are residing at<br \/>\nthe aforesaid place, may be for last couple of years and not more<br \/>\nthan 15 years.  The letter under challenge dated 19.07.2007 is<br \/>\nuntenable in law and the same is quashed and set aside.\n<\/p>\n<p>5.\tMrs.Kettty Mehta,<br \/>\nlearned advocate for respondent No.8 vehemently contended that the<br \/>\nCorporation cannot undertake the work of laying down sewage line or<br \/>\nproviding civic amenities without the consent of the owner.\n<\/p>\n<p>\tIt will be<br \/>\nappropriate to note that when inquired from the learned advocate as<br \/>\nto whether respondent No.8 has taken any steps to establish his<br \/>\nownership against the present petitioners, the  answer is in<br \/>\nnegative.\n<\/p>\n<p>5.\tAt the request of<br \/>\nMrs.Ketty Mehta, learned advocate for respondent No.8, it is<br \/>\nclarified that grant of any civic amenities will not tilt the balance<br \/>\nin the matter of claim of the ownership by respondent No.8.  At her<br \/>\nrequest, it is further clarified that the work of laying down<br \/>\ndrainage line\/providing civic amenities to the petitioners will be at<br \/>\ntheir own costs and the owner of the land will not be held<br \/>\nresponsible for the cost of such amenities being provided.\n<\/p>\n<p>6.\tOn the last<br \/>\noccasion, Mr.Desai, learned advocate for respondent No.1 Corporation<br \/>\nhad apprised the Court that the work of laying down sewage line is to<br \/>\ntake about 3 months.  The learned advocate submitted that the said<br \/>\nwork is not in progress on account of monsoon season.\n<\/p>\n<p>7.\tToday, on<br \/>\ninstructions, learned advocate Mr.Desai states before this Court that<br \/>\nas soon as the monsoon season is over, i.e. latest by 30.09.2008, the<br \/>\nCorporation will undertake the work of laying down the sewage line<br \/>\nand will complete the same as expeditiously as possible and<br \/>\npreferably by 31.12.2008.\n<\/p>\n<p>\tIt is once again<br \/>\nreiterated that this order will not affect the ownership rights of<br \/>\neither party in any manner.\n<\/p>\n<p>8.\tThe petitions are<br \/>\ndisposed of with the aforesaid directions.
