{"id":36759,"date":"2009-05-27T00:00:00","date_gmt":"2009-05-26T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/shri-vijay-bahadur-singh-vs-central-administrative-tribunal-on-27-may-2009"},"modified":"2018-12-29T15:16:55","modified_gmt":"2018-12-29T09:46:55","slug":"shri-vijay-bahadur-singh-vs-central-administrative-tribunal-on-27-may-2009","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/shri-vijay-bahadur-singh-vs-central-administrative-tribunal-on-27-may-2009","title":{"rendered":"Shri Vijay Bahadur Singh vs Central Administrative Tribunal &#8230; on 27 May, 2009"},"content":{"rendered":"<div class=\"docsource_main\">Central Information Commission<\/div>\n<div class=\"doc_title\">Shri Vijay Bahadur Singh vs Central Administrative Tribunal &#8230; on 27 May, 2009<\/div>\n<pre>                   CENTRAL INFORMATION COMMISSION\n                         Complaint No. - CIC\/WB\/C\/2007\/00651\n                      Right to Information Act- Section 18 (1) (b)\n\nComplainant:             Shri Vijay Bahadur Singh\nRespondent:              Central Administrative Tribunal (CAT)\n\n\nFacts<\/pre>\n<p>          The Commission has received a complaint from Shri Vijay Bahadur<br \/>\nSingh of Baqar Zai, Shahjahanpur, UP that his request under RTI Act<br \/>\nsubmitted to the CPIO, Central Administrative Tribunal, Allahabad seeking<br \/>\ninformation on the status of case No. 2228\/96\/841 of 1999 has not been<br \/>\nresponded to although the same was duly submitted along with the requisite<br \/>\nfee dated 7.4.2007.\n<\/p>\n<p>          Admitting the complaint of Shri Vijay Bahadur Singh under section 18 (1)\n<\/p>\n<p>(b) the Commission issued a notice to the PIO, CAT, Allahabad for furnishing<br \/>\ncomments on the complaint. In response the CPIO and Jt. Registrar, CAT,<br \/>\nAllahabad Shri P. Ulganathan has submitted his comments informing the<br \/>\nCommission as under:-\n<\/p>\n<blockquote><p>           &#8220;The Hon&#8217;ble Central Information Commission has held in<br \/>\n           appeal no. CIC\/AT\/A\/2006\/00586 dated September 18 of 2007<br \/>\n           that section 4 (1) (d) &#8220;does not apply to a Judicial proceeding<br \/>\n           conducted by a Court or a Tribunal as it refers only to<br \/>\n           Administration and Quasi Judicial decistars 1 of Public<br \/>\n           Authorities&#8221;. The date of hearing\/ Adjournment is always given<br \/>\n           by the Hon&#8217;ble Tribunal and it forms part of a Judicial<br \/>\n           Proceedings of the Particular case. Hence no individual can<br \/>\n           resort to the RTI Act for obtaining the information and it is left to<br \/>\n           the discretion of Tribunal to give such an information.\n<\/p><\/blockquote>\n<blockquote><p>           It is also pertinent to note that the applicant was in<br \/>\n           correspondence with the registry in connection with this case<br \/>\n           and this Tribunal in its discretion, had also been giving various<br \/>\n           replies advising him to file appropriate petitions before the<br \/>\n           registry. Copies of communication, sent by the Registry are also<br \/>\n           enclosed for ready reference which will provide that his requests<br \/>\n           were dealt with by this Tribunal under the Act and rule<br \/>\n           applicable to this Tribunal.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">1<\/span><\/p>\n<blockquote><p>    Sic<br \/>\n<span class=\"hidden_text\">                                            1<\/span><br \/>\n        It is also a fact that the applicant had not filed any First Appeal<br \/>\n       under Section 19 of the RTI Act and the present First Appellate<br \/>\n       Authority is Shri A. K. Ajmani, Registrar, CAT, Allahabad and not<br \/>\n       the Ministry of Personal Grievances and pension.&#8221;<\/p><\/blockquote>\n<p>       A copy of this comment, however, has not been endorsed to the<br \/>\ncomplainant.\n<\/p>\n<p>                              DECISION NOTICE<\/p>\n<p>      It is obvious from the comments submitted by the CPIO, CAT that the<br \/>\nrequest of Shri Vijay Bahadur Singh has indeed not been responded to at all.<br \/>\nIt is a sad comment on the functioning of CAT that complainant had to take<br \/>\nrecourse to the RTI Act to obtain what should have been routine information<br \/>\nas described in the Decision of this Commission cited in his response to our<br \/>\nComplaint Notice by CPIO Shri Ulganathan. At any rate even were CPIO CAT<br \/>\nto find fit to refuse the information sought a response was obligatory as per<br \/>\nSec 7 sub-section 1, citing reasons for such refusal. The CPIO, CAT is<br \/>\nhereby directed to supply the information sought by appellant Shri Vijay<br \/>\nBahadur Singh vide his RTI application dated 7-4-2007 within 10 working<br \/>\ndays of the date of receipt of this decision notice and the then CPIO will<br \/>\nalso show cause in writing by 29.6.&#8217;09 as to why a penalty for failing to<br \/>\nrespond to the RTI application may not be imposed on him @ Rs. 250\/- per<br \/>\nday commencing from 7.5.&#8217;07 when the information became due subject to a<br \/>\nmaximum of Rs 25,000\/-.\n<\/p>\n<p>       If not satisfied with the information received Shri Vijay Bahadur Singh<br \/>\nwill be well advised to file first appeal to the appellate authority, CAT u\/s 19 (1)<br \/>\nof the RTI Act.\n<\/p>\n<p>Announced.
