SHAH\n\t\t\n\t\n\n \n\nDate\n: 05\/05\/2010 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>1.\t\tThe<br \/>\npresent Civil Application under Section 5 of the Limitation Act has<br \/>\nbeen preferred by the applicants herein   original defendants to<br \/>\ncondone the delay of 248 days in preferring the Second Appeal<br \/>\nchallenging the judgement and order passed by learned District Judge,<br \/>\nBanaskantha at Palanpur in Civil Appeal No.36 of 2007.\n<\/p>\n<p>2.\t\tHaving<br \/>\nheard the learned advocates appearing on behalf of the respective<br \/>\nparties and considering the averments in the application,  it appears<br \/>\nto the Court that delay be condoned on imposition of reasonable cost<br \/>\nto be paid to respondent Nos.1 and 2.\n<\/p>\n<p>3.\t\tUnder<br \/>\nthe circumstances, delay caused in preferring the Second Appeal is<br \/>\nhereby condoned on condition that the applicants shall deposit an<br \/>\namount of Rs.3,000\/- with the Registry of this Court on or before<br \/>\n14th June,2010. On deposit of cost, Registry is directed<br \/>\nto pay the same by account payee cheque in favour of respondent No.1<br \/>\nand the cheque be given to Mr.Bachani, learned advocate appearing on<br \/>\nbehalf of respondent No.1. Rule is made absolute accordingly to the<br \/>\naforesaid extent.
