    Petitioner was convicted and sentenced for<\/p>\n
the offence under section 138 of Negotiable<\/p>\n
Instruments   Act     in    C.C.410\/1993    and<\/p>\n
C.C.70\/1994   by     Judicial    First    Class<\/p>\n
Magistrate’s Court, Parapanangadi.   Petitioner<\/p>\n
challenged the conviction and sentence before<\/p>\n
Sessions Court, Manjeri in Crl.A.4\/1996 and<\/p>\n
9\/1996.       Learned   Sessions    Judge    on<\/p>\n
reappreciation  of   evidence   confirmed   the<\/p>\n
conviction  and  sentence  and   dismissed  the<\/p>\n
appeals.  The revisions are filed challenging<\/p>\n
the conviction and sentence.  Crl.R.P.1185\/2002<\/p>\n
is  filed   challenging  the   conviction   and<\/p>\n
sentence  in  C.C.410\/1993   as  confirmed   in<\/p>\n
Crl.A.4\/1996.     Crl.R.P.1186\/2002  is   filed<\/p>\n
Crl.R.P.1185 & 1186 of 2002       2<\/p>\n
challenging           the    conviction  and   sentence   in<\/p>\n
C.C.70\/1994 as confirmed in Crl.A.9\/1996. First<\/p>\n
respondent contended that promising visa petitioner<\/p>\n
obtained        Rs.10,000\/-     and  towards  its  repayment<\/p>\n
issued       Ext.P1      and  P5  cheques  respectively  for<\/p>\n
Rs.6000\/-        and      Rs.4000\/-  drawn  in  his  account<\/p>\n
maintained in Pallikkal Service Co-operative Bank.<\/p>\n
When the cheques were presented for encashment,<\/p>\n
they were dishonoured under Exts.P2 and P6 memos<\/p>\n
for insufficient funds.            By Ext.P3  and P7 notices<\/p>\n
first respondent demanded the amount covered by the<\/p>\n
dishonoured          cheques.      Both  the  notices   were<\/p>\n
returned unclaimed and petitioner did not pay the<\/p>\n
amount.        Petitioner pleaded not guilty.        Learned<\/p>\n
Magistrate tried both the cases together and on the<\/p>\n
evidence of Pws1 and 2 and Exts.P1 to P8 found the<\/p>\n
petitioner guilty.            He was convicted and sentenced<\/p>\n
to simple imprisonment for one month each and a<\/p>\n
compensation             of    Rs.6000\/-    and    Rs.4000\/-<\/p>\n
respectively and in default simple imprisonment for<\/p>\n
one month each. The contention of the revision<\/p>\n

petitioner is that the courts below failed to take<\/p>\n
note of the fact that the notices demanding the<\/p>\n
amount covered by the dishonoured              cheques were<\/p>\n
returned unclaimed and the complaints were filed<\/p>\n
before the expiry of 15 days from the date of<\/p>\n
respective dates of intimation and therefore they<\/p>\n
are     premature         and on   that  sole  ground,   the<\/p>\n
conviction        is     to  be set  aside.     It  is  also<\/p>\n
contended that petitioner has not been properly<\/p>\n
questioned under section 313 of Code of Criminal<\/p>\n
Procedure.\n<\/p>\n
      2.     Ext.P4 is the original notice sent to the<\/p>\n
petitioner and returned unclaimed.             Ext.P4 shows<\/p>\n
that the intimation was given to the petitioner on<\/p>\n
9.10.1993 and it was received on return by the<\/p>\n
first      respondent       on 15.10.1993.     Even  in  the<\/p>\n
revision, petitioner contended that the date of<\/p>\n
intimation namely 9.10.1993 is to be taken as the<\/p>\n
date of receipt of notice by the petitioner.             The<\/p>\n
case is that           if that be so, petitioner has 15 days<\/p>\n
time to pay that amount and excluding 9.10.1993 the<\/p>\n

