No.55\/99 and acquit the\n'\u00ab*petitioners.\n\nThis Crl.R.P. coming on for Finai Hearing this\nday, the court made the following:\n\n\n\n2 Crl.RP 487\/O5\nORDER\n<\/pre>\n<p>The petitioners have challenged their<br \/>\nconviction and sentence for the offence punishable<br \/>\nunder Sections 392 and 394 lPC., on a trial held by<br \/>\nthe JMFC., Sira and confirmed in the appeal hetore_<\/p>\n<p>the Sessions Judge, Tumkur.\n<\/p>\n<p>2. The facts relevant tor ph\u00a7i\u00a7u;\u00a7\u00a2s\u00e9&#8221;o: this<br \/>\nrevision are as under: &#8216; i<\/p>\n<p>I will be referring the parties as per their<br \/>\nrank before the Trig; Court&#8217; tog. the Mpurpose of<\/p>\n<p>conveniences d&#8221;\n<\/p>\n<p>The petitioners_herein are the accused 1 and 2<\/p>\n<p>before&#8221; the &#8216;aria: Court. P.Ws.l and 2 are the<\/p>\n<p>&#8216;spouses and were under employment of P.W.4. They<\/p>\n<p>Kwere &#8220;iaogi\ufb01g, after the land of P.W.4 and were<\/p>\n<p>residing inCa room, wherein an eiectric motor was<\/p>\n<p>i&#8217;~pdinstalied. On 11.07.1996, they were sleeping in the<\/p>\n<p>*\ufb01aid room by just closing the door without latching<\/p>\n<p>&#8216;o,&#8221; and there were electric lights inside and. outside<\/p>\n<p>drthe room. At about 1.00 a.m., the accused knocked<\/p>\n<p>st<\/p>\n<p>and by pushing the door entered the room. The i<\/p>\n<p>accused asked the complainant to give the valua\ufb01\ufb01\u00e9\ufb01ww<\/p>\n<p>3 Crl.RP 487\/O5<\/p>\n<p>kept in the room and the 2&#8243; accused took the metal<\/p>\n<p>box [trunk] containing some amount and while going<\/p>\n<p>out, he snatched the ear rings of POWA2 and caused_<\/p>\n<p>injury and her ear lobes were torn. \u00bbw1n the metalu<\/p>\n<p>box, the complainant had :kepti:.an leamountiaiof<\/p>\n<p>Rs.l,OO0&#8211;0O and there were old ear rings and clethes*s<\/p>\n<p>in the said box. Totally&#8217;: 1\u00a7&gt;&#8221;&#8216;:~m\u00ab&gt;:i5ierty lv\u00a77OV.5&#8243;1Vi&#8217;}&#8217;i~xv&#8217;:Rs:&#8217;.\u00a72,Ht3GOw-O0<br \/>\nwas robbed by the accused ineluding the amount of<br \/>\nRs.l,OOOmOO kept in in these<br \/>\ncircumstances? \u00abthat ithedicomblainant iaccompanied by<br \/>\nP.W.2 i.e.g&#8221;hiSmwi\ufb01estafterCyisiting the hospital<br \/>\napproached _ *\u00a7ih}\ufb01eStatioh&#8221;~ \u00abdouse Officer of<br \/>\nKallambiella&#8217;  and submitted his<\/p>\n<p>complaint-Ex;Pl,d_\ufb01hich\ufb02=came to be registered in<\/p>\n<p>_ Crime No;79\/l\u00a796 under Section 384 IPC and sent the<\/p>\n<p>Vb,eomplainttEx}Pl and the FER to the Magistrate. He<\/p>\n<p>visited the scene of occurrence and in the presence<\/p>\n<p>dd of the attesting witnesses held the spot Hmhazarm<\/p>\n<p>&#8220;sffgExtP2 and seized the metal box [trunkj and the towel<\/p>\n<p>&amp;&#8217;=trom_the said place. On i3.G7.l996 the accused were<\/p>\n<p>R*,broduced before him and he recorded their voluntary<\/p>\n<p>&#8216;&#8221;.u_statement. The 1&#8243; accused &#8216;volunteered tx&gt; produce<\/p>\n<p>the ear~rings kept in the metal box and he led the<\/p>\n<p>Police and the attesting witnesses to his house and<\/p>\n<p>4 Crl.RP 487\/O5<\/p>\n<p>produced M.O.2eearerings from the metal box. He<br \/>\nseized them under mahazar~Ex.P5. Exs.P6 and 7 are<\/p>\n<p>the voluntary statements of the accused recorded by<\/p>\n<p>P.W.9. P.W.8 continued the investigation&#8217; and<br \/>\nsecured the injury certificate&#8211;ExiP3_ land ireni%<\/p>\n<p>completion of the investigation &#8216;filed$.the_ charge<\/p>\n<p>sheet against the accused.