PUBLIC PROSECUTOR for\nRespondent(s) : 1, \n=========================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE MD SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 21\/10\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>[1]\t\tPresent<br \/>\napplication has been filed by the applicant to release him on bail<br \/>\nwho is convicted vide order dated 07.05.2011 passed by the learned<br \/>\nSessions Judge, Himatnagar in Sessions Case No.41 of 2010 for the<br \/>\noffence under section 363, 366 and 376 of the Indian Penal Code.\n<\/p>\n<p>[2]\t\tThis<br \/>\nCourt has gone through the judgment and order passed by the Trial<br \/>\nCourt. When the incident took place, victim was major and aged about<br \/>\nmore than 16 years. As per statement of victim, she was in love<br \/>\naffair with the applicant accused, she went with the accused and<br \/>\nstayed at different places with accused. Above aspect speaks volume<br \/>\nabout the conduct of the victim.\n<\/p>\n<p>[3]\t\tIt<br \/>\nis not proper to discuss evidence in detail while deciding the bail<br \/>\napplication.\n<\/p>\n<p>[4]\t\tApplicant<br \/>\naccused is in jail since about two years and considering the conduct<br \/>\nand age of victim and the manner in which incident took place,<br \/>\npresent application deserves to be allowed.\n<\/p>\n<p>[5]\t\tIn<br \/>\nview of above, application is allowed. Applicant  &#8211; accused is<br \/>\nordered to be released on bail on executing personal bond of<br \/>\nRs.10,000\/- (Rupees Ten Thousand only) with solvent surety of like<br \/>\namount to the satisfaction of Trial Court on condition that the<br \/>\napplicant &#8211; accused shall : &#8211;\n<\/p>\n<p>(a)\tnot<br \/>\nleave India without prior permission of the Court.\n<\/p>\n<p>(b)\tnot<br \/>\nenter Village &#8211; Chatreshwari, Taluka &#8211; Modasa, District &#8211;<br \/>\nSabarkantha for two years.\n<\/p>\n<p>(c)\tprovide<br \/>\nhis residential address to the concerned police station as well as<br \/>\nthis Court.\n<\/p>\n<p>[6]\t\tRule<br \/>\nis made absolute to the aforesaid extent.
