Katihar Town, District Katihar.\n                                                                            ---------- Petitioner\n                                         Versus\n             The State of Bihar.\n                                                                       -------- Opposite Party\n                                       -----------\n<\/pre>\n<p>05\/-   18\/08\/2011                        Since both these applications arising out of one<\/p>\n<p>                          common case are heard together and being disposed of by this<\/p>\n<p>                          composite order.\n<\/p>\n<p>                                         Heard learned counsel for the petitioners and<\/p>\n<p>                          learned Additional Public Prosecutor for the State, who is armed<\/p>\n<p>                          with carbon copy of the case diary.\n<\/p>\n<p>                                         Both the petitioners apprehend their arrest, in<\/p>\n<p>                          connection with Katihar Town P.S. Case No. 16 of 2008 for the<\/p>\n<p>                          offences punishable under Sections 406, 409, 467, 468, 120 B of<\/p>\n<p>                          the Indian Penal Code, are named accused in this case being<\/p>\n<p>                          office bearers of Central Bank Karamchari Credit Society<\/p>\n<p>                          Limited, Katihar for relevant periods in different terms with<\/p>\n<p>                          allegation of causing defalcation and not properly maintaining<\/p>\n<p>                          account etc.<\/p>\n<p>                                         Submission is that only against petitioner, namely,<\/p>\n<p>                          Ram Bilash Bishwakarma, there is specific allegation of taking<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>            Rs. 25,000\/- for purchase of a land. There is no allegation against<\/p>\n<p>            co-petitioner, namely, Krishna Kumar Lal. The investigation is<\/p>\n<p>            still going on.\n<\/p>\n<p>                              Considering the facts and circumstances of the<\/p>\n<p>            case, till submission of the charge-sheet\/conclusion of the<\/p>\n<p>            investigation, in the event of their arrest\/surrender before the<\/p>\n<p>            court below within four weeks, let the above named petitioners be<\/p>\n<p>            enlarged on bail on furnishing bail-bond of Rs. 10,000\/- (ten<\/p>\n<p>            thousand only) each with two sureties of the like amount each to<\/p>\n<p>            the satisfaction of Chief Judicial Magistrate, Katihar, in<\/p>\n<p>            connection with Katihar P.S.
