Mathur, J.\n<\/p>\n<p>\tLeave granted.\n<\/p>\n<p>2.\tThese appeals, by special leave, have been preferred against the<br \/>\njudgment and order dated 1.4.2003 of Lucknow Bench of Allahabad<br \/>\nHigh Court, by which two writ petitions filed by the respondent L.P.<br \/>\nRai were disposed of.\n<\/p>\n<p>3.\tThe respondent L.P. Rai was posted as Senior Manager,<br \/>\nVINCO, in July 1989.  He was issued a charge sheet on 2.11.1989<br \/>\ncontaining 8 charges.   He submitted a reply to the charges levelled<br \/>\nagainst him.   The enquiry officer, after consideration of the material<br \/>\non record, submitted his report to the disciplinary authority.   A show<br \/>\ncause notice was then issued to the respondent on 7.12.1990.<br \/>\nThe disciplinary authority by his order dated 8.2.1991 held the<br \/>\nrespondent guilty of certain charges and imposed punishment of<br \/>\nrecovery of Rs. 42,214.57 from his salary, stoppage of one increment<br \/>\nwith cumulative effect and an adverse entry in his character roll.  It<br \/>\nwas further directed that during the period of his suspension, the<br \/>\nrespondent would only be entitled to the suspension allowance which<br \/>\nhad already been paid to him.\n<\/p>\n<p>4.\tThe respondent filed Writ Petitions No.2748 (SB) of 1993<br \/>\nchallenging the order of punishment.  He had also filed Writ Petition<br \/>\nNo.4517 (SB) of 1998 seeking his promotion.   The writ petitions<br \/>\nwere contested by the appellant herein, U.P. Cooperative Federation<br \/>\nLtd.   The High Court after consideration of the material on record<br \/>\ncame to the conclusion that no opportunity of hearing was given to the<br \/>\nrespondent during the course of enquiry inasmuch as he was not given<br \/>\nany opportunity to cross-examine the witnesses who were examined<br \/>\non behalf of the employer nor was he given any opportunity to lead<br \/>\nevidence in his defence. On these findings, it was held that as no<br \/>\nproper enquiry was held, the charges levelled against the respondent<br \/>\ncannot be said to have been proved.   The order of punishment dated<br \/>\n8.2.1991 was accordingly set aside.  The operative portion of the order<br \/>\npassed by the High Court reads as under :-\n<\/p>\n<p>&#8220;As a consequence of quashing of the punishment<br \/>\norders, the petitioner shall also be entitled to all the<br \/>\nmonetary and such other consequential benefits to which<br \/>\nhe would have been entitled in case the aforesaid<br \/>\npunishment orders had not been passed.  The petitioner,<br \/>\nthus, would be given all such benefits, within a period of<br \/>\nthree months from the date a certified copy of this order<br \/>\nis produced before the authority concerned.\n<\/p>\n<p>Both the writ petitions thus, disposed of finally.&#8221;\n<\/p>\n<p>5.\tMs. Rachana Srivastava, learned counsel for the appellant, has<br \/>\nsubmitted that the High Court having come to a finding that no proper<br \/>\nenquiry was held as the respondent was not given opportunity to<br \/>\ndefend himself and the enquiry suffered from procedural<br \/>\nirregularities, should have given liberty to the appellant to hold a fresh<br \/>\nenquiry against the respondent in accordance with law.   However, by<br \/>\nthe impugned order, the right of the appellant to hold a fresh enquiry<br \/>\nhas been foreclosed.  Learned counsel for the respondent has<br \/>\nsubmitted that L.P. Rai (respondent) has since retired from service and<br \/>\nit will not be proper at this stage to hold a fresh enquiry against him.<br \/>\nHaving considered the submissions made by learned counsel for the<br \/>\nparties, we are of the opinion that the charges levelled against the<br \/>\nemployee are not of a minor or trivial nature and, therefore, it will not<br \/>\nbe proper to foreclose the right of the employer to hold a fresh enquiry<br \/>\nonly on the ground that the employee has since retired from service.<br \/>\nIn this view of the matter, the order passed by the High Court requires<br \/>\nto be modified.   It is accordingly clarified that it will be open to the<br \/>\nappellant-employer to hold a fresh enquiry against L.P. Rai<br \/>\n(respondent) in accordance with rules.   Having regard to the fact that<br \/>\nthe respondent has already retired from service, it is directed that if<br \/>\nthe appellant chooses to hold a fresh enquiry, it must do so<br \/>\nexpeditiously, preferably within a period of four months from the date<br \/>\non which a certified copy of this judgment is issued by the office.  A<br \/>\ndecision on the question of promotion of the respondent employee<br \/>\nshall be taken after the conclusion of the enquiry.\n<\/p>\n<p>6.\tThe appeals are accordingly disposed of.
