Vyas for petitioner and learned<br \/>\n\tAdvocate Mr. Arvind K. Thakur for respondent NO.1. Petitioner<br \/>\n\tAhmedabad Municipal Corporation has challenged award passed by<br \/>\n\tLabour Court, Ahmedabad in Reference (LCA) No. 1494 of 2003 Exh. 69<br \/>\n\tdated 10th May, 2010. Labour Court has partly allowed<br \/>\n\treference filed by workman and granted reinstatement with continuity<br \/>\n\tof service with 25% back wages of interim period with consequential<br \/>\n\tbenefits.\n<\/p>\n<p>I<br \/>\n\thave considered submissions made by both learned Advocates. I have<br \/>\n\talso kept in mind one fact that respondent workman was working as<br \/>\n\tSafai Kamdar for more than 20 years as per statement of claim filed<br \/>\n\tby workman, therefore, learned advocate Mr. Vyas is raising serious<br \/>\n\tobjection against granting of 25% back wages of interim period.<br \/>\n\tHowever, considering fact, question raised and involved in this<br \/>\n\tpetition would require detailed examination. Hence, Rule. Ad interim<br \/>\n\trelief in terms of paragraph 31(b) qua back wages only and there is<br \/>\n\tno stay granted by this Court against reinstatement.
