02     14.02.2011                        The petitioner is in custody in relation to Punpun P.S.<\/p>\n
                       Case No.124 of 2009 instituted under Section 395 of the Indian Penal<\/p>\n
                       Code.\n<\/p>\n
                                         On behalf of the petitioner, it is submitted that on the<\/p>\n
                       date of occurrence petitioner was in judicial custody. It is further<\/p>\n
                       submitted that the learned Sessions Judge who disposed of the matter<\/p>\n
                       has committed error of record in holding that the mobile recovered<\/p>\n
                       from the petitioner was the stolen mobile of the informant, in fact,<\/p>\n
                       mobile recovered from the petitioner was the mobile of a relative of<\/p>\n
                       the petitioner.\n<\/p>\n
                                         In my view, both issues first pointedly raised before the<\/p>\n
                       learned Sessions Judge who was in a better position to appreciate to<\/p>\n
                       decide those issues.      I, accordingly, direct the petitioner to move<\/p>\n
                       before the learned Additional Sessions Judge-III, Patna once again on<\/p>\n
                       these specific issues who would decide the same and pass appropriate<\/p>\n
                       orders in respect of the bail accordingly keeping in view the<\/p>\n
                       antecedent of the petitioner as well.\n<\/p>\n
                                         This application is disposed of accordingly.<\/p>\n
