The schedule\n\nu premises is nowresiclezztial premises. The plaintiff&#039;\n\nstates that he requires the schedule premises for his\n\n9\/\n\n\n\n4\n\nown bona\ufb01de use and occupation and to start the\n\nComputer Ins\ufb01tute.\n\nThe plaintiff further states that he   \n\na. legal notice dated 16.08.2001 .tei&#039;I}:1i.n.;;\u00a31iI1g:\u00ab \n\nef the defendanton 20.09.2001 end&quot;eelIed@:.pen&#039;~ \n\nvacate and deliver the vacant&#039;-vetgesseseiexj ef seheduie &#039;V\n\npremises on 21.09.i20Q_}. _He_  steites&quot; that the\ndefendant despite receipt&#039;-def   has not\n\n  therein. Apiainti\ufb02&quot; submits that the mnancy of the\n\n  Jdefe;1d311;t herein has been terminated and therefore the\n\n -_d.efeu*1de;1t becomes the trespasser in the schedule\n\nVt  &#039;xitemisee. The defendant is also iiable te pay the\n\ndamages at the rate of f~2s.3.00{)\/-- per month from the\nQ]!\n\n\n\n5\n\ndate of termina\ufb01on of tenancy till the date of\n\nschedule premises. Thettes1\u00a2fendatxjt\u00ab ~.f_1_.1.&quot;.t1j1er states that the plajnti\ufb01&quot;\nis the \u00e91bee]uteV..  the premises bearing Site\n\nNe.1\u00a7&#039;g4&#039;, 5 .ef &#039;tpreperty bearing survey No.88\/.3,\n\n  vvenkateshpuram, K.G.Ha}}i, Bangalore-\n\n__ further states that the defendant is a\n\nV _ tee:-int   of the premiees described in the\n\n on a monthly l\ufb01\ufb02t of Rs.750\/-- and that the\n\n--   commences \ufb01em 20131 of each month it} 19th of\n\n&quot; &quot;7s&#039;ueeeeeii2&quot;zg month. The echeduie premises is a non-\n\nresidential premises. The defendant took; the schedule\n\n1\n\n&#039;Z\/&#039;\n\n\n\npremises in the year 1981 to run a school. At the time of\n\ninception ef tenancy the rate of rent was Rs.5{).G,\/_\n\nmonth and the defendant has also paid__  &#039;l _\n\ndeposit of Rs.5,000\/~\u00ab te the pIaiI;j;i\ufb01&#039;. The \u00bb \n\nenhanced the rent from  \n\nperiodically. The defendant&#039;  &#039;etetes . \ufb01le    *\n\nbuilding comprises of   the\n\nground \ufb02eor is  .  ldlefelndant to run the\n\nabove   and style of &quot;SOPHIA\nNURSERY PRIMA\u00a7\u00a7l3V.:l\u00a7lGH SCHOOL&quot; which is aided\n\nand Vreeoglzijeed. _\u00a53yAA&#039;f_l1e&quot;&#039;llVState Government. Kejmada\n\n  Sehoel &#039;iS&quot;&quot;a1so run 2311 the premises. The\n\n   that the plajnti\ufb01&#039; issued a legal notice\n\n  has suitably replied for the same.\n\nt&#039; The fmdings of the Trial Court is as under:\n\n&#039;A      The Trial Court has framed the fo\ufb01owing issues:\n\n&quot;1. The plaintiff issued a notice on\n\n%:e;:}e\u00ab;e  as per the netzice, the plaintiff has\n\nV&#039; .V te1:ei&#039;ina\u00a3ed&#039;fhe tenancy of defendant and on the expiry of\n\nH K  &#039; &quot;V.:e&quot;L1:er1a:;c\u00a7}; the plaintiff demanded the defendant to deiiver\n\n--   possessicm of the schedule premises on 215*\n\n &#039;  &quot; &quot;deg of September 2001.
