Justice M.SASIDHARAN NAMBIAR\n\n Dated :09\/09\/2009\n\n O R D E R\n              M.SASIDHARAN NAMBIAR,J.\n\n              ------------------------------------------\n               CRL.M.C.NO.1779 OF 2008\n              ------------------------------------------\n\n             Dated      9th     September          2009\n\n\n                           O R D E R\n<\/pre>\n<p>            Petitioner         is      the      accused    in   crime<\/p>\n<p>No.412\/2008 of Thoppumpady police station registered<\/p>\n<p>under Annexure-A FIR for the offence under Section<\/p>\n<p>55(i) of Kerala Abkari Act. Prosecution case is that<\/p>\n<p>on  26\/4\/2008 first accused, the               security personal of<\/p>\n<p>the petitioner, who is second accused, the                   licensee<\/p>\n<p>conducted sale of the foreign liquor,                      after the<\/p>\n<p>permitted time at about 0.25 a.m and thereby committed<\/p>\n<p>offence  under  Section        55(i)       of     Abkari   Act.  This<\/p>\n<p>petition  is  filed     under       Section        482   of  Code  of<\/p>\n<p>Criminal Procedure to quash the FIR contending that<\/p>\n<p>even if the allegation is accepted, an offence under<\/p>\n<p>Section 55(i) is not attracted, as it would only<\/p>\n<p>amount to violation of condition No.20                  of Annexure-B<\/p>\n<p>license and at best, it may            attract an offence under<\/p>\n<p>Section 56 of Abkari Act.\n<\/p>\n<p>         2.   Learned counsel appearing for petitioner<\/p>\n<p>and  learned Public Prosecutor were heard.<\/p>\n<p><span class=\"hidden_text\">CRMC 1779\/09                 2<\/span><\/p>\n<p>          3.   Petitioner   has   produced   Annexure-C<\/p>\n<p>judgment in O.P.3379\/1999, whereunder, in a similar<\/p>\n<p>case  this   court,  though   dismissed  the   original<\/p>\n<p>petition holding that the offence attracted is only<\/p>\n<p>under Section 56 of the Abkari Act. Learned counsel<\/p>\n<p>relied on the decision of this court in <a href=\"\/doc\/98247\/\">Mohanan v.<\/p>\n<p>State of Kerala<\/a> (2007 (1) KLT 845) and argued that in<\/p>\n<p>any case, offence under Section 55(i) of Abkari Act is<\/p>\n<p>not attracted.\n<\/p>\n<p>          4.   Learned Public Prosecutor submitted that<\/p>\n<p>final report has already been submitted. But, learned<\/p>\n<p>Public Prosecutor   could not throw    light, whether,<\/p>\n<p>the final report is for an offence under Section    56<\/p>\n<p>or 55(i) of Abkari Act.\n<\/p>\n<p>          5.    Allegation in Annexure-A FIR is only<\/p>\n<p>that in violation of the conditions of the license,<\/p>\n<p>through    the  security   personal,   petitioner   the<\/p>\n<p>licensee,    sold liquor after the prescribed hour<\/p>\n<p>during mid night. Even if, that case is accepted, it<\/p>\n<p>would not attract an offence under Section 55(a) or 55<\/p>\n<p>(i) of Abkari Act. Offence attracted     would only be<\/p>\n<p>one  under   Section  56  of  Abkari  Act.
