(J)\n\nCITATION:\n 1981 AIR 1160\t\t  1981 SCR  (3) 268\n 1981 SCC  (2) 712\t  1981 SCALE  (1)579\n\n\nACT:\n     Penal Code-Crime  against public  servant\tfor  reasons\narising out  of performance  of official  duty-No reason for\ncommuting death sentence to lesser sentence.\n\n\n\nHEADNOTE:\n     The deceased  Bhagwan Singh  who was working as an Amin\nput the\t appellant's lands  to sale  for recovering  certain\narrears. The appellant and his two companions Mool Chand and\nDaya Ram  lay in  wait for  the deceased while he was on his\nway back  home. Daya  Ram first\t fired three  shots  at\t the\ndeceased as  a result  of which\t he fell  down.\t Immediately\nthereafter the\tappellant emerged  with a  sword and chopped\noff the head of Bhagwan Singh.\n     The appellant was convicted under section 302 read with\nsection 34,  I.P.C.  and  sentenced  to\t death.\t The  second\naccused was still absconding.\n     On the question of sentence\n^\n     HELD: There  is no reason for commuting the sentence of\ndeath to  the lesser  sentence of imprisonment for life. The\ndeceased had to perform his ministerial duties as an amin in\nputting the land to sale. He bore no personal grudge against\nthe appellant  nor had\the anything  to gain  for himself by\nselling the  appellant's lands.\t Such crimes  against public\nservants for  reasons arising out of the performance by them\nof their  public duties\t must be  put down with a firm hand.\n[269E]\n     The fact  that the\t second accused\t was absconding does\nnot reduce the gravity of the appellant's offence. [269D]\n\n\n\nJUDGMENT:\n<\/pre>\n<p>     CRIMINAL APPELLATE\t JURISDICTION: Criminal\t Appeal\t No.<br \/>\n362 of 1979.\n<\/p>\n<p>     Appeal by\tSpecial Leave  from the\t Judgment and  Order<br \/>\ndated 28.2.79  of the  Allahabad High  Court at Allahabad in<br \/>\nCrl. Bhatt for the Respondent.<br \/>\n     The Judgment of the Court was delivered by<br \/>\n     CHANDRACHUD, C.  J. The  appellant&#8217;s land was auctioned<br \/>\non December  26, 1976  in a  revenue sale  held\t to  recover<br \/>\narrears of  land revenue.  On the  same day, the land of one<br \/>\nMool Chand  was also sold for a similar reason. The deceased<br \/>\nBhagwan Singh, who was<br \/>\n<span class=\"hidden_text\">269<\/span><br \/>\nan Amin,  acted as  an officer of the Court in effecting the<br \/>\naforesaid sales.  After\t the  sale  proceedings\t were  over,<br \/>\nBhagwan Singh was returning home on a bicycle, with his peon<br \/>\nShripat, who is examined in the case as P.W.4 The appellant,<br \/>\nMool Chand and the latter&#8217;s son Daya Ram lay in wait for the<br \/>\ndeceased and while he was passing along on his bicycle, Daya<br \/>\nRam fired  three shots\tat him; two out of these hit Bhagwan<br \/>\nSingh, as  a result  of which  he fell\tdown. A split second<br \/>\nthereafter, the\t appellant emerged  with a sword and chopped<br \/>\noff the\t neck of Bhagwan Singh. Daya Ram is still absconding<br \/>\nbut the\t appellant was convicted by the Sessions Court under<br \/>\nsection 302  read with\tsection 34 of the Penal Code and was<br \/>\nsentenced to  death. He was also convicted under section 307<br \/>\nof the\tPenal  Code.  The  sentence  of\t death\thaving\tbeen<br \/>\nconfirmed by  the High\tCourt, the  appellant has filed this<br \/>\nappeal by  special  leave.  The\t leave\tis  limited  to\t the<br \/>\nquestion of sentence.\n<\/p>\n<p>     We see  no reason\tfor commuting  the sentence of death<br \/>\nimposed\t upon  the  appellant  to  the\tlesser\tsentence  of<br \/>\nimprisonment for  life. The fact that Daya Ram is absconding<br \/>\ndoes not  reduce the gravity of the offence committed by the<br \/>\nappellant. Bhagwan  Singh had  but performed his ministerial<br \/>\nduty as\t an Amin in putting the appellant&#8217;s land to sale. He<br \/>\nbore no\t personal grudge  against the  appellant nor  had he<br \/>\nanything to  gain for  himself by  selling the\tlands of the<br \/>\nappellant and  of Daya\tRam. Such  crimes committed  against<br \/>\npublic servants\t for reasons  arising out of the performance<br \/>\nby them\t of their  public duties must be discouraged and put<br \/>\ndown with  a firm  hand.
