We \u00a0 heard \u00a0 this \u00a0 case \u00a0 through \u00a0 videoconferencing. \u00a0 The \u00a0 Appellant \u00a0 was\u00a0<\/p>\n<p>present\u00a0in\u00a0the\u00a0Port\u00a0Blair\u00a0studio\u00a0of\u00a0the\u00a0NIC.\u00a0The\u00a0Respondent\u00a0was\u00a0present\u00a0in\u00a0our\u00a0<\/p>\n<p>chamber.\u00a0We\u00a0heard\u00a0their\u00a0submissions.\n<\/p>\n<\/p>\n<p>3.      The\u00a0Appellant\u00a0had\u00a0sought\u00a0a\u00a0copy\u00a0of\u00a0the\u00a0reserve\u00a0list\/panel\u00a0prepared\u00a0by\u00a0<\/p>\n<p>the\u00a0UPSC\u00a0for\u00a0the\u00a0post\u00a0of\u00a0Director\u00a0of\u00a0Agriculture,\u00a0Andaman\u00a0and\u00a0Nicobar\u00a0Islands\u00a0<\/p>\n<p>in \u00a0 November \u00a0 1998. \u00a0 The \u00a0 CPIO \u00a0 had \u00a0 observed \u00a0 that \u00a0 not \u00a0 only \u00a0 the \u00a0 desired\u00a0<\/p>\n<p>information\u00a0was\u00a0exempt\u00a0from\u00a0disclosure\u00a0under\u00a0Section\u00a08(1)\u00a0(d)\u00a0and\u00a0(e)\u00a0of\u00a0the\u00a0<\/p>\n<p>CIC\/WB\/A\/2010\/000010\u00adSM<br \/>\n Right\u00a0to\u00a0Information\u00a0(RTI)\u00a0Act\u00a0but\u00a0it\u00a0was\u00a0also\u00a0not\u00a0available\u00a0being\u00a0more\u00a0than\u00a0<\/p>\n<p>eight\u00a0years\u00a0old\u00a0while\u00a0its\u00a0retention\u00a0period\u00a0was\u00a0only\u00a0three\u00a0years.<\/p>\n<p>4.      During \u00a0 the \u00a0 hearing, \u00a0 the \u00a0 Respondent \u00a0 reiterated \u00a0 the \u00a0 same \u00a0 line \u00a0 of\u00a0<\/p>\n<p>argument.\u00a0We,\u00a0however,\u00a0do\u00a0not\u00a0agree\u00a0that\u00a0such\u00a0information\u00a0would\u00a0come\u00a0under\u00a0<\/p>\n<p>the\u00a0exemption\u00a0provisions\u00a0cited\u00a0above.\u00a0Neither\u00a0this\u00a0information\u00a0is\u00a0in\u00a0the\u00a0nature\u00a0of\u00a0<\/p>\n<p>commercial\u00a0confidence\u00a0or\u00a0trade\u00a0secret\u00a0nor\u00a0it\u00a0is\u00a0held\u00a0in\u00a0a\u00a0fiduciary\u00a0capacity.\u00a0This\u00a0<\/p>\n<p>is \u00a0 routine \u00a0 information, \u00a0 part \u00a0 of \u00a0 the \u00a0 administrative \u00a0 records \u00a0 arising \u00a0 out \u00a0 of \u00a0 the\u00a0<\/p>\n<p>selection \u00a0 process. \u00a0 Therefore, \u00a0 if \u00a0 this \u00a0 information \u00a0 is \u00a0 available, \u00a0 it \u00a0 must \u00a0 be\u00a0<\/p>\n<p>disclosed.\n<\/p>\n<\/p>\n<p>5.      We\u00a0 direct\u00a0 the \u00a0 CPIO\u00a0 to \u00a0 search\u00a0 for\u00a0 these\u00a0 records\u00a0 and,\u00a0 if \u00a0 available,\u00a0 to\u00a0<\/p>\n<p>provide\u00a0the\u00a0desired\u00a0information\u00a0within\u00a010\u00a0working\u00a0days\u00a0from\u00a0the\u00a0receipt\u00a0of\u00a0this\u00a0<\/p>\n<p>order.\u00a0However,\u00a0if\u00a0the\u00a0information\u00a0is\u00a0no\u00a0longer\u00a0held\u00a0and\u00a0has\u00a0been\u00a0destroyed\u00a0<\/p>\n<p>following\u00a0the\u00a0retention\u00a0schedule,\u00a0the\u00a0CPIO\u00a0must\u00a0clearly\u00a0say\u00a0so\u00a0and\u00a0indicate\u00a0the\u00a0<\/p>\n<p>year,\u00a0if\u00a0known,\u00a0in\u00a0which\u00a0the\u00a0relevant\u00a0records\u00a0had\u00a0been\u00a0weeded\u00a0out.<\/p>\n<p>6.      With\u00a0the\u00a0above\u00a0direction,\u00a0the\u00a0appeal\u00a0is\u00a0disposed\u00a0off.<\/p>\n<p>7.
