Shri J K Shastri\n\n^\n\n CORAM:        Honble Shri Satish K Agnihotri J\n\n Dated:  20\/09\/2010\n\n: JUDGEMENT    \n<\/pre>\n<p>                   ORDER ORAL<\/p>\n<p>  APPLICATION FOR RESTORATION OF THE WRIT PETITION NO<br \/>\n                        3414\/1995<\/p>\n<p>  1.   The applicant has filed the instant application for<\/p>\n<p>       restoration of Writ Petition No. 3414\/1995, which was<\/p>\n<p>       dismissed for want of prosecution on 17.04.2006.\n<\/p>\n<p>2.   The instant application for restoration was filed<br \/>\non 16.09.2008 which is barred by limitation of 853 days.\n<\/p>\n<p>3.   On perusal of the office report, it is evident that<br \/>\nthe matter was listed for default before the Additional<br \/>\nRegistrar (Judicial) on 19.09.2008. Thereafter, the<br \/>\nmatter was again listed for default before the<br \/>\nAdditional Registrar (Judicial) on 14.10.2008,<br \/>\n16.10.2008 and  20.08.2010. Thus, it is evident that the<br \/>\napplicant has taken almost two years to remove the<br \/>\ndefault.\n<\/p>\n<p>4.   The applicant has also filed I.A. No. 1,<br \/>\napplication for condonation of delay in filing the<br \/>\nrestoration application. The applicant has also not<br \/>\noffered any cogent reasons for condonation of delay in<br \/>\nfiling the restoration application as even after delay<br \/>\nof 853 days, the applicant has taken more than two years<br \/>\nfor removing the default.  Thus, it appears that the<br \/>\napplicant himself is not interested in pursuing his<br \/>\npetition and after such a belated stage, prays for<br \/>\nrestoration of the writ petition, which was dismissed<br \/>\nfor want of prosecution.\n<\/p>\n<p>5.   A Division Bench of this Court, in A.Sriniwas Rao &amp;<br \/>\nOthers v. Union of India &amp; Others1 , while deciding a<br \/>\nsimilar issue, observed as under:\n<\/p>\n<blockquote><p>                &#8220;9.  Law  helps the  diligent  not<br \/>\n                indolent  person&#8217; is often  quoted<br \/>\n                and   reiterated   principle    to<br \/>\n                highlight  the  rationale   behind<br \/>\n                the  law  of limitation. There  is<br \/>\n                no  need  for us to add cause  law<br \/>\n                in   that   regard.  Law   reports<br \/>\n                contain     abundant    instances.<\/p><\/blockquote>\n<blockquote><p>                Although it is said that a  person<br \/>\n                who    approaches   Tribunal\/Forum<br \/>\n                after  the  limitation  prescribed<br \/>\n                by  the  statute  has  to  explain<br \/>\n                each    day&#8217;s   delay    to    the<br \/>\n                satisfaction  of  the   Court   or<br \/>\n                Tribunal,  as  the  case  may  be,<br \/>\n                even practicing liberalism in  the<br \/>\n                peculiar  facts and  circumstances<br \/>\n                of  this case, we do not find  any<br \/>\n                explanation    much   satisfactory<br \/>\n                explanation   to   constitute    a<br \/>\n                `sufficient cause&#8217; to condone  the<br \/>\n                enormous delay of 4 year 3  months<br \/>\n                and 3 days..&#8221;\n<\/p><\/blockquote>\n<p>  6.   This  Court,  in Chain Singh Pendre v.  State  of<\/p>\n<p>       Chhattisgarh &amp; Others2, relying on decisions of the<\/p>\n<p>       Supreme Court, in <a href=\"\/doc\/317602\/\">S.S.Rathore v. State of  Madhya<\/p>\n<p>       Pradesh, C.Jacob<\/a> v. Director of Geology &amp; Mining &amp; Anr.,<\/p>\n<p>       R.N.Bose v. Union of India, State of M.P. v. Nandlal,<\/p>\n<p>       U.P.Jal Nigam &amp; another v. Jashwant Singh &amp; another,<\/p>\n<p>       State of Punjab &amp; another v. <a href=\"\/doc\/65686\/\">Balkaran Singh, Tridip<\/p>\n<p>       Kumar Dingal &amp; Others v. State of West Bengal &amp; Others,<\/p>\n<p>       Yunus (Baboobhai<\/a> ) <a href=\"\/doc\/1684754\/\">A. Hamid Padvekar v. State  of<\/p>\n<p>       Maharashtra,<\/a>  held that no relief can be given to a<\/p>\n<p>       person who without any reasonable explanation approaches<\/p>\n<p>       the Court after inordinate delay.\n<\/p>\n<p>7.   The applicant herein has not offered any<br \/>\nsatisfactory explanation for such an inordinate delay of<br \/>\n853 days. Further, even after filing of the restoration<br \/>\napplication on 16.09.2008, the petitioner has taken<br \/>\nalmost two years in removing the default and listing of<br \/>\nthe case before this Court.\n<\/p>\n<p>8.   In view of the foregoing and for the reasons stated<br \/>\nhereinabove, the application for condonation of delay is<br \/>\nrejected.
