Pursuant to the said<br \/>\n\tadvertisement, the petitioner had applied  and he has appeared<br \/>\n\tbefore the selection committee on 24.2.2008.\n<\/p>\n<p>2.2<br \/>\n\t\tThe petitioner was selected and was placed at the Sr. no. 5 in the<br \/>\n\tselection list and ultimately he was selected.\n<\/p>\n<p>2.3\tThe<br \/>\n\tservices of the petitioner came to be terminated by order dated<br \/>\n\t26.8.2009. The petitioner made several representations, but no reply<br \/>\n\twas given. Hence this petition.\n<\/p>\n<p>\t\tHeard learned advocates for<br \/>\n\tthe respective parties and perused the documents on record.\n<\/p>\n<p>\t\tThe respondent had filed<br \/>\n\treply to the petition . In paras 6 and 7 it is stated as under:\n<\/p>\n<p>\t 6. \tI say and submit that<br \/>\n\tthe post of Assistant Manager is an important post of middle level<br \/>\n\tmanagement and is an important post in the organization of the<br \/>\n\trespondent corporation and therefore  the assistant manager is not<br \/>\n\tappointed for a particular department but has to perform work as<br \/>\n\tassistant  manager in different department as per the exigencies. I<br \/>\n\tsay and submit that the applications filed by the petitioner after<br \/>\n\tcompletion of his contract dated 7.9.2009 and 8.10.2009 have been<br \/>\n\tduly considered by the highest authority of the corporation.\n<\/p>\n<p>\t7. \tI say and submit that,<br \/>\n\tearlier the post of assistant managers were directed to be filled in<br \/>\n\ton fixed pay basis on contract and accordingly as said earlier the<br \/>\n\tpetitioner was so appointed. And as per the contract which has come<br \/>\n\tto an end the petitioner has been relieved. I say  and submit that<br \/>\n\tthe respondent corporation has therefore acted in accordance in law.<br \/>\n\tIt is denied that, the order dated 26.8.2009 is arbitrary. I further<br \/>\n\t say and submit that the initial appointment  of the petitioner  on<br \/>\n\tcontract on various  conditions and on expiry of the period of<br \/>\n\tcontract  the order at ANNEXURE A is passed. I therefore say and<br \/>\n\tsubmit that no reason is necessary to be given. I say and submit<br \/>\n\tthat  the grounds raised in the petition are no germane to the<br \/>\n\tcondition and contract of service and is not applicable in case of<br \/>\n\tthe present petitioner and hence the same are hereby denied and not<br \/>\n\tadmitted.\n<\/p>\n<p>\t\tIn view of the above, I am<br \/>\n\tof the opinion that the petitioner was appointed as Assistant<br \/>\n\tmanager with the respondent purely on contract basis. So as soon as<br \/>\n\tcontract is over, it is the prerogative of the management to<br \/>\n\tterminate the service. I do not find any merits in the matter and<br \/>\n\ttherefore, the same is dismissed.
