Though served no one<br \/>\n\tappears for respondent Nos. 2 to 7.\n<\/p>\n<p>Appeal<br \/>\n\tis directed against an order dated 31.8.2007 passed by learned<br \/>\n\tAdditional Senior Civil Judge, Gandhinagar below Exh.5 in Special<br \/>\n\tCivil Suit No.169 of 2006.\n<\/p>\n<p>Respondent<br \/>\n\tNo.1 herein is the plaintiff in the said suit. He claimed to have<br \/>\n\tpurchased suit lands from respondent Nos. 2 to 7. The appellants<br \/>\n\talso claimed to have purchased the same lands by registered<br \/>\n\tsale-deed dated 18.11.2006.\n<\/p>\n<p>Learned<br \/>\n\tadvocate Shri Pahwa for the appellants submitted that even if the<br \/>\n\tinterim injunction granted in favour of the plaintiffs by the<br \/>\n\timpugned order is to be continued, the plaintiffs also should be put<br \/>\n\tto terms so that ultimately, if the suit is dismissed, interest of<br \/>\n\tthe present appellants is not jeopardized.\n<\/p>\n<p>Considering<br \/>\n\tthat the rival parties claimed ownership rights over the same<br \/>\n\tproperties and the appellants also have produced on record the<br \/>\n\tregistered sale-deed in their favour, which is not disputed by the<br \/>\n\tland owners, the request of the learned advocate for the appellants<br \/>\n\tis accepted.\n<\/p>\n<p>Under<br \/>\n\tthe circumstances, while disposing of the Appeal From Order as well<br \/>\n\tas Civil Application and not disturbing the impugned order passed by<br \/>\n\tthe learned Judge, it is further directed that even the original<br \/>\n\tplaintiff-respondent No.1 herein shall maintain status-quo with<br \/>\n\trespect to the title and possession of the suit property obtaining<br \/>\n\tas on today till the trial is over.\n<\/p>\n<p>With<br \/>\n\tthese directions, appeal from order as well as civil application is<br \/>\n\tdisposed of.\n<\/p>\n<p>(AKIL<br \/>\nKURESHI, J.)<\/p>\n<p>ashish\/\/<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Bhikhaji vs Bhagabhai on 11 September, 2008 Author: Akil Kureshi,&amp;Nbsp;