&#8217;<\/p>\n<p>During the trial, the .prosecution ,examined<\/p>\n<p>P.Ws.1 to E9 and in their evidence got H\u00e9rked the<\/p>\n<p>documents Exs.P1 to ill andQ&#8217;M,\u00a9s}i rand 2. The<\/p>\n<p>Section 313 \u20ac%%PJ&amp;\u00a3&#8217; They have taken the defence of<\/p>\n<p>total denial and have not led any defence evidence.<\/p>\n<p>_Qn appreciation of the material on record, the<\/p>\n<p>.7, trial Court kconvicted. the accused. for the offence<\/p>\n<p>pu;1ii&#8217;shi\u00a7LvJf&#8217;e..,,V_ under Sections 392 and 394 IPC&#8217; and<\/p>\n<p>V ordered &#8220;to? undergo rigorous imprisonment for a<\/p>\n<p>&#8216;&#8221;;period of 3 years for each of the offences and to<\/p>\n<p>\u00b0_pay. the fine and to undergo default sentence.<\/p>\n<p>i&#8221;wuAggrieved by the conviction and sentence, the<\/p>\n<p>{accused has approached the Sessions Court in<\/p>\n<p>Criminal Appeal No.55\/1999 and the said appeal came<\/p>\n<p>to be heard and dismissed on merits. Aggrieved by<\/p>\n<p>5 Crl.RP 487\/O5<\/p>\n<p>the concurrent findings of conviction and sentence,<br \/>\nthe petitioners have approached this Conrttain<\/p>\n<p>revision.\n<\/p>\n<p>3. I have heard the learned cpunsel for the<\/p>\n<p>petitioners as also the learnedKGovernmen\ufb01.pleader\ufb01*<\/p>\n<p>4. The point that arises for my consideration<\/p>\n<p>is;\n<\/p>\n<p>Whether the Jndgment and \ufb01rder of<br \/>\nconviction gof the &#8220;petitioners\/accused<br \/>\nfor th\u00e9f_io\ufb01;\u00e9n\u00a2ei*_pnnishabie under<br \/>\nSections t3\u00a7gV andiA3\u00a7smtiPC and the<br \/>\nsente\ufb01\u00a2\u00e9&lt;j:n\u00e9%\u00e9a\u00a7% as_ ordered by the<br \/>\ntrial Court and confirmed in the appeal<\/p>\n<p>is illegal and perverse?\n<\/p>\n<p>&#8220;5. Vit is the contention of the learned counsel<\/p>\n<p>for the petitioners that both P.Ws.1 and 2 are the<\/p>\n<p>employees.. of P.W.4wRamakrishna, whereas the<\/p>\n<p>f&#8217;.,petitioners\/accused, are the employees of one<\/p>\n<p>&#8216;&#8221;._Karegowda and there was enmity between both. these<\/p>\n<p>V*, employers and therefore, she contends that the<\/p>\n<p>V&#8217;*. &#8220;accused were falsely implicated in this crime. So<\/p>\n<p>also, it is her contention that except the evidence<\/p>\n<p>of P.Ws.l and 2, who are the interested witnesses,<\/p>\n<p>safe<\/p>\n<p>6 Crl.RP 487\/O5<\/p>\n<p>no material is placed on record by the prosecution<\/p>\n<p>though available to prove the guilt of the accused<\/p>\n<p>beyond reasonable doubt. Therefore, she&#8217; sub\ufb01its_<\/p>\n<p>that the conviction and sentence ordered&#8221; by theul<\/p>\n<p>trial Court and confirmed hat the jlower* appellate<\/p>\n<p>Court is illegal and perverse.