15 days would expire on 24.10.1993.                But the<\/p>\n
complaint was filed on 22.10.1993 and therefore the<\/p>\n
complaint is premature. Learned Sessions Judge has<\/p>\n
considered this aspect in the proper perspective.<\/p>\n
Relying on the decision of the Apex Court in<\/p>\n
Narsingh Das Tapadia v. Goverdhan Das Partani<\/a>          2000<\/p>\n
(3) KLT 605) it was held that the relevant date is<\/p>\n
the date of taking cognizance and not the date of<\/p>\n
filing       of   the      complaint.  If that be  so,  the<\/p>\n
cognizance was taken after the expiry of 15 days<\/p>\n
from the date of receipt of notice and therefore<\/p>\n
the      conviction         is      legal.    Similarly  in<\/p>\n
C.C.70\/1994.           Ext.P8 the original notice which was<\/p>\n
sent by the first respondent and returned back<\/p>\n
unclaimed         by     the   petitioner.  It  shows  that<\/p>\n
intimation          was     given   to  the  petitioner  on<\/p>\n
16.11.1993. Excluding that day, the fifteen            days<\/p>\n
would expire on 1.12.1993. The complaint was filed<\/p>\n
only on 2.12.1993. Though petitioner contended that<\/p>\n
the complaints are premature and therefore the<\/p>\n
conviction         is     illegal,  in   the light  of  the<\/p>\n

declaration of law by the Apex Court in Narsingh<\/p>\n
Das Tapadia’s case (supra) the submission can only<\/p>\n
be rejected.\n<\/p>\n
      3. Section 142 of Negotiable Instruments Act<\/p>\n
provides that notwithstanding anything contained in<\/p>\n
the Code of Criminal Procedure, 1973, (a)no court<\/p>\n
shall take cognizance of any offence punishable<\/p>\n
under section 138 except upon a complaint, in<\/p>\n
writing, made by the payee or, as the case may be,<\/p>\n
the holder in due course of the cheque. (b) such<\/p>\n
complaint is made within one         month of the date on<\/p>\n
which the cause of action arises.           Clause (c) of<\/p>\n
the proviso to Section 138             provides that the<\/p>\n
drawer of such cheque         has to fail to make payment<\/p>\n
of the said amount of money to the payee or as the<\/p>\n
case may be, to the holder in due course of the<\/p>\n
cheque, within fifteen days of the receipt of the<\/p>\n
said notice. True, on receipt of the notice under<\/p>\n
section 138(b) of Negotiable Instruments Act the<\/p>\n
drawer has 15 days time to pay that amount.        As far<\/p>\n
as the complaint is concerned, he has to file the<\/p>\n

complaint before the expiry of thirty days from the<\/p>\n
date of receipt of the notice.         As declared by the<\/p>\n
Apex      Court      filing  of  a  complaint and   taking<\/p>\n
cognizance are two different and distinct aspects.<\/p>\n
In C.C. 410\/1993 though the complaint was filed on<\/p>\n
22.10.1993 and fifteen            days from the date of<\/p>\n
receipt of notice would expire only on 24.10.1993,<\/p>\n
learned Magistrate has taken cognizance only on<\/p>\n
2.12.1993.              So  also  in C.C.70\/1994   learned<\/p>\n
Magistrate has taken cognizance of the offence only<\/p>\n
on 7.2.1994 though the complaint was filed on<\/p>\n
2.12.1993. In both the cases         cognizance were taken<\/p>\n
much after the expiry of 15 days in both the cases.<\/p>\n
In such circumstances, conviction of the petitioner<\/p>\n
for the offence under section 138 of Negotiable<\/p>\n
Instruments Act in both the cases is perfectly<\/p>\n
legal.\n<\/p>\n
      4. Then        the only question is regarding the<\/p>\n
sentence.          The amount covered by Ext.P1 and P5<\/p>\n
cheques together is Rs.10,000\/-. Learned Magistrate<\/p>\n
awarded a compensation of Rs.6000\/- and Rs.4000\/-<\/p>\n

respectively with a default sentence of simple<\/p>\n
imprisonment for one month.           The calendar judgment<\/p>\n
in C.C.410\/1993 shows that petitioner was arrested<\/p>\n
on     21.9.1995          and was  released  on   bail   on<\/p>\n
23.9.1995.Records also shows that subsequent to the<\/p>\n
conviction also petitioner was in custody.          In such<\/p>\n
circumstances, interest of justice will be met, if<\/p>\n
the substantive sentence is modified to the period<\/p>\n
petitioner has already in undergone          in these cases<\/p>\n
and confirming the compensation with the            default<\/p>\n
sentence.\n<\/p>\n
      Revisions are allowed in part. While confirming<\/p>\n
the conviction as well as the compensation and the<\/p>\n
default       sentence,      the  substantive sentence   is<\/p>\n
modified        to     the  period petitioner  has  already<\/p>\n
undergone.\n<\/p>\n<\/p>\n
