R.C.KODEKAR, APP for Respondent(s)\n: 1, \nNone for Respondent(s) :\n2, \n========================================= \n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE A.M.KAPADIA\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE BANKIM.N.MEHTA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 31\/01\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE A.M.KAPADIA)<\/p>\n<p>RULE.\n<\/p>\n<p>Mr.\n<\/p>\n<p>\tR.C.Kodekar, learned APP appears and waives service of notice of<br \/>\n\tRule on behalf of the Respondent &#8211; State of Gujarat.\n<\/p>\n<p>Having<br \/>\n\tregard to the facts of the case, the application is taken up for<br \/>\n\thearing today.\n<\/p>\n<p>The<br \/>\n\t  applicant &#8211; convict prisoner, who,  vide    judgment    and<br \/>\n\torder dated 15.11.2006  rendered    in      Sessions   Case No. 14<br \/>\n\tof 2006  by  the     learned     Additional Sessions Judge,<br \/>\n\tDistrict Narmada at Rajpipla,   has   been convicted for the offence<br \/>\n\tpunishable under Sections 302 etc.  of the Indian Penal Code and<br \/>\n\tsentenced to imprisonment for life, has filed this application<br \/>\n\tthrough jail authority, praying to enlarge him on temporary bail for<br \/>\n\ta period of 30 days to enable him to   find out a suitable match for<br \/>\n\this daughter who has reached to a marriageable age.\n<\/p>\n<p>We<br \/>\n\thave considered the submissions advanced by  Mr.R.C.Kodekar, learned<br \/>\n\tAPP for the Respondent &#8211; State of Gujarat and perused the<br \/>\n\taverments made in the application so also the jail remark sheet<br \/>\n\tforwarded by the jail authority along with the application.\n<\/p>\n<p>Upon<br \/>\n\tperusal of the jail remark sheet, we have noticed that the applicant<br \/>\n\thas undergone total period of 5 years and 4 days imprisonment and<br \/>\n\tduring the said period he was enlarged on temporary bail on two<br \/>\n\toccasions and has also enjoyed Furlough Leave on two occasions and<br \/>\n\ton all the occasions, he has surrendered in time.  There is no jail<br \/>\n\tpunishment and his conduct in jail is also good.\n<\/p>\n<p>In<br \/>\n\tview of this, if the Applicant convict is released on temporary bail<br \/>\n\tfor a period of 15 days from the date of his actual release, the<br \/>\n\tsame would meet the ends of justice.\n<\/p>\n<p>For<br \/>\n\tthe foregoing reasons, the Application succeed in part and and is<br \/>\n\taccordingly partly allowed.  The Applicant &#8211; Convict &#8211;<br \/>\n\tNAGIN<br \/>\n\tCHHITABHAI is ordered to be released on temporary<br \/>\n\tbail for a period of 15 days from the date of his actual release on<br \/>\n\texecuting a personal bond of Rs.5,000\/- before the jail authority on<br \/>\n\tusual terms and conditions. The applicant shall surrender to the<br \/>\n\tjail authority on completion of 15 days from the date of his release<br \/>\n\twithout fail.  During the period of temporary bail, the applicant<br \/>\n\tshall not abuse the liberty granted to him and shall maintain law<br \/>\n\tand order.