\n<\/p>\n<p>Per contra, the learned Govern\ufb01ent_Pleader has<br \/>\nsupported the Judgment_ anqatdrder&#8221; of the courts<\/p>\n<p>below. ,_ gwalV<\/p>\n<p>6. 1 have scrutinized the evidence led by the<br \/>\nparties, the documentszadmitted in the evidence and<br \/>\nthe statement of the accused recorded under Section<\/p>\n<p>313 Cr.P.C,_&#8221;ErWsEi and 2 are the persons, who were<\/p>\n<p>_ in the room at the time of the incident and it is in<\/p>\n<p>lg theg evidence, of P.W.l ands also in the complaint-<\/p>\n<p>Ex Pl that there were electric lights both inside<\/p>\n<p>V and. outside&#8217; the roonu Further more, it is also<\/p>\n<p>&#8216;&#8221;;c1ear from the evidence of P.W.l that though there<\/p>\n<p>&#8216;&#8221;_was._light in the night at about 1.00 a.m., the<\/p>\n<p>vd&#8221;_accused gained entry and the 1&#8243; accused asked P.W.l<\/p>\n<p>fto show as to where are the valuables and he took<\/p>\n<p>the metals box containing&#8221; an amount of Rs.l,OOO&#8211;OO<\/p>\n<p>and old earerings, whereas the 2&#8243;d accused snatched<\/p>\n<p>7 Cri.RP 487\/O5<\/p>\n<p>the earwrings of P.W.2 i.e., the wife of P.W.l and<br \/>\nwhile snatching the said earwrings, P.W.2 sustained<\/p>\n<p>tearing of her earwlobes and sustained Vgrieyous<\/p>\n<p>injury. The accusedo after the robbery; &#8220;left Tthe<\/p>\n<p>metal box {trunk} and took away the rameunt tofu&#8217;<\/p>\n<p>Rs.1,0GO~O0 in addition to the <\/p>\n<p>were kept in the metal box and also the egfcfingg sf;<\/p>\n<p>P.W.2 worth more than RsgdySOOwOQi&#8221;idCluding thei<\/p>\n<p>clothes. So far as the identity of these accused<br \/>\nare concerned, P.Ws.l and 2 have named each of the<\/p>\n<p>accused. and ass the jincidentaftook1\u00abplace where the<\/p>\n<p>electric &#8212;- ~lidht Kwas *hurning\u00a2i the complainant P.W.l<br \/>\nand his wife ?;w}2 had ample opportunity to witness<\/p>\n<p>the accused&#8221; and rthe\u00a7= have identified the said<\/p>\n<p>_ accused &#8220;before. the VCourt as well. Even in the<\/p>\n<p>in Police Station, when the accused were arrested and<\/p>\n<p>brought} P wsyi and 2 have identified them and in<\/p>\n<p>V the circumstances, considering the evidence of these<\/p>\n<p>d&#8221;22&#8242; witnesses, I do not think that there is any<\/p>\n<p>&#8220;_difficulty insofar as the identity of the accused<\/p>\n<p>&#8220;Huare concerned.\n<\/p>\n<p>7. The acts of the accused have been spoken by<\/p>\n<p>P.Ws.l and 2. Accused No.1 went inside, questioned<\/p>\n<p>8 Crl.RP 487\/O5<\/p>\n<p>P.W.l as to the valuables and thereafter, he took<br \/>\nthe metal box [trunk] and from it he took out the<\/p>\n<p>old earerinqs, the &#8216;clothes, whereas accused_kNo.2<\/p>\n<p>snatched the ear&#8211;rings of P.W.2 i.e., the uife of<\/p>\n<p>P.W.l by causing injury and tearing her ear lobesty\u00e9<\/p>\n<p>The overtwact of each of the yaccused_Whaue_ been<\/p>\n<p>stated by P.Ws.l and 2v_andi their ,evidence &lt;isw<\/p>\n<p>consistent, cogent and acce\ufb01table.