SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 16\/12\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>By way of this petition under<br \/>\n\tArticle 226 of the Constitution of India, the petitioner has prayed<br \/>\n\tfor the following reliefs  in para 13:-\n<\/p>\n<p>&#8220;(A)\tYour<br \/>\nLordships may be pleased to admit and allow this application.\n<\/p>\n<p>(B)\tYour<br \/>\nLordships may be pleased to issue writ of  mandamus direction, order<br \/>\nin nature of mandamus by directing respondent No.2 &#8211; Police<br \/>\nInspector Kagdapith Police Station to take appropriate steps against<br \/>\nthe subordinate In-charge of Investigation Officer of Application<br \/>\ndated 16.10.2010 (Ann.A)<\/p>\n<p>(C)\tYour<br \/>\nLordships may be pleased to direct the respondents not to harass or<br \/>\nnot to take any coercive action   against the petitioner.\n<\/p>\n<p>(D)<br \/>\nYour Lordships may be pleased to direct the respondent No.2  to<br \/>\nproduce action taken report before the Honourable Court.\n<\/p>\n<p>(E)\tGrant<br \/>\nsuch other and further reliefs that may be deemed fit and proper in<br \/>\nthe facts and circumstances of the case:&#8221;\n<\/p>\n<p>On<br \/>\n\tthe advance copy being given, Mr.K.P. Raval, learned Additional<br \/>\n\tPublic Prosecutor has appeared on behalf of the respondents &#8211;<br \/>\n\tauthorities, more particularly respondent No.2 &#8211; Police<br \/>\n\tInspector, Kagdapith Police Station and he has stated at the bar<br \/>\n\tunder the instructions of the Mr.B.B. Bhagora, 2nd Police<br \/>\n\tInspector, Kagdapith Police Station  that the petitioner<br \/>\n\t shall not be called to the Police Station unless<br \/>\n\trequired in any criminal proceedings. The respondent No.2 has also<br \/>\n\talso stated at the bar that henceforth he will see to it that unless<br \/>\n\tany criminal proceedings are initiated, he shall not call anybody to<br \/>\n\tthe police station so as to cause unnecessary harassment.\n<\/p>\n<p>In<br \/>\n\tview of the above, Mr.Shah, learned<br \/>\n\tadvocate appearing<br \/>\n\ton behalf of the petitioner  seek does not press the<br \/>\n\tpresent petition.\n<\/p>\n<p>In<br \/>\n\tthe peculiar facts of the case, the respondent No.2  &#8211; Mr.B.B.<br \/>\n\tBhagora, 2nd Police Inspector, Kagdapith Police Station<br \/>\n\tis hereby directed to act as per his statement recorded hereinabove.\n<\/p>\n<p>Present<br \/>\n\tpetition is accordingly disposed of as not pressed.\n<\/p>\n<p>\t\t\t\t\t\t\t[M.R.\n<\/p>\n<p>SHAH, J.]<\/p>\n<p>rafik<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Navinbhai vs State on 16 December, 2010 Author: M.R.