\n<\/p>\n<p>8. Further more} \u00a7.W,2u*was&#8221;aexamined by the<\/p>\n<p>doctor&#8211;P.W.6 and hey xhab ; issuedW&#8217; the injury<\/p>\n<p>certificate at }\ufb01x.P3.\u00a7 it ireyealse that P.W.2 was<\/p>\n<p>examined. on *ll5Q\u00a7\u20ac19\u00a7En at&#8211; about 9.00 a.m. and he<\/p>\n<p>states &#8216;that both Nthe Vearerings were torn. The<br \/>\ndoctor is of the opinion that the injury sustained<\/p>\n<p>i&#8221;by \u00e9jw,;_ia grievous in nature and accordingly he<\/p>\n<p>v\ufb01has kdeposed\ufb01 before the court and speaks to the<\/p>\n<p>contests &#8216;efs3Ex.P3. So, the medical evidence<\/p>\n<p>kcorroborates the evidence of P.W.2 who is an injured<\/p>\n<p>{witness and it is welleestablished principle that an<\/p>\n<p>m injured generally does not implicate an innocent and<\/p>\n<p>&#8216;kfdoes not leave a person who really has caused the<\/p>\n<p>harm. She has spoken to the overt&#8211;act of accused<\/p>\n<p>No.2 and the presence of accused No.1 and she has<\/p>\n<p><span class=\"hidden_text\">5<\/span><\/p>\n<p>9 Cri.RP 487\/05<\/p>\n<p>also identified both the accused before the Court as<br \/>\nwell in the Police Station. There was ample<br \/>\nopportunity for P.W.2 to see the accused7 and<\/p>\n<p>therefore, her evidence corroborates the version of<\/p>\n<p>P.W.l i.e-, her husband. and in the light fofn this 7\u00bb<\/p>\n<p>evidence led by the prosecution &#8216;is? sufficieht&#8217; to<\/p>\n<p>prove the guilt of the accused;f_1<\/p>\n<p>9. P.W.5 is the employer_of P:Wsli and 2 and<br \/>\nhe states about the injuries sustained by P.W.2 and<br \/>\nhaving seen her after the in\u00a2iae\ufb01t;;fse is also an<\/p>\n<p>attesting witness for the spotwmahazar&#8211;Ex.P2 along<\/p>\n<p>with P{W.4 and the seisure&#8211;of the metal box {trunk}<br \/>\nM.0.1 and the toweirM;\u00a9C1{a). P.W.7 is the resident<\/p>\n<p>of the same village and he took the injured to the<\/p>\n<p>x&#8221;hospita;_and he is also an attesting witness with<\/p>\n<p>vFregard_&#8221;tolithev recovery of the ear&#8211;rings at the<\/p>\n<p>instance of the l&#8221;&#8216;accused. The said ear&#8211;rings have<\/p>\n<p>ibeen. marked in the evidence as M.O.2 and. seizure<\/p>\n<p>Lmahazar has been produced at Ex.PS. It appears that<\/p>\n<p>&#8212; there is a mistake in numbering the material objects<\/p>\n<p>xpby the trial Court. Anyhow, the mistake committed<\/p>\n<p>by the trial Court does not come in the way of the<\/p>\n<p>prosecution as it is a minor discrepancy. P.W.9 is<\/p>\n<p>10 Crl.RP 487\/O5<\/p>\n<p>the Police Officer, who registered the complaint of<br \/>\nP.W.l and held the Investigation, which was<br \/>\ncompleted by P.W.8, who filed the charge sheet after<\/p>\n<p>collecting the injury certificate. SO,mdthesg Vis<\/p>\n<p>consistent material so far as the of\ufb01ence &#8216;under&#8217;<\/p>\n<p>Section 394 IPC is concerned. &#8221;\n<\/p>\n<p>10. It is necessary to note that the accused<\/p>\n<p>caused injury to P.W.2 while snatching the ear\u00a5rings<\/p>\n<p>and that has been stated b\u00a7&#8221;doctor~P)W,6; who has<br \/>\nissued the injury certificate%E\u00a7\ufb02P3iz_Therefore, the<\/p>\n<p>accused have committ\u00e9i an offence punishable under<\/p>\n<p>Section 394 EEC \ufb02 which is an act of robbery and at<br \/>\nthat time grievous injury was caused to P.W.2. It<\/p>\n<p>is in. the mcontextilof&#8221; these circumstances, if the<\/p>\n<p>3&#8243;.,Qff\u00e9:n!E:e3y&#8221;..,1{{1I&#8217;1CiE!f Sec&#8221;t&#8217;i&#8217;oVn 392 IPC is considered, it is a<\/p>\n<p>&#8216;tminorx offence}. whereas Section 394 IPC is major<\/p>\n<p>offence. &#8216;B when there is a punishment for major<\/p>\n<p>woffence and the ingredients of Section 392 ZPC do<\/p>\n<p>{merge with the offence under Section 394 IPC., the<\/p>\n<p>&#8216; conviction for the offence under Section 392 IPC is<\/p>\n<p>&#8220;a redundant. The ample material placed on record is<\/p>\n<p>sufficient to hold the accused guilty for the<\/p>\n<p>offence under Section 394 IPC. The mere existence<\/p>\n<p>11 Crl.RP 487\/05<\/p>\n<p>of some enmity between P.W.\u00a7 and the employer of the<br \/>\naccused does not take away the evidence led by the<br \/>\nprosecution, which has been supported by P.Wi2, who<br \/>\nis an injured witness. The material placed&#8217; on<br \/>\nrecord is consistent, cogent, natural and there is,<br \/>\nno much delay in lodging the _complaint5 &#8220;ins thel<br \/>\ncircumstances, I am of the fopinion jtha\ufb01w the<br \/>\npetitioner has not made&#8221; out anyf such ogrounds top<br \/>\nwarrant the interference to the extent of the proof<br \/>\nof offence punishable under Section 394 lPC. The<br \/>\naccused. will have to _be_ acguittedf for the charge<\/p>\n<p>under soction.392gIPC,=n<br \/>\nlf, rso far as the sentence is concerned, the<br \/>\nlearned cbunsel for the petitioners submit that the<\/p>\n<p>accused 2are &#8220;aged vabout 40 years and 22 years<\/p>\n<p>7_ respecti\ufb01elyrv they are married persots and<\/p>\n<p>maintaining Stheir family. They are the only<\/p>\n<p>persons5&#8243;wno are looking after the members of their<\/p>\n<p>&#8220;knfamily and that it is their first offence and in the<\/p>\n<p>&#8220;u circumstances, she submits that these mitigating<\/p>\n<p><span class=\"hidden_text\">1<\/span><\/p>\n<p>&#8220;&#8216;,circumstances may oe considered to reduce the<\/p>\n<p>lsentence. So, taking into consideration the<\/p>\n<p>submission made, I think it would be just and proper<\/p>\n<p>12 Crl.RP 487\/O5<br \/>\nto reduce the sentence to 2% years. Hence, I answer<br \/>\nthe point partly in affirmative and partly in<\/p>\n<p>negative and proceed to pass the following:<br \/>\nORDER<\/p>\n<p>The petition is allowed in parts a iihe<\/p>\n<p>conviction and. sentence of rim: petitionersfaccusedu\u00b0<\/p>\n<p>for the offence under Section 392 his &#8216;set,xaside.<\/p>\n<p>Their conviction for the offence under Section 394:<\/p>\n<p>is affirmed by modifyin\u00a7*. the __5eat\u00e9h\u00a2e. The<\/p>\n<p>petitioners\/accused.a:e ordered to undergo rigorous<\/p>\n<p>imprisonment&#8221; for%j2%&#8217; years&#8221; and. to pay the fine as<br \/>\nordered by the triaia\ufb01curt, failing which have to<\/p>\n<p>undergo default _sentence. Their bail bonds stand<\/p>\n<p>__ canc\u00e9iied.